PETALUMA COMMUNITY DEVELOPMENT COMMISSION
RESOLUTION DETERMINING THE NECESSITY OF EXPENDING FUNDS FOR THE PLANNING AND
ADMINISTRATION OF PROJECTS AND PROGRAMS WHICH FACILITATE THE PRODUCTION,
IMPROVEMENT, OR PRESERVATION OF LOW AND MODERATE INCOME HOUSING
FOR FY 2008 AND FY 2009
WHEREAS, pursuant to Community Redevelopment Law, California Health and Safety
Code Section 33000 et seq. (CRL), the Petaluma Community Development Commission (PCDC)
has established and implemented a Low and Moderate Income Housing Fund (Housing Fund);
and,
WHEREAS, the Housing Fund is utilized for the production, improvement, and preservation
of low and moderate income housing; and,
WHEREAS, Section 33334.3(d) of the CRL requires the PCDC to make a determination
that PCDC funds expended from the Housing Fund for planning and administrative expenses are
necessary for the production, improvement and preservation of low and moderate income
housing; and,
WHEREAS, in order to comply with Section 33334.3(d) of the CRL for fiscal years 2008 and
2009 the PCDC desires to make a determination that funds expended from the Housing Fund in
the amount of approximately seven percent (7%) of the total budget were necessary for the
production, improvement and preservation of low and moderate income housing, such amount
not being disproportionate to the amount actually spent for the costs of production,
improvement or preservation of housing.
NOW, THEREFORE, BE IT RESOLVED THAT the Petaluma Community Development
Commission hereby finds and determines that funds expended from the Housing Fund for
planning and administrative expenses in fiscal years 2008 and 2009 were necessary for the
production, improvement and preservation of low and moderate income housing.
