C500306) 5410.54100 Current Fund Balance: $11,745,768.02 Recommendation: It is recommended that the City Council take the following action: Approve resolution seeking authorization from State to conduct resolution of necessity hearings for Sonoma 101-East Washington Street Interchange Project. 1. ^ First reading of Ordinance approved unanimously, or with unanimous vote to allow posting prior to second reading 2. ^ First reading of Ordinance approved without unanimous vote: Ordinance has been published/posted prior to second reading; see Attachment 3. ^ Other action requiring special notice: Notice has been given, see Attachment Summary Statement: The Cooperative Agreement entered into by the City and Caltrans on June 1, 2009 (Resolution No. 2009-075 N.C.S.), establishes the respective responsibilities of the State and of the City regarding appraisal, acquisition, relocation services and other right-of--way activities for the Project, including the City's responsibility to perform all right-of--way activities, including all eminent domain activities, if necessary,. regarding the acquisition of property to accommodate the road widening, and relocation of utilities necessary for completion of fhe project In order to meet the project schedule (metric exception deadline), the East Washington Interchange Project must advertise for bids no later than June 30, 2010. This requires all right-of--way and easement must be certified by Caltrans no later than that date. In order to ensure this critical schedule is maintained, the City needs to take all steps necessary to obtain the necessary rights-of--way for construction, including steps to initiate eminent domain, if necessary. In ths.case, because ofthe Cooperative Agreement, one of the steps needed before the Council could initiate eminent domain proceedings is for the Council to first approve a resolution seeking authorization from the State to conducf a resolution of necessity hearing for the project. Staff is recommending the right-of--way acquisition process follow two parallel paths: the first which staff hopes to facilitate is that property owners will either donate and/or accept the City's appraised value of the property. The second is to prepare for, and if necessary, initiate eminent domain proceedings in the event that other agreements with property owners cannot be reached. Attachments to A;;enda Packet Item: 1.
