Recommendation: It is recommended that the City Council take th'e following action: If a vacancy is
created. on the HCPC by the Council's separate action on appointment of planning commissioners, appoint one
member to the HCPC.

Summary Statement:. On September 21.,.2009, the City Council adopted Ordinance No. 2344 N.C.S., making
amendments to the Petaluma Municipal Code to effect the consolidation of SPARC and Planning Commission
and clarify the Council's authority to appoint new planning commissioners to the reconstituted Planning
Commission. As a result of the amendments, the Historic and Cultural Preservation Committee (HCPC) consists
of the Planning Commission, the Official Honorary City Historian (if any), and two members .from historical
preservation organizations appointed by the City Council for one year terms. (Petaluma Municipal Code sections
2.08.010, 2.03.0.10, Resolution No. '90.1 S N.C:S.) The two historic preservation organization members: serve
from July L to June 30 of each fisca'1 year, or until successors are designated, If a vacancy is created on the
HCPC by Council, action. on the separate agenda item appointing:planning commissioners, the Council may wish
to fill -that vacancy witfi appointment of anew HCPC member. Heritage Homes of Petaluma has nominated John
Terrell "Terry". Kosew~ic :to serve a one year term as representative of that historic preservation organization.

DISCUSSION AND ADOPTION OF RESOLUTION APPOINTING MEMBER
TO gIISTORIC AND CULTURAL PRESERVATION COMMITTEE
RECOMMENDATION: If a vacancy is created on the HCPC by the Councils separate action on
appointment of planning commissioners, appoint one member to the HCPC.
2. BACKGROUND: The background of the Council action leading to appointment of new planning
commissioners is stated in the staff report for Item 4.A on the. November 2 agenda. The need for a
new member of the HCPC may be created by Council. action appointing commissioners.
3. DlscussloN: If a vacancy on the HCPC is created and a new HCPC appointee chosen by the Council,
that appointee would serve. until June 30, 20.10, or until a successor is appointed. The appointment
would be effective upon seating of the new planning commissioners and the seating of the new HCPC
member at a meeting of the HCPC:.
4. FiNANC1AL IMPACTS: The financial impacts of the proposed appointment action include the cost of
staff and attorney time to prepare the agenda bill and resolutions for the appointment, approximately
$160.00.

APPOINTING
TO TIDE I~ISTORIC AND CiJLTiJRAL PRESERVATION COMMITTEE
WHEREAS, Petaluma Municipal Code Section 2.30.010 provides for the creation of a
Historical and Cultural Preservation Committee, with composition and membership to be
established by resolution of the City Council; and
WHEREAS, Resolution No. 9015 N.C.S., adopted November 24, 1980, provides that the
Historical and Cultural Preservation Committee shall be composed of the members of the Site
Plan and Architectural Review Comrttee (SPARC) and the Official Honorary City Historian, as
appointed by the City Council, and two .members from historical preservation organizations
appointed by the City Council; and
WI-IEYZEAS, the Petaluma City Council, at its September2l, 2009 Regular Meeting,
adopted Ordinance 2344 N.C.S. amending Chapter. 2.08 of the Petaluma Municipal Code
governing the Planning Commission and repealing Chapter 2:50 of the Petaluma Municipal
Code relating to SPARC to consolidate Planning Commission and site plan/architectural review
responsibilities in a single, reconstituted Planning Commission; and,
WI-IEREAS, Section 4 of Ordinance No. 2344•N.C:S: furtherprovides that "references to
the Site Plan and Architectural Review Committee or SPARC in.Petaluma land-use related
ordinances, regulations aril policies shall mean the Planning Commission"; and
W>EIEREAS, a vacancy exists on the. Historical and Cultural Preservation Committee for
.:one of the two seats occupied by members from historical preservation organizations; and
WHEREAS, Petaluma Heritage`H`o_rrres has nominated John Terrell "Terry" Kosewic to
serve a one year term on the Historical and Cultural Preservation Committee as a representative
of Petaluma Heritage Homes.
NOW, T>EIEREFOIZE°, >gE IT RESOLVED by the. City Council of the City of Petaluma
that is hereby appointed to the Historical' and. Cultural Preservation
Committee for. a,term beginning when said appointee is seated. at a meeting of the Historical and
Cultural" Preservation.Committee taking place on or after the effective date~of.Ordinance No
2344 N~C.S aril expiririg'June 30, 2010, oruntil his or her successor qualifies acid is seated.
BE IT FJRTI=IER RESOLVED that this resolution .shall take immediate effect but that said
appointment shall not be effective-until the effective date of Ordinance No. 2344 N.C.S.
