HomeMy WebLinkAboutResolution 2004-229 N.C.S. 12/06/2004 lZesolution No.2004-229N.C.S. of the City of Petaluma, California RESOLUTION APPROVING THE ISSUANCE OF A CERTIFICATE OF PUBLIC CONVENIENCE AND NECESSITY FOR GEORGE'S TAXI/YELLOW CAB OF SANTA ROSA WHEREAS, Mark Neese of George's Taxi/Yellow Cab has requested approval of a Certificate of Public Convenience and Necessity to authorize the operation of an eight (8) taxicab service inside the Petaluma city limits; and, WHEREAS, a public hearing was held on December 6, 2004 before the City Council to consider the operation of the taxicab company; and, WHEREAS, the City Council voted to recommend approval of the requested Certificate of Public Convenience and Necessity for George's Taxi/Yellow Cab of Santa Rosa; and WHEREAS, the request was heard on Monday, December 6, 2004 before the City Council, at which time the information was: heard and considered by the Council. NOW, THEREFORE, BE IT RESOLVED that it is ordered. and declared pursuant to Petaluma Municipal Code Chapter 14, that the City has found the taxicab company George's Taxi/Yellow Cab to be allowed to operate~subject to the fol~.lowing conditions: 1. This certificate of Public Convenience and Necessity is hereby issued to Mark Neese of George's Taxi/Yellow Cab, an eight (8) taxicab service inside City of Petaluma city limits. 2. The fare rates are hereby fixed, and may only be changed by City Council action. The rates are to be no more than what is outlined in City of Petaluma Resolution 2004-165 N.C.S. adopted October 1, 2004 which updates the maximum rates as outlined in Chapter 14, Section 14.20.260 of the Petaluma Municipal Code to be as follows: ® The base rate (aka: drop rate) shall be no more than $2.20. ® A per mile rate shall be no more than $2.50 and shall be in addition to the base rate. ® Wait time shall be no more than $30 per hour. ® A special rate for seniors (age 65 or older) will consist of no less than a 10% discount. ® No charge shall apply to additional passengers. ® No charge shall apply to luggage/baggage. Resolution No. 2004-229 N.C.S. • No charge shall apply to pets carried. • 24 hour daily operation shall be provided every day except Christmas and Thanksgiving when emergency service only shall be provided. • The above rates .shall apply on from the point of pick-up to the point of destination. 3. The eight (8) vehicles owned and operated by George's Taxi/Yellow Cab shall be inspected by the Police Department prior to operation inside City limits. Any defects uncovered during the inspection shall be corrected and the vehicle re- inspected bythe Police Department. 4. Any proposal for increase in the number of taxicabs shall be reviewed and approved by the City Council before expansion of service is made. 5. Certificates issued to owners of taxicab companies and automobiles for hire may be suspended or revoked by the Council for violation of any of the terms of such certificate or for misuse or abuse of the privilege thereby granted or failure to comply with any and all applicable state, federal and local laws and regulations.
