PUBLIC HEARING
The Council resumed their public hearing deliberation of the proposed
General Plan .
LAND USE AND
GROWTH MANAGEMENT CHAPTER
The Council continued their review of this chapter.
Transfer of Density (TDR) the Council had preliminary discussion on
"where to transfer the development rights to" . Infill was one
suggestion .

- If someone wants to increase density, he will have to buy TDR's or
come back with a proposal for low income housing .
- Anytime anybody comes in to .request an increase of density, the
Council wishes to be apprised of that fact.
- On ratio of residential construction, the Council wants a mechanism
to encourage 2 / 3 on the East side of the freeway and 1 / 3 on the
West side of the freeway and the development is to be based on
trafficyconstraints for the period of the plan.

- The City shall continue to identify specific growth or redevelopment
areas and prepare specific plans for them.
- No development will be approved if the increased traffic or the
infrastructure would need improvement.

Several other wording amendments were suggested by the Council for
staff and the consultant to incorporate into this Chapter.

MARCELLUS APPEAL
Mr. James McNamara, Civil Engineer, presented the appeal on behalf of
. Ace Marcellus.. The Planning Commission had denied the .property
owner's request to prezone a 2 acre parcel located at 984 Bodega
Avenue. ~ Staff noted that due to the number of different owners of
property in this area, development will most likely be incremental.
Circulation for inner parcels needs to be addressed. Tom and Rose
Nowak, Joe Belly and Harry deShane, neighboring property owners
spoke in opposition to the additional development Mr. Marcellus proposes.
~:, They have experienced access and drainage problems.
Mr. Marcellus noted he was not planning to add another access road to
Bodega Avenue. There: was more discussion about preplanning the
entire area for purposes of traffic circulation. Mr. Marcellus presented
a petition with sixty-nine signatures of persons stating they have no
objection to the prezoning. The matter was continued for ninety days
(with the consent of Mr. Marcellus) to look at the possibility of using
Holly Heights-Bodega Avenue access road for this area and to look at
better drainage.

LIBBEY APP-EAL UPHELD
Reso. 86-31 NCS upholding the appeal from Harold andPatricia Libbey
from the Planning Commission recommendation to deny the variance on lot
size. The neighbor originally had appealed the Zoning Administrator's
action to grant the variance. Douglas Dongman, representing the
Libbey's, described the proposed lot split and access to the: flag lot.
The Libbey's showed slides of the area, the location of -the proposed
construction and views of the neighboring houses. Steve Parrott a
neighbor read a letter opposing the lot split.. Louis Larsen; a neighbor,
urged: the Council` support th'e request. The Libbey's a`greed' 'to do
off-site .drainage improvement on West Street (increase capacity of
culvert located caster-ly of intersection of West and Howard. Planning
Director Warren Salmons read the findings the Council must exist in
order to uphold the appeal.

TRUCK TRAFFIC
PAYRAN ST.:REET
After some discussion, City Engineer Hargis was instructed to prepare
an ordinance specifying time constraints on Payran Street truck traffic
between E. Washington and Jefferson Streets, and banning through
traffic for trucks on. Payran between E. Washington and Petaluma.„Blvd.
North., .and banning truck, through traffic on East D Street. There was
some discussion but no• action about special permits for the two firms on
Payran Street which located there with the understanding they would
have truck access to East Washington. No specific time 'was scheduled
for this item.

Reso. 86-317 NCS approving annexation 1 to the Casa del Oro
Landscaping Assessment District for a project located on Josette Court (a

PUBLIC COMMENT
The Council concurred .there shall be an item on the agenda, prior to
transaction of any business, for public comments. The intent is this
item shall take a maximum of 15 .minutes and the Mayor shall allocate the
. ~~ ..time. This coincides with a revision of State law which becomes effective
January 1, 1987, requiring public comment time on agendas for
legislative bodies.

Reso. 86-318 NCS adopting subsequent Environmental Impact Report for
East of Ely Subdivision (Spring Meadow V, 72 single family dwellings,
Shelter Hills Village Units I and II, 1.08 single family dwellings and
Village East Unit 3) . Village East Unit 3 did not get through the
Residential Growth Control System rating process .

Introduce Ord. 1670 NCS amending Zoning Ord. 1072 by rezoning Spring
Meadow V from Planned Community District to Planned Unit Development
(located on the East side of Garfield Drive between Vista Lane and
Caulfield) . Michael Gallagher, McBail Company, requested an amendment
to the front yard setbacks and the number of lots. After discussion
between the Council and Mr. Gallagher, the number of lots was increased
to 74 and the setbacks were amended.. ' The two additional lots will be at
. the, beginning of the turn on Caulfield Lane adjacent to the proposed
. • neighborhood park.

Subdivision located on the northwesterly side of East Washington at Ely
Blvd. They commented on their housing construction.

Payran S.t. Area to discuss a, possible sandbagging project;. Staff''`~<
proposed an alternative project to • sandbagging which would -provide for
additional storm water carrying capacity downstream of the Payran St.
Bridge and conceivable could provide as much protection as the proposed
sandbag wall. By creating a wide, shallow bypass ditch in this: area, it
is possible to relieve storm waters , which accumulate on Payran St.
easterly of the bridge back into the Petaluma River immediately southerly
of Rio Vista Way . If the river builds up in height, it would be possible
for flood waters to relieve around the south side of the Payran St.;
Bridge through the proposed relief bypass channel. 'The proposed
bypass ditch would have a low berm on each side in order to protect the
existing houses on Payran St . and Rio Vista Way and prevent erosion of
the Petaluma River bank.
