This proposal is for use of Conservancy funds to purchase. a hay
ranch along Highway 37 owned by the Herzog families •, of .:Marie .and

SKY PARK ESTATES APPEAL UPHELD
The PTaerirng Commission's action to refuse to recommend issuance of a
negative declaration of environmental impact was appealed ~ .by the
developer of Sky Park Estates. Sky Park Estates is a 20 lot single

found it to be in conformance with airport land use policies . The
project is consistent with current zoning for the site.. Roger
Mikulecky, Vice President of Z:'A.M. Enterprises (the developer)
addressed the Council. Barbara Piper of 20.12 Appaloosa Drive,
ideas"tified herself as representing residents along Garfield Drive. She
spoke in opposition to the project and in opposition to any project
along Garfield Drive. There being no one else wishing to speak, the
hearing was closed. Relating to noise and the proximity of the
airport, the City Council's consensus was that if it is found that the
airport is responsible for some noise generation, the airport should
pay for the mitigation of that noise rather than requiring that from the
developer. Normal subdivision fences are to be the developer's
responsibility . The use of Garfield Drive for a collector street was
discussed. The City Engineer advised that it has been designed and
is to be used in the same manner as the collector streets Crinella
Drive and St. Francis Drive.
It was moved by Lynn Woolsey and seconded by Michael Davis to

THE MOTION WAS DEFEATED.
The Council adopted a 'motion to uphold the appeal and authorize
"~ issuance of a negative declaration of environmental' impact,' to refer the
subdivision back to the Planning Commission who is to regard this as a
minor infill with no significant impacts; regarding the fencing, the
standard subdivision fence will be required. Appropriate legislation
reflecting this action will be placed on the February 18 agenda.

Th'e' public hearing was opened. Councilman Bond addressed the need
:for non-senior handicapped housing which is the Petaluma Ecumenical
Projects item. Craig Meltzner from Burbank Housing explained how
the self-help housing construction projects work. They noted that

they will be asking for a density bonus, a waiver of lfees and; ,that
their project be expedited t<hrough the City's appr-oval network.,

SYCAMORE HEIGHTS NEGATIVE DECLARATION ±
Kurt Yeiter reviewed the project. The architect, Scott Barber.,. spoke.
for the developer, Leonard. Jay. Gordon Bartram, representing Acorn
Terrace and Oak Hill North, expressed concern that adequate .drainage
should.,be installed in this project to direct the ground water away
from Acorn Terrace which has problems with springs. an_d .drainage.
Other items of concern were the limited amount of .parking facilities the
need for equivalent setbacks on either side of the common fence, the
placement and size of the backyard trees, and the-~proposed removal of
most of the eucalyptus trees . _

In answer to the Council's question, how many more parking spaces
could be created if there were .parking allowed only on one side of the
street, the developer's engineer Emil Mogel estimated that ten more
parking spaces could be created... The Council agreed that the parking
restrictions should be made , a part of the covenants, conditions and
~.~~ ..restrictions for the project.
.. :Regarding the tree size, the Council. suggested there be a policy
relating to trunk diameter rather than. container size which is the
~:J``~ cu~rren.t tree size reference. It was noted. that an arborist selected by
. --: the City will work with the developer during all phases of construction
. ~,: _~ . ,'[~~F:.i•n order to save and protect as many of the oak. trees as possible and
.., to oversee the pruning .
A soils engineer will be on site during the grading phase.
The Council said>>: that the Building Inspector should inspect the site
before the the floor joists go on to be certain there are no tire_ ruts or
unnecessary unevenness in the ground surface within the building
5 ~ ~ footprint. The Council also also suggested that there be a larger

• - ~~ ~ drainage. Staff was asked to furnish the City Council with a list of
.drainage corrective measures when the final map comes before the

REPORT ON STATUS OF POLICE
REORG_ ANIZATION
Police Chief Murphy gave a progress .report in implementation of the
Council approved changes in the .Police Department. The former two
lieutenants have been promoted to Captain, three former sergeants
have been promoted to lieutenant and three officers were promoted. to
sergeant. Two lateral transfer police officers and four trainees have
been recruited. Two experienced officers will be assigned to full-time
drug law enforcement this month. In March, there will be an officer
assigned to traffic law enforcement.

suggested constructing a sidewalk on the southerly side of West Street.
