SUBJECT: Resolution Accepting Completion of the Community Center Roof Overlay Project
RECOMMENDATION
It is recommended that the City Council adopt the attached Resolution accepting completion of
the Community Center Roof OverlayProject.
•, BACKGROUND: •
The,subject project was the second phase in replacing and repairing the Community Center roof
which had reached the end of its.useful life: Additional phases of,repairs will be completed as
funds became available. This project involved installation of 60 mil thermoplastic polyolefin
(TPO) single-ply membrane over selected existing roof sections and 45 mil TPO single-ply •
membrane on parapet walls of the selected roof areas. Bids were opened on August 22;2012. On •
• September 10, 2012,. the City Council awarded the construction contract to Pacific Builders and
Roofing dba Western Single.Ply Roofing(WSP Roofing) of Roseville, CA, in the amount.of
$48,500. The project was completed on December 21 and, as required by-the City's charter, must
be accepted by City Council,prior to release of the retention to the contractor.
DISCUSSION
• The final construction.contract cost is $53,500, which includes a change order of,$5.,000'tare-
roof An`additional a rea. The approved project bud g et established a change order coritin g enc o f •$5,000:A change order in the amount of$5,000 was issued to maximize the limits of roof repair
for'this:project phase: Inspection was performed by Public Works and Utilities staff and the
City's Building Department. There are no disputed claims and the project'was•completed without
any significant incidences. •
The proposed action meets Council Goal: "Plan for and implement priority capital projects as
funding permits"

FINANCIAL IMPACTS
The budget for the Community Center Roof Overlay, Project.Number C16201306, was approved
byCity Council in the FY 12/13 budget for$56,000. With the design, construction'contract,
inspection and change orders, the total cost for the project w,as $55,300..The unspent $700 from
the budget will be returned to the General Fund. .
Following the acceptance of the project, the City Clerk will file a Notice of Completion with the
Sonoma County Recorder and the Finance Division will release the retention of$5,350.00 to the
contractor within 60'days.

'WHEREAS, in.accordance.with Section 68 of Article,X of the City of Petaluma Charter, •
Section 20162 of the'California Public Contract Code and other applicable laws, the City of
Petaluma solicited bids for'the Community Center Roof Overlay("Project"); and
WHEREAS,,bids for the Project_were opened on August 22, 2012 in accordance with
California Public Contract Code Section 4104.5 and other applicable laws; and
W e EREAS,the apparent low bidder for the Project was Pacific Builders and Roofing
dba Western Single Ply Roofing(WSP Roofing) with a bid of$48,500; and
WHEREAS, by Resolution No. 2012-131 N.C.S. adopted September 10, 2012,the City
Council of the City of Petaluma.found the bid of$4
y $48,500 for the Project to be the lowest
responsive bid; awarded the Project to WSP Roofing in the amount of$48,500 conditioned on
WSP Roofing's timely executing the Project contract and.submitting all required documents; and
authorized and directed the City Manager to sign the Project contract on behalf of the City upon
'such timely submission and,to execute on behalf of the City any amendments to the Project
contract that are,necessary to effectively complete the project and/or to realize the Project and/or
cost benefits for the City; and
WHEREAS, the following change order(CO) affecting the Project amount has been
• approved:
CO No. 1: Additional 1,070 s.f of roof area$5,000; and
WHEREAS,the final contract amount as amended including all change orders is
$53,500; and .
WHEREAS, City staff has inspected the Project and determined that it has been
completed in accordance with the contract requirements subject to the Contractor's continuing
warranty and other obligations pursuant to the,contract; and
• WHEREAS, based on the foregoing, staff recommends acceptance of the Project on
behalf o f the City;

NOW;THEREFORE, BE IT RESOLVED by the City Council of the City of Petaluma

as,follows:
1 The contract entitled Community Center Roof Overlay, City Project Number
C16201306 with a final contract amount of$53,500, is accepted as complete subject
to the Contractor's continuing warranty and other obligations pursuant to the contract.
2. The City Clerk/Recording Secretary is hereby authorized and directed to file a Notice
of Completion concerning the Project with the Sonoma County Clerk's Office within
ten (10) days of the date,of this Resolution.
3. Staff is hereby authorized and directed to release all undisputed•retention not subject
to pending change orders within sixty(60) days of the date of this Resolution and in
accordance with the terms of the Project contract, the Petaluma City Charter,
California Public Contract Code Section 7107 and applicable law.
