Mr. Berliner was not present to speak to his complaint about meterless
parking, so the item was continued to a later meeting. ",

APPEAL -JOHN MILLIKEN
MINI-MARKET USE PERMIT - _:.i•' ~ ._
The Council considered the appeal received from John Milliken .from the
Planning Commission refusal to grant a use permit for a mini-market to be
located on the corner of Cherry Street and Petaluma Blvd. North... Kurt
Yeiter of the Planning Department presented the background ~i"nformat-ion.
The hearing was opened. John Milliken presented his points of ap,p.eah and
responded to the Council's questions. In addition, 'the other speakers
were: Dr Noles, whose property adjoins the subject parcel, .expressed his
agreement to allow delivery trucks to exit through his driveway onto
Petaluma Blvd. North; Bruce Blynn, John Milliken's. partner, .reiterated
their proposal to improve a portion of Cherry Street (curb and gu,tter~:) as
well as a portion of Petaluma Blvd.. North (restripe to create five lanes,,; the
middle lane being reserved for left-hand, turns for ,traffic going either
. direction) ; Jim Hanna of 805 Petaluma Blvd.. North spoke in support•~of the
application; Fred Rogers, 14 West Street, spoke in support saying, this
would benefit the neighborhood.; Jack Hogan, 314 English Street., said both
of Mr. Milliken's stores are well run; George Milliken, D Street,.~spoke . on
his son's behalf.. 5,. ;-, 1,
Those speaking in opposition to the mini-market were: Ed Barone,, 31
Cherry Street, noted there are 50 students who use the street to. get to
and from school (St. Vincent's); a left turn would be difficult unless, you
cut the sidewalk; there is heavy sidewalk. traffic there; the . length of
delivery trucks runs from 35 feet to_65 feet.; there- are several delicatessens
within a one mile radius; this will .b,e . inconvenient for .the . resdents~~in~ the
neighborhood. Linda Barone, 31 Cherry Street, is opposed to just closing
the mini-.market between 2 am and 6 am; Cherry is a dangerous, little
street and only a small portion will be improved. Phyllis Powell, 20 West
Street, is opposed because of the traffic and noise on West Street.

The hearing was closed at 8:45 p . m. The .City Council asked staff to read
;,`.the ~ p:ermitted and conditional uses for the Highway Commercial zone so that
the public would be aware of the potential uses for this land.

UPHOLD MILLIKEN APPEAL -GRANT USE PERMIT
Reso. 85-131 NCS upholding the appeal and granting a use permit for a
mini-mart to be located at 715 Petaluma Blvd. North with the 12 conditions
listed in the April 9 staff report plus three additional conditions: (1) that
the mini-market close between tam and 6 am; (2) if noise becomes a problem,
the u.se permit review will occur sooner than one year; and (3.) a truck
egress agreement through Dr. Noles property be entered into between Mr.
..,Milliken and Dr. Noles. Introduced by John Balshaw, seconded by Michael

.;project. The public hearing was opened. Mr. Marvin Alldaffer, Vice

Planner Kurt Yeiter presented the Sycamore Heights application for a
general plan amendment from Suburban Low to Urban, prezoning of 8.17
acres and request that the Local Agency Formation .Commission .initiate
annexation proceedings . It was stated that this land is part of the original
~::i rcerrietery 'master plan area' . Councilmembers asked how this .8.17 acre
~~ f.deve'lopment will impact the.. future burial needs of the City. of Petaluma.
