The following item was removed from the Consent Calendar in order 'toy

CINNABAR SCHOOL- AT CAPACITY
Cinnabar School District requested the Council concur with the school
district's findings and adopt a school facilities impact fee schedule: ~=for, .
new housing construction in the Cinnabar School District within the
City Limits . Currently the Acorn Terrace Subdivision (57 units) is the:
only subdivision in the Cinnabar District. Proposed development of ~ the
adjacent lands of Murphy/Tomasini could bring 8.0 more -dwellings .into
the Cinnabar District. Gary Vickers-Barr, _Superintendent/"Principal,;
Mary Jean Burgess Board Member;, 'and Bob Henry. Attorney for Sonoma
County Office of Education addressed the Council on behalf of the
school district. Building Industry representative Charles Carson
advised that their industry is scheduling a meeting with. representatives
of the eight school districts in Santa Rosa who are experiencing' the
same problem.

The issues before. the Council are as follows:
(a) There is a school impact fee request in proper form; (b) There is
a possibility that the school district boundaries (Cinnabar and Petaluma
_ districts,) could be realigned as the City Limits lines change; (c)
:~,y, There'. is. a school facilities impact fee fund that could be the basis of a
joint powers agreement among the school districts that become impacted
with additional housing construction. It was noted the Waugh District
is also looking at additional student population. Mayor Mattei asked
that a letter be sent to the school district boards of directors inviting
them to join in a discussion of the various alternatives to fund
classrooms .
,a;,It was Council consensus to continue this item to April 1 when the
~,:,.~B~uilding Industry will report their findings relating to mitigation
- ~;rjcmeasures for the school districts. It was also Council consensus they
' would guarantee to do what is necessary to get a physical facility for
the additional children at Cinnabar School.
CAULFIELD PROPERTY /LAKEVILLE AT CAULFIELD
tziT.om Caulfield, owner of the block bordered by Payran, Caulfield,
,Lakeville Streets and Lindberg Lane, requested the. City abandon two
' strips of land on that block. One is 6.1 feet wide (Payran) by 255 feet
long; the other is a 30± foot strip parallel to the Caulfield curb line.
In addition, Mr. Caulfield expressed willingness to grant a 24± foot
-strip of Payran to the City of Petaluma. .There was a very long
discussion about the possibility of requiring that the 30± foot strip
along Caulfield Lane be dedicated to commuter parking.

i ,Tom Caulfield answered the Council's questions. Mr. Jim Watt, Lucky
yStores, expressed their deep concern about the liability exposure from
any requirement to place commuter parking on-site.
It was Council consensus to authorize staff to negotiate a price
settlement with Mr. Caulfield and to talk to CALTRANS about the
possibility for alternative siting of a commuter parking lot and to begin
vacation proceedings .

RADIO .BROADCAST TERMINATION
They City Council learned that Radio Station KTOB will discontinue
broadcasting the City Council meetings beginning January 1, 1985.
Mayor Mattei expressed the City's appreciation for that public service to
the community.

Representatives of the RACES expressed grave concern about. the.
problems encountered by ham radio. operators with signal leakage from
illegally installed cable wires. They were encouraged to keep records
of instances this occurred and to communicate that information to ithe
cable company who. assured that these problems would be checked.: as
they were apprised of them. '__

DAON/SONOMA HIGHLANDS LAWSUIT
City Attorney Joe Forest said that ~ Judge Sater of the Sonoma Superior
Court has ruled for the plaintiffs and directed that the actions taken
this year relating to Sonoma Highlands be 'vacated' . The actions
affected are:
Reso. 84-29 NCS Resolution relating to environmental review, Ord.
1571 NCS Rezoning to Planned Unit Development, Reso. 84-32 NCS
approving the development plan, and Reso. 84-33 NCS approving the
tentative map ., The Judge also requires preparation of a supplemental
or subsequent environmental impact report dealing with the effect of the
change in the project so as to route traffic primarily through "D"
Street.
