Councilman Perry arrived at 8:20 p.m.
Councilman Tencer led the Pledge of Allegiance to the ,flag .
CLOSED SESSION At 7:05 p.m. the Council recessed to a closed session
to discuss the Diamondhead litigation with the City Attorney. The
meeting was resumed at 7:20 p.m.
Minutes The October 1 minutes were corrected to accurately reflect
Councilman Tencer's vote on Resolution 84-244 NCS by deleting his
name from the "Aye" vote listing . The October 15 minutes were
approved as submitted.
Consent Calendar The following items from the consent calendar were
approved by the adoption of a single motion which was introduced by
Councilman Tencer and seconded by Councilman Battaglia.

RESO. 84-277 NCS
VALLEY MIST -DENIAL OF APPEAL
Planning Director Warren Salmons reviewed the application of Mar-mon
to construct a 421 unit three story apartment complex on property
located at Payran, Jefferson and Vallejo Streets. The public hearing
was opened at 8:00 p.m. The following persons spoke on behalf of the
project:
Attorney for the Developer, George Silvestri
John Margraff,• a principal of Mar-Mon, the
developers •
Keith Klein, architect of the project
Bill Brannan,. consultant for the developers

• ..The. concern .expressed by residents .most often was the density of the
• proposed apartment complex. Many- of them expressed a preference of
living adjacent to a light industrial zone than to a three story
apartment complex even if there • were a door planing mill in the light
'industrial zone.
In response to comments regarding racetrack noise, Bev Wilson,
Manager of the Sonoma-Marin Fair, noted the automobile racing is
scheduled from April through September at the Fairgrounds.

;~_;~ The hearing -was closed at 9:21 p.m. After a considerable amount of
:additional discussion, it was moved by Councilman Tencer and seconded
by Councilman Balshaw to deny the appeal of Mar-Mon from the
Planning Commission denial • to rezone the site to Planned Unit
Development to accommodate a 421 unit apartment complex. The City
Council denial is based on the findings of the Planning Commission as
well as the testimony received at the public hearing this evening.
