5 ADDRESSING THE STATUS OF CERTAIN RESIDENTIAL PROJECTS
6 FACING FORFEITURE OF 1989 AND 1990 ALLOTMENTS UNDER
7 THE PROVISIONS OF THE RESIDENTIAL GROWTH
8 MANAGEMENT SYSTEM ORDINANCES

10 WHEREAS, the City Council has adopted Residential Growth Management System to
1.1 .address allocations for calendar years 1989 and 1990 and beyond; and

13 WHEREAS, Section 17.26.070(F) of the growth management system ordinance (Chapter
14 17.26 of the Municipal Code) establishes a deadline of December 31, 1989, as the date by
15 which certain projects must have either an approved tentative map or have been through
16 preliminary review and have had their project application deemed complete by the
17 Planning Department; and

19 WHEREAS, according to those sections of the growth management ordinance listed
20 above, any project not achieving the required approval or determination of completeness
21 by December 31 shall forfeit its allotments unless the City Council finds that the deadline
22 should be extended; and

24 WHEREAS, four projects have been identified by staff as facing forfeiture of allotments:
25 1. Twin Creeks (65 allotments for 1989)
26 2. Country Club Estates III (73 allotments for 1990)
27 3. Fairway Meadows (50 allotments for 1990)
28 4. Corona/Ely (300 allotments for 1990)

30 NOW, THEREFORE BE IT RESOLVED that the City Council.. hereby extends the
31 forfeiture deadline of December 31, 1989, until June 30, 1990 for Twin Creeks based on the
32 following findings:

34 1. The project has made significant progress over the past year toward achieving
35 tentative map approval.

37 2. The project has completed a draft environmental impact report and public hearings
38 at the Planning Commission are imminent pending review of said report.

3. The project has particular characteristics that have made processing more difficult
and lengthier than normal.
BE IT FURTHER RESOLVED that the City Council also hereby extends the forfeiture
deadline of December 31, 1989 until February 28, 1990 for Corona/Ely based on the
following findings:
1. The projects have made substantial progress during the last year towards achieving
tentative map approval, establishment of an assessment district for major
infrastructure improvements, and approval of a development agreement.
2. The projects have completed environmental review (i.e., the Corona/Ely Specific
Plan EIR) and no additional subsequent significant adverse effects are expected.
3. Size of the project area and complexity of coordinating design and review of all
affected properties have made processing more difficult and is taking a lengthier
time to accomplish them normally allowed by the Residential Growth Management
Ordinance.
4. This extension is necessary to allow time to review and approve an ordinance
authorizing execution of a development agreement which will thereinafter control
these projects' development schedule.
ALSO, BE IT FURTHER RESOLVED that the City Council also hereby extends the
forfeiture deadline of December 31, 1989 until January 31, 1990 for Country Club Estates
III based on the following findings:
1. The project site has particular characteristics that have made subdivision design and
planning, and initial environmental review more difficult and lengthier to prepare
than other subdivisions.

1 2. The applicant has committed in writing (reference letter dated December 11, 1989
2 from Leonard Jay Enterprises, on file with the Department of Community
3 Development and Planning) to participate in processing an environmental impact
4 report. This participation will secure allotments until December 31, 1990.
