HomeMy WebLinkAboutResolutions 89-387 N.C.S. 12/11/1989~`l Resolution No. s9-387 N ~.5. of the City of Petaluma, California RESOLUTION APPROVING THE ISSUANCE OF A MITIGATED NEGATIVE DECLARATION PURSUANT TO CEQA AND LOCAL GUIDELINES FOR AMENDMENT TO GENERAL PLAN LAND USE MAP FOR LAND LOCATED AT MCNEAR AVENUE AND MISSION DRIVE (OWNED BY COUNTY OF 50NOMA) WHEREAS, the Department of Community Development and Planning received an application from the County of Sonoma requesting General Plan amendment to allow land owned by a public agency to be subdivided and sold for residential construction; and, WHEREAS, the proposal was deemed necessary by the public agency land owner in order to improve existing public facilities, and; WHEREAS, this application. is described as follows: 1. By the County of Sonoma to amend the General Plan land use designation on 1.4 acres located to the rear of the Veteran's Memorial Building, 1094 Petaluma Boulevard South at McNear Avenue and Mission Drive (AP No. 008-471-06) from ".Public and Institutional" to "Urban Standard"; and, WHEREAS, the Planning Commission held a duly notified public hearing on. this application on September 26, 1989 at which time all interested persons were allowed to participate on this matter; and, WHEREAS, all pertinent information presented to the Planning Commission, the minutes of the Planning Commission public hearings, and minutes of pertinent Music, Parks and Recreational Commission discussions, were presented to the City Council; and, WHEREAS, the City Council held public hearings prior to rendering a decision on this application at which time any and all interested persons were allowed to participate; and, 1 ftcs. No. .....8.9.:-.38.7......: N.C.S. ~.. 1 WHEREAS, an Initial Study was prepared for this application and the results, summarized and presented to the Planning Commission and City Council prior to their rendering a decision, suggested that approval of this proposal would not result in a significant adverse impact; and, WHEREAS, the staff and Planning Commission recommended approval of a Mitigated Negative Declaration for this matter; and, WHEREAS, the Music, Parks and Recreation Commission recommended that the option of a park be kept open until the Council reviews subdivision or development plans for this site; and, WHEREAS, the City Council considered this matter during a public hearing on October 6, 1989, NOW, THEREFORE, BE IT RESOLVED that the issuance of said Mitigated Negative Declaration is hereby approved pursuant to the California Environmental Quality Act (CEQA) and local Guidelines for this General Plan amendment, based on the following findings as recommended by the Planning Commission Findings 1. The project does not have the potential to degrade the quality of the environment, substantially reduce the habitat of a fish or wildlife species, cause a fish or wildlife population to drop below self-sustaining levels, threaten to eliminate a plant or animal community, reduce the habitat of a fish or wildlife species, cause a fish or wildlife population. to drop below self-sustaining levels, threaten to eliminate a plant or animal community, reduce the number or restrict the range of a rare or endangered plant or animal or eliminate important examples of the major periods of California history or prehistory. 2. The project does not have the potential to achieve short-term, to the disadvantage of long-term, environmental goals. 2 89-387 NCS ~~ S 3. The project does not have, impacts which are individually limited, but cumulatively considerable . 4. The project does not have environmental effects which will cause substantial adverse effects on human beings, either directly or indirectly . 5. The project is consistent with and further promotes the objectives, goals, and policies of the General Plan. 6.
