4 DENYING APPEAL OF PLANNING COMMISSION ACTION
5 ON A PROPOSED BUSINESS USE WITHIN THE ML ZONING
6 DISTRICT, AP NO. 007-630-01

9 WHEREAS, on August 18, 1989, the Planning Director acted to deny the application by
10 Paul and Allen Henderson for SPARC review of proposed plans for a business use within
11 the ML Zoning District; and,
12
13 WHEREAS, an appeal of the Planning Director's decision was appropriately filed by the
14 applicants on September 1, 1989, stating objection to the Planning Director's findings of
15 inconsistency of the proposed use with the intent of the General Plan and Zoning
16 Ordinance; and,

1.8 WHEREAS, upon consideration of all documentation and testimony submitted on the
19 matter, the Planning Commission at its regular meeting of September 26, 1989 acted to
20 deny the appeal; and,

22 WHEREAS, a timely appeal of the Planning Commission decision was filed by the
23 applicants on October 10, 1989 in objection to the Planning Commission findings of
24 inconsistency; and,

2b WHEREAS, the City Council held a public hearing on November 6, 1.989 to consider the
27 appeal and all previously submitted information, reports, and Planning Commission
28 minutes relative to this matter;

30 NOW, THEREFORE, BE IT RESOLVED that the City Council finds as follows:

32 1. The project, as proposed, does not conform to the requirements and intent of the
33 Petaluma Zoning Ordinance with respect to permitted uses within the ML Zoning
34 District.
35 2. The project, as proposed, does not conform to the requirements; intent, policies, and
36 provisions of the General Plan as they relate to properties designated for Industrial
37 use.

3. The proposed use is not consistent with the nature and character of other permitted
uses for the site.
BE IT FURTHER RESOLVED that the City Council hereby denies the appeal of Paul
and Allen Henderson, thereby upholding the Planning Commission decision to deny the
project as inconsistent with the Industrial land use designation and zoning for the site.
