HomeMy WebLinkAboutResolutions 89-312 N.C.S. 10/02/1989~4 resolution No. ~9--~_ N C.S. of the City of Petaluma, California RESOLUTION APPROVING ISSUANCE OF A MITIGATED NEGATIVE DECLARATION PURSUANT TO CEQA FOR THE CREATION OF BENSON ESTATES SUBDIVISION LOCATED ON THE SOUTH SIDE OF BODEGA AVENUE BETWEEN NORTH WEBSTER STREET AND BANTAM WAY; AP No.'s 006-441-06, 49, 50, 51, AND 54 WHEREAS, the Planning Commission has recommended issuance of a Mitigated Negative Declaration pursuant to the California Environmental Quality Act (CEQA) for a proposal to create a 20-unit residential subdivision and permit subdivision ordinance modifications south of Bodega Avenue between North Webster Street and Bantam Way; and WHEREAS, an initial study which noted potential impacts to earth, water, circulation, aesthetics, archaeology/historical resources and land use has been prepared for the project and has been reviewed by the Community Development and Planning Department; and WHEREAS, the results of this study have indicated that conditional approval of this project will not trigger any significant adverse environmental impacts; and WHEREAS, staff and the Planning Commission have recommended that a mitigated negative declaration be issued on the above project; NOW, THEREFORE, BE IT RESOLVED that the issuance of said Negative Declaration pursuant to the California Environmental Quality Act is hereby approved, based upon the following findings: Findings 1. Potential impacts related to earth, water, circulation and aesthetics will be mitigated through the conditioning of this tentative map. 2. Potential impacts related to archaeological/historical resources have been mitigated through the completion of an archaeological survey and by the conditioning of the tentative map. aes. v~.....89-312....... Ncs. °r 3. No other land use or environmental impacts have been identified. 4. The project, as conditionally approved, does not have the potential to degrade the quality of the environment, substantially reduce the habitat of a fish or wildlife species, cause a fish or wildlife population to drop below self-sustaining levels, threaten to eliminate a plant or animal community, reduce the habitat of a fish or wildlife species, cause a fish or wildlife population to drop below self-sustaining levels, threaten to eliminate a plant or animal community, reduce the number or restrict the range of a rare or endangered plant or animal or eliminate important examples of the major periods of California history or prehistory. 5. The project, as conditionally approved, does not have the potential to achieve short-term, to the disadvantage of long-term, environmental goals . 6.
