RESOLUTION APPROVING ISSUANCE OF A MITIGATED
NEGATIVE DECLARATION PURSUANT TO CEQA FOR THE
CREATION OF CHERRY HILL SUBDIVISION LOCATED AT
THE EAST END OF FREEDOM LANE NORTH, BETWEEN CHERRY
AND MAGNOLIA STREETS: APN 006-031-34
WHEREAS, the Planning Commission has recommended issuance of a Mitigated
Negative Declaration pursuant to the California Environmental Quality Act
(CEQA) for a proposal to create a 29-unit residential subdivision east of
Freedom Lane North, between Cherry and Magnolia Streets; and,
WHEREAS, an initial study which noted archeological, traffic, drainage, and
grading impacts to existing trees has been prepared for the project and has
been reviewed by the Community Development and Planning Department;
and,
WHEREAS, the results of this study have indicated that conditional approval
of this project will not trigger any significant adverse environmental
impacts; and,
WHEREAS, staff and the Planning Commission have recommended that a
mitigated negative declaration be issued on the above project;
NOW, THEREFORE, BE IT RESOLVED that the issuance of said Negative
Declaration pursuant to the California Environmental Quality Act is hereby
approved, based upon the following findings:
Findings
1. The proposal as conditioned will permit the preservation of the
physical and visual quality of the creek and existing mature trees on
site.
2. A prior initial environmental study has been completed, and specific
focused study has been completed in the area of traffic impac ts which
revealed no significant impacts of development which will not be

mitigated by conditions of approval for the PUD amendment and
tentative subdivision map.
3. The project, as conditionally approved, does not have the potential to
degrade the quality of the environment, substantially reduce the
habitat of a fish or wildlife species, cause a fish or wildlife population
to drop below self-sustaining levels, threaten to eliminate a plant or
animal community, reduce the habitat of a fish or wildlife species,
cause a fish or wildlife population to drop below self-sustaining levels,
threaten to eliminate a plant or animal community, reduce the number
or restrict the range of a rare or endangered plant or animal or
eliminate important examples of the major periods of California history
or prehistory.
4. The project, as conditionally approved, does not have the potential to
achieve short-term, to the disadvantage of long-term, environmental
goals .
5. The project, as conditionally approved, does not have impacts which
are individually limited, but cumulatively considerable.
6. The project, as conditionally approved, does not have environmental.
effects which will cause substantial adverse effects on human beings,
either directly or indirectly. °. '
7. The project is consistent with and further promotes the objectives,
goals, and policies of the General Plan.
