BACKGROUND: In February 2009, Congress passed economic stimulus legislation known as the American Recovery and Reinvestment Act (ARRA) of 2009, providing funding. for "shovel-ready" roadway and highway rehabilitation projects. According to the Metropolitan Transportation Commission (MTC) and Caltrans calculations, the City of Petaluma is eligible to receive ARRA funding up to $728,000 for construction of the McDowell Boulevard North Rehabilitation Project. This project was submitted to MTC and Caltrans in February as a back-up project in the event that more ARRA funding might later become available. In September, the City was informed by MTC that additional funding was available through the State ARRA program. This project involves pavement rehabilitation of McDowell Boulevard North, from Lynch Creek Way to Dynamic Street. Department of Public Works staff prepared the plans and specifications for the project, and on October 12, 2009, the City received federal authorization to advertise the project for bids. Gonsalves & Son, Napa, CA $742,905.00 $261,675.00 The engineer's estimates for construction are $661,000 for base bid, and $136,000 for additive bid alternate. The base bid involves rehabilitation/resurfacing of McDowell Boulevard North from Lynch Creek Way to Commerce Street, and the additive bid alternate extends the limit to Dynamic Street. Team Ghilotti Inc. is the apparent low bidder with a total bid of $664,076.50, which includes a base bid and additive bid alternate. This contractor has satisfactorily performed similar projects for other municipal agencies. Staff verified that Team Ghilotti possesses a valid Class A contractor's license No. 895384, which qualifies them to perform the -work. Staff recommends authorizing the City Manager to enter into contract with the low bidder, Team Ghilotti Inc., for both the base bid and additive bid alternate, to provide pavement rehabilitation of McDowell Boulevard North.. If the Council decides not. to award the contract at this time, the City may risk losing the ARRA grant, since the State deadline for award of ARRA contracts is December 31, 2009. FINANCIAL IMPACTS: The following is a breakdown of the estimated construction costs: Construction Contract (low bid) $664,076.50 Design 10,000.00 Construction Management 52,000.00 Geo-Technical Testing 30,000.00 Construction Contingency 66,000.00 CIP Overhead 16,000.00 Estimated Total Construction Costs $838,076.50 At this date, the estimated total construction cost is $838,076.50. The current economic environment accounts for the lower than estimated bid. The Federal ARRA grant will fully reimburse all eligible construction costs (i.e., construction contract, construction management and inspection, testing, etc.) up to $728,000, and the remaining funding will come from the Street Maintenance Fund in the approximate amount of $110,076.50 . Construction is tentatively scheduled to begin in April 201.0, and is expected to last about two months, weather permitting. S:\C1P Division\Yrojects\McDowel Boulevard North Kehab c16i010U4\Desi~~n\3 ~0 PCDC-City Council\award ofcontract.doc ATTACHMENT "1 RESOLUTION APPROVING THE PROJECT BUDGET AND RUTH®RIZING THE AWARD 'OF CONTRACT FOR THE AMERICAN RECOVERY AND REINVESTMENT ACT (ARRA) OF 2009 - MCDOWELL BOULEVARD N®RTH REHABILITATION PROJECT WHEREAS, City staff has prepared construction bid documents and advertised for construction of this Project; and WHEREAS, in accordance with California Public Contract Code Section 20162 and other applicable law, City staff solicited bids for the Project; and WHEREAS, the project was bid on November 12, 2009, and seven (7) bids were received and opened in accordance with applicable law; and WHEREAS, the lowest bid for the Project was from Team Ghilotti Inc. for $664,076.50; and WHEREAS, staff has determined that Team Ghilotti's bid satisfies the bidding requirements for the Project; and WHEREAS., staff has verified that Team Ghilotti possesses a valid California Contractor's License, Class A, number 895384 that qualifies Team Ghilotti to perform the Project; and WHEREAS, the Project has a Categorical Exemption pursuant to the California Environmental Quality Act ("CEQA") pursuant to Article 19, Section 15301, of Title 14 of the California Code of Regulations ("CEQA Guidelines"). NOW, THEREFORE, BE IT RESOLVED that the City Council ofthe City hereby: 1. Approves the Project Budget in the amount of $838,076.50. 2. In accordance with the City of Petaluma Charter and Municipal Code, California Public Contract Code Section 20162 and other applicable law, waives any and all non-conformance in the- bid of Team Ghilotti for the McDowell Boulevard North Rehabilitation Project, and finds the bid of $664,076.50 to be the lowest responsive bid and further finds that Team Ghilotti Inc. is the lowest responsible bidder. 3. Awards the contract for the McDowell ,Boulevard North Rehabilitation Project to Team Ghilotti Inc., in -the. amount of $664,076.50, the. amount of the lowest responsive bid for base bid and' additive bid alternate, conditioned on Caltrans' concurrence of the award and Team Ghilotti Inc. timely executing the project contract and. submitting all required documents, including but not limited to, executed bonds, certificates of insurance, and endorsements, in accordance with the project bid documents. 4. Directs staff to issue a notice of award to Team Ghilotti Inc. 5. Authorizes and directs the City Manager to execute the project contract on behalf of the City of Petaluma upon timely submission by Team Ghilotti Inc. of the signed project contract and all other required docurnents;:including but not limited to, executed bonds, certificates of insurance, and endorsements; in accordance with the project bid documents.
