Recommendation: It is°recommended that-the City Council take the following action:
Adopt the Resolution requesting an employment extension from the'California Public Employees' Retirement System
(CalPERS) to permit Sandra Sato to serve iri her temporary appointment with the-City of Petaluma as Interim Finance
Director throu h November 15, 20.1.0..

Summary Statement: CalPERS limits the:~number of hours a;retired-member.. may work to 960 in a fiscal year. Government Code
Section 21221(h) permits an employer to.request the CalPERS Board. of Administration to approve an extension of an appointment
lieyond the 960-hour limit. However, if.approved, the retired membercannot be employed in the position more than twelve months.
Sandra Sato is ietired into the CalPERS. City Manager John C. Brown appointed Sandra-Sato to the positior of InterimFinance
Director effective November 16, 2009. Mr. Brown understood and was aware when:he appointed Ms. Sato to the Interim Finance
Director position that she had already worked for another.municpality this'.. fiscal year and was reaching her 960-hour maximum at the
time of her appointment to'the City.of Petaluma. The City was also aware ofGovernment Code Section 21221(h) which permits the
Cty'to request an employment extension from the CalPERS Board of Administration. It is estimated that Ms. Sato will reach her 960-
hqur maximum allowed by CalPERS for temporary employment during the fiscal year on or about December 14, 2009. Ms. Sato
possesses the necessary,, and specialized skills to serve in the position of Interim Finance Director. The City plans to conduct a second
recruitment for the position of Finance Director in the summer of 2010 and needs the expertise of Ms. Sato until a replacement can be
appointed. Therefore, it is requested that the City Council adopt this resolution and request the CalPERS Board of Administration
allow Ms. Sato to exceed'the 960=hour maximum and approve an extensign.in accordance with Government Code.Section 21221(h) for
the tem orary em loyment as Interim Finance Director throu h Novembei 15, 201,0.

Discussion and Adoption of Resolution Requesting Employment Extension
for Interim Finance Director Sandra Sato Pursuant to Government Code Section 21221(h)
1. RECOMMENDATION:
Adopt the attached Resolution requesting an employment extension from the Ca1PERS to permit Ms. Sato
to serve. in her temporary appointment with the ~ City of Petaluma as Interim Finance Director through
November 15, 2010.
2. FINANCIAL IMPACTS:
In FY 2009/2010 the City budgeted a total of $178,346 for the position of Finance Director. The City
has had a temporary Interim .Finance Director which has been paid a total of $48,212 through
November 6, 2009.: The remaining .fund amount is $1'30,134.00. It is estimated that the cost of Ms.
Sato's employment through the end of the fiscal year is $97,920.00.

WHEREAS,, Sandra Sato retired from the City of Oakland in the position of Agency
Fiscal and Administrative Manager, effective August 1.;,2006; and
WHEREAS, City Manager John C. Brown apponted.Sandra Sato to the position of
Interim,Finance Director, a position deemed' to be of`lmted duration and requiring specialized
skills, effective November 16, 200,9; and
WIIEItEAS, City 1Vlariager';John C. Brown understood,and was aware that Sandra Sato
was subject tq a 960=hour maximum as a retired member in the ;California Public Employees'
Retirement ..System (CaIPERS) at the time of her appointment; and would reach her 960-hour
maximum. on or about December 14, '2009; and
WHEREAS, Sandra Sato is .expected to reach her 960-hour maximum allowed by
Ca1PERS for temporary employment during the fiscal year on or about December 14, 2009..; and
WHEREAS, the City of Petaluma conducted "a recruitment for the position of Finance
Director in May 2009 and extended"thee filing deadline date to July 15, 2009 and did not receive a
sufficient number of highly qualif ed applicants; and
WHEREAS, the City of Petaluma has an immediate: need to conduct and oversee a series
of in-depth and comprehensive reviews; which require thorough analysis and sound
recommendations for action; and
WHEREAS,, Sandra Sato possesses the necessary and specialized skills as a Finance .
Director and has direct. experience `in municipal finance haling served in that capacity for the
Cities of Oakland, Oroville, Suisun City, and Town of Windsor-for over eighteen years; and
WHEREAS, the City of Petaluma plans to conduct a second recruitment for, the position
of Finance Director in the summer of 2010 and needs the expertise of Sandra Sato until a
replacement can be appointed; and
WHEREAS;..1VIs. Sat_ois subject to a 960-hour maximum as a retired member in the
California Public Employees' Retirement System. (Ca1PERS);: and
WHEREAS; Ms Sato has worked for another public agency in Fiscal Year .2009-2010,
and is expected to reach her maximum of 96'0 hours for Fiscal Year 2009-2010 on or about
December 14; 2009; and .additional work beyond those hours will be required to fulfill the duties
of Interim Finance Manager until a successful recruitment can be completed and a permanent
Finance Manager retained;: -and
WHHEREAS, Government Code section 21221_(h) permits continued, employment in
excess of 960 hours in a fiscal:year, if the City requests and Ca1PERS grants approval therefore;
and
WIfiEREAS, this resolution will be presented to CaIPERS before the expiration of`Ms.
Sato's'960 hour~:maximum for the present fiscal year.
N,QW, THER'EFOR~, BE IT RESQLVED by the City Council of the City of Petaluma that:
1. `The Ca1PERS Board of Administration is hereby requested to approve an extension
for the temporary employment of Sandra Sato by the City of Petaluma through June 30, 2010,
the end of Fiscal Year-2009-2010, in excess of 960 hours; and
2. The Ca1PERS Board of Administrators is hereby requested to approve an extension of
the temporary employment of Sandra Sato effective July 1, 20.10 through November 15, 2010,
for a total period not exceeding twelvemonths frorri her riitial appointment, in accordance with
Government Code Section 21221(h); and ,
3. The City Manager shall immediately transmit. this resolution and request to the
CaIPERS Board of Administration.
