CERTIFYING A FINAL
SUBSEQUENT ENVIRONMENTAL IMPACT REPORT
FOR A MODIFICATION TO THE
RIVER OAKS/PETLAUMA VILLAGE
MASTER GENERAL DEVELOPMENT PLAN
TO ALLOW DEVELOPMENT OF PARCELS B AND C
TO BE KNOWN AS THE PETALUMA VILLAGE MARKETPLACE

WHEREAS, an application was filed by the Chelsea Property Group for a
modification to the previously approved Master Plan Program for the River
Oaks/Petaluma Factory Outlet Village, which outlined development guidelines for Parcel
A, to allow development of Parcel B consisting of up to 163,000 square feet of retail
space and development of Parcel C with a movie theater and 36,000 square feet of retail
space or up to 81,000 square feet of retail space and associated site improvements; and,
WHEREAS, the original conditions of approval imposed on the River
Oaks/Petaluma Factory Outlet Village project required additional environmental review
and the processing of a modification to the PCD prior to development of Parcels B and C;
and,
WHEREAS, the City of Petaluma is the lead agency under the California
Environmental Quality Act (Public Resources Code Section 21000 et seq.) with respect
to land development approval within the City limits; and,
WHEREAS, the City has prepared a Draft Subsequent Environmental Impact
Report (DSEIR), dated November 2002. The City extended the comment period beyond
the required 45 days, and the Planning Commission held public hearings on the draft
document on January 14, January 28 and February 3, 2003; and,
WHEREAS, the City has evaluated the comments received by public agencies,
utilities, organizations, special interest groups and persons who reviewed the DSEIR, and.
has prepared the Final SEIR (FSEIR), which contains responses to comments received
during the 45-day public review period; and,
WHEREAS, said comments received on the DSEIR, and a list of individuals,
groups, organizations, and agencies commenting on the DSEIR have been included in the
Final SEIR for said project, as required by Section 15132 of the CEQA Guidelines.
WHEREAS, the custodian of record of proceedings for this project is the City of
Petaluma Community Development Director; and,

WHEREAS, the City desires and intends to use the Final SEIR for the Petaluma
Village Marketplace PCD Modification as the environmental documentation required by
CEQA for the discretionary actions by the City required for this project; and,
WHEREAS, on April 22, 2003, the Planning Commission of the City of
Petaluma recommended that the City Council certify the Final SEIR; and,
WHEREAS, on June 21 and August 16, 2004, the City Council held a duly
noticed public hearing on the adequacy of the Subsequent EIR, accepting all written and
verbal reports and testimony. As part of this hearing process, the City Council has
considered the Draft and Final SEIR, recommendations bythe Planning Commission and
City staff, and comments received during the review process.
NOW, THEREFORE, BE IT RESOLVED that the Petaluma City Council does
hereby certify the Final SEIR based on the findings that:
1. The Final Subsequent Environmental Impact Report (Final SEIR) dated
April 2003, which consists of Volume I (Draft Subsequent Environmental
Impact Report as amended subsequent to public comment and Mitigation
Monitoring and Reporting Program); and Volume II (Responses to
comments document, appendices and supplemental information) has been
completed in compliance with the requirements of CEQA and the City of
Petaluma Environmental Review Guidelines.
2. The City Council has exercised its independent judgment in evaluating the
Final SEIR and has considered the comments received during the public
review period on the Draft SEIR.
