HomeMy WebLinkAboutResolution 2004-175 N.C.S. 09/13/2004 resolution No.2004-175 N.C.S. of the City of Petaluma, California A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PETALUMA MAKING APPLICATION TO THE LOCAL AGENCY FORMATION COMMISSION (LAFCO) SUPPORTING PROCEEDINGS FORA 2-ACRE PARCEL KNOWN AS 1081 BANTAM WAY, APN 019-070-043 PURSUANT TO THE CORTESE/KNOX LOCAL GOVERNMENT REORGANIZATION ACT OF 1985 WHEREAS, after public review and input, the City Council of the City of Petaluma adopted under Resolution No.2004-173 N.C.S., the Negative Declaration for the Rivas Subdivision; and, WHEREAS, in order to implement the project it is necessary to annex property known as Assessor's Parcel Number 019-070-043. NOW, THEREFORE, BE IT RESOLVED that pursuant to the Municipal Organization Act (Government Code 35000 et. Seq.) the Petaluma City Council hereby supports application to the Local Agency Formation Commission of Sonoma County for a proposed reorganization as follows: An annexation of an approximately 2-acre parcel located at 1081 Bantam Way, known as assessor's parcel number 019-070-043, to the corporate boundaries of the City of Petaluma; Said territory at 1081 Bantam Way is developed with an existing single-family residence, as described on the Rivas Subdivision Tentative Parcel Map. BE IT FURTHER RESOLVED that the reasons for the requested organization are: 1. The property is contiguous to the City and is within the adopted Sphere of Influence and General Plan Urban Limit Line of the City of Petaluma. 2. The City has completed an environmental review process for the area, which culminated in the approved Negative Declaration. 3. The owner of said property has initiated said annexation. 4. By Ordinance No.2192 N.C.S., the .City of Petaluma has pre-zoned the affected 2-acres to R-1 20,000. 5. The annexation is consistent with the objectives and policies of the General Plan, as documented in the Ordinance to pre-zone the property and the Resolution approving the Tentative Parcel Map for the Rivas Subdivision. Resolution No. 2004-175 N.C.S. 6. This annexation will enable several provisions of the General Plan to be achieved including: orderly improvement of City infrastructure, preservation of the city's Urban Limit Line, and preservation of County land use including residential and agricultural uses. BE IT FUR'I'IIER RESOLVED that the requirements of the California Environmental Quality Act (CEQA) and its Guidelines have been satisfied and thoroughly addressed in the Negative Declaration adopted by City Council Resolution No. 2004-173 N.C.S., on September 13, 2004, and herein incorporated herein by reference. The City Clerk is hereby authorized and directed to file a certified copy of this Resolution with the Executive Officer of the Sonoma County Local Agency Formation Commission. Under the power and authority conferred upon this Council by the Charter of said City.
