HomeMy WebLinkAboutResolutions 89-250 N.C.S. 08/07/19891 ', s FZesolution No. s9-250 N ~.s. of the City of Petaluma, California RESOLUTION APPROVING ISSUANCE OF A MITIGATED NEGATIVE DECLARATION PURSUANT TO CEQA FOR THE CREATION OF THE ST. JAMES ESTATES SUBDIVISION LOCATED ON ELY BOULEVARD BETWEEN EAST WASHINGTON AND EAST MADISON STREETS (AP No's 007-510-36, 42 and 43) WHEREAS, the Planning Commission has recommended issuance of a Mitigated Negative Declaration pursuant to the California Environmental Quality Act (CEQA) for a proposal to create a nineteen-lot residential subdivision on Ely Boulevard between East Washington and East Madison Streets; and, WHEREAS, an initial study which noted traffic and drainage impacts has been prepared for the project and has been reviewed by the Community Development and Planning Department; and WHEREAS, the results of this study have indicated that conditional approval of this project will not trigger any significant adverse environmental impacts; and, WHEREAS, staff and the Planning Commission have recommended that a mitigated negative declaration be issued on the above project; NOW, THEREFORE, BE IT RESOLVED that the issuance of said Negative Declaration pursuant to the California Environmental Quality Act is hereby approved, based upon the following findings: 1. The project, as conditionally approved, does not have the potential to degrade the quality of the environment, substantially reduce the habitat of a fish or wildlife species, cause a fish or wildlife population to drop below self-sustaining levels, threaten to eliminate a plant or animal community, reduce the habitat of a fish or wildlife species, cause a fish or wildlife population to drop below self-sustaining levels, threaten to eliminate a plant or animal community, reduce the number or restrict the range of a rare or endangered plant or animal or k~5. The project, as conditionally approved, does not have the potential to achieve short-term, to the disadvantage of long-term, environmental goals . 3. The project, as conditionally approved, does not have impacts which are individually limited, but cumulatively considerable. 4. The project, as conditionally approved, does not have environmental effects which will cause substantial adverse effects on human beings, either directly or indirectly. 5. Any impacts related to the potential archaeological sensitivity of the site are mitigated through conditions of approval. 6. The traffic impact of this nineteen-unit subdivision will be slight relative to the capacity of the existing road network and the impact of the subdivision will be mitigated through conditions of approval. 7.
