RESOLUTION APPROVING SALARY AND SUPPLEMENTAL WAGE BENEFITS
FOR, MANAGEMENT EMPLOYEES, UNITS 8 & 9
WHEREAS, the City Manager, pursuant to Section 28,
City of. Petaluma City Charter, is required and empowered to make a
recommendation to the City Council on matters related to employees'
compensation; and,
WHEREAS , the City Manager has reviewed the attached
Exhibit "A" and Exhibit "B" and recommends approval thereof,
NOW, THEREFORE, BE IT RESOLVED that the salary
and supplemental wage benefits as specified in the attachments for
Management Personnel are approved and shall become effective July 1, 1989.
BE IT FURTHER .RESOLVED that it is the City Council
policy that ninety (90) days notice is required by either party (City
Council and City Manager) prior to termination of services between said
parties .
Under the power and authority conferred upon this Council by the Charter of said City.

Section, ,3. Compensation for 'Clothing Loss
The City . Manager is authorized to provide. compensation to City
employees for ]sass or damage to their clothing which occurs during the
course of carrying out an offir-ial duty. A~ request for compensation
hereunder sha11 be submitted in writing, in detail, to the City Manager
via the department head. concerned. The amount of compensation, if
any, shall be at the discretion of the City Manager.
~Sectiori: 4,. Vacation, Payment at Termination
Emplsyees who terminate employment shall-. be paid in a lump sum for
all. accrued vacation leave earned prior to the effective date of
termination .
Section. 5. Sick Leave, Payment of
In the event of the death or retirement of an employee who has
completed °ten (10) or more years of continuous service with the City,
th'e employee should be paid or shall receive to his benefit fifty
percent (50~) of his' accumulated but unused sick leave not to exceed
4'80 hours.
.Section 6. 'Deferred, Compensation
The City of Petaluma shall make available to the members of this unit,
the City's Deferred Compensation Plan.
Sect~.on 7. PERS Employer Paid Contribution
The City shall pay Z$ of the employee's share of the Public Employees'
Retirement System :contribution . The City will also defer the taxes on
any remaining member's contribution. to PE;RS .
Seet~on;. 8.. Work During a .Local Emergency
Members of this unit- who are required try work during a Council
Declared .Local Emergency shall be paid at 1 x their hourly rate for all
hours beyond their normal work day.
INSURANCE
Section 9. Health Insurance.
During the period of this Memorandum of -.Understanding, the City shall
pay any premium :increases beyond the current City contributions as
listed below.. No~ increase in the dollar amount of the employee
contributions sYiall be assessed during the term of this Memorandum of
Understanding, with the exception of the. Sonoma County P]an.

During the term ~~of this plan the City shall contribute $42.18 per
month,-per .eligible emphyee toward the premium for a group dental
insurance p9~n. Additionally, the City shall contribute $7.00 per
month toward an Orthodontia plan, $1,000 .per' child, at a 50~
co-payment rate .
Section 11. Life Insur-ance
A . During the term of this fiscal ,year thee: City shall contribute
$.36%$1,000 per month per eligible employee toward a group term
life insurance plan in the amount of $10,000 per employee.
-B . Management ;Life . .Insurance shall be in the amount of one and
one-.half (1-1/2) dimes their annual salary rounded try the nearest
even dollar, i.e., $12,000, $13,000, etc, not to exceed $100,000.
Section 12. Long-Term Disabi]ity
The City shall provide along-term disability plan, premium to be paid
by the City.
Section .13. Vision Insurance

During the term of this fiscal year the City shall contribute $11.55 per
month per eligible employee for a family vision plan, effectsve August
1, 1989.
LEAVE
Section 14:. Vacation
A. Amounts. All regular employees of the City of Petaluma, after
working one. 'full year are entitled try the equivalent of eighty (80)
.hours of vacation with pay in the year following the year in
which vacation is earned.
A,11 regular employees of the City of Petaluma, after five (5)
years of continuous service with the City, and beginning with the
sixth, year, shall be entitled to the equivalent ,of one hundred
twenty (120) -hours of vacation per year.
.After ten (10) years of continuous service. with the City, eight
(8) hours of vacation shall be added for each year of continuous
service to a maximum of one hundred sixty (160) hours of
vacation .

Section 15. Sick Leave
`A . General Sick have with pay shall .be granted to all employees as
set forth in this section, Sick leave is not a right which an
" employ..ee may use at his discretion., .but rather, shall be used
only ;in case of personal illness, disability or the serious illness
or injury of an employee's family member which requires. the
employee'"s attention,. The term family members shall include:
pouse, children,, parents, spouse=s parents, brothers, sisters or
other inclivcluals whose relationship xi the employee is that of a
dependent or near dependent.
B . Accrual Sick leave shall accrue to all full.-time employees at the
:rate of eight hours for each month of continuous service. No
employee shall accumulate more sick: leave in, any year than
provided .
C . Relationship. to Workers'. Compensation.. Benefits shall be payable
in situations wFier"e employee absence is; due to industrial injury
as .provided in California State- Workers' Compensation Law. The
amount of disability payments paid to the injured emp].cyee shall
be deducted from salary payable t~ the employee while on sick
leave. During the first three (3) calendar days of absence for
industrial disability, employees will be compensated at their full
. .rate. of pav without deduction from sick Teave unless they are
hospitalized.. Absences resulting in immediate hospitalization or
absences continuing beyond the third day shall be charged
.against the employee at the rate of one-half (1/2) day for each
day of absence credited or compensated by wor'-kegs' compensation
insurance,; provided the City receives. ail compensation pai~7. by
workers' compensation payments .only, without City payment for
salary at no loss of sick leave. Sick leave for industrial injury
:shall not be allowed for a disability .resulting from sickness,
self-inflis~ted injury or wilful misconduct..
All, .employees -r-eceiving .full salaries in .lieu of temporary disability
payments pursuant to Section 4850 Labor Code are entitled ~
accumulate sick leave during such periods of disability.
Section -16.. Bereavement .Leave
In the: event of the death of an employee's spouse,, mother,
step-.mother, mother-in-law, father, step-father,, father in law,
brother, .sister, child,, including an adopted child., grandchild and
grandparent, an .emp]oyee who attends the funeral shall. be granted
time off' work with pay . The amount of" time off work with pay shall.
be only that which is° required to. attend ~ the funeral and make
necessary 'funeral ar-rangements, but in no event ;shall it exceed three
(3) working days. These three (3) days shall -not:. be chargeable to
sick. leave., An 'ad_dtional two (2) days required for necessary .funeral.
arrangements may be charged to the emp]~~yee's sick leave and any
additisnal. time beyond these two days may be charged to accumulated
vacation or• leave without .pay. Such bereavement leave shah not be

accruable from fiscal year to fiscal year, nor shall it have any
monetary value if unused.
Section 17. Holidays
A. Fixed Holidays. The. City shall observe. eleven (11) fixed-date
Yiolidays. These ho]days shall be establshecl for the City's fiscal
year as determined by City Council. resolution .
B. Floating Holiday. During the period. of this Compensation P]an
the City will authorize one (1) "Floating Holiday" per employee,
which may be taken by the employee at a time se]ected by the
employee, subject to operational. :requirements and approval
determined by the City. Employees hired between July 1 and
December 31 will be eligible for a "Floating Holiday" during the
course of the Fiscal Year.
.Section.: 18. Military Leave
Mi]itary leave shall be arranged in accordance with the provisions of
State .law. All employees entitled to military leave shall give the
appointing power an opportunity within the limits of military
regulations to determine when such leave shall. be taken.
Section 19. Leave of Absence without Pay
The. City Manager may grant a permanent or probationary employee
leave of absence without pay or seniority fora period not to exceed
three (3) months,. Good cause being shown by a written request, the
City Manager may extend the leave of absence without pay for an
additional period not. to exceed six (6) months. No such leave shall be
granted except upon written request of the employee setting forth the
reason .for the request, and the approval will be in writing. Upon
expiration of a regularly approved leave. or within a reasonable period
of time after notice to return to duty, the employee shall be reinstated
in the' position held at the time leave was grant-~ed. Failure on the
part of an employee on leave fn report promptly at its expiration, or
within :a reasonable time. after notice to return to duty, shall be cause
for discharge.
Section 20.. Jury Leave
Every :classified' employee of the City who is called or required to
serve as a trial juror shall be entitled to absent himse]f from his
duties with the City during the period of such service or while
necessarily ..being present in court as a result of such call. Under
such circumstances., the employee shall be paid. the .difference between
his full salary and any payment received by him, except travel pay,
for such duty.
Sectis~n 21. Administrative Leave
Members of this unit. are eligible for administrative leave. Days may
be granted ~by the City Manager upon written request, not t~ exceed
ten (10) days -per Fiscal Year.

Section, 1. Term
This :compensation plan shall be for a one (1) year term for the fiscal
year commencing July 1, 1989, through June 30, 1990.

Section, 3.. Overtime -Police Lieutenants
O'vertime at the regular rates of pay is authorized under the following
carcum'stances for Police Lieutenants::
1, When, extra duty is required by call-out or extended service, due..
to a .major- emergency situation, .e~. , flood, earthquake, SWAT
operatis~n or other major unusual ..incidents requiring the presence
" of a Lieutenant.
2. 'When required for the proper investigation of extremely pressing
.personnel ,matters,: such as serious personnel complaints or officer
involved shooting'., when authorized by the Chief of Police.
3. To fill .behind. another Lieutenant to provide adequate shift
supervision.. during periods of high activity or special events with
the approval of the Chief of Poli:ce.. We feel routine vacancies
,should be filled by an Ac1~ng Watch Com-mander when possible tea
provide training exposure to the Sergeants.
Section 4,, Compensation for .Clothing Loss
.The .City Manager is authorized to provide compensation to City
employees for- loss or damage to their c]pthing w"hich occurs during the
course, of carrying out. an official duty.. A .request. for compensation
hereunder shall be submitted in writing, in detail, to the City Manager
via the department• head concerned. The amount,of compensation, if
any; shall. be at the discretion of the City Manager.
Section :5;. Vacation,.. Payment at Termination
Employees who terminate employment shall. be paid in a lump sum for

Section 7. Deferred Compensation
The City of Petaluma shall -make available to the members of this urLt,
the City's Deferred Compensation Plan.
Section 8. Holiday Pay
The City shall: pay Battalion Chiefs and Police Lieutenant .for eleven
(11) holidays in the month of December in lieu of giving time off.

Section. 9 Court Appearances:: Pollee Management Personnel
T:he City will compensate a minimum of four (4) hours at time and
one-half for each officer for court appearances on his own time;
additionally, time and one-half (1-1/2) shall be compensated for all
hours actually worked in court beyond such four (4') hours .
An employee receiving full salary while .not working, pursuant to Labor
Code Section 4850, shall. not be granted further compensation for court
time unless this court time. (including all related professional activities)
exceed the number of hours in the regular workday (eight (8) or ten
(10') , depending upon his or her schedule:) in one day or 40 hours in
one week; if such court time and related professional activities exceed
eight (;8) or ten (10) .hours in one :.day (whichever is the applicable
workday or 40 hours in one week) the .employee shall be compensated
for such additional time at the applicable overtone rate.
Section. T0. PERS Employer Paid Contribution
The City shall pay 7 0 of 'the emp]oyee's share of the Public Employees'
Retirement System contributir~n. The City will also defer the taxes on
any remaining member's ,contribution to PERS.
Section 11. Work During a .Local Emergency
Members of this unit who are required' tp work during a Council
Declared Local Emergency shall be paid at 1 x their hourly rage for all
hours 'beyond their normal work day.
Sectaon12. Uniform Allowance -Public Safety
The classifications. of Police Captain and Police Lieutenant shall recieve
1.5~ of the top step Patrol Officer's annual salary effective July 1,
1988 as the Uniform Allowance.
The classifications of Fire Battalion Chief and Fire Marshal shall
rec.eve I:.5~ of the top step Firefighter's annual salary effective
July ~ 1 1988 as the Uniform Allowance.
INSURANCE
Section 13. Health, Insurance
During the period of this Memorandum of Understanding, the City shall
pay any premium increases beyond 'the current City contributions as
listed :below . No increase. in the do]lar amount of the employee
contributions shall be assessed during the term of this Compensation
Plan, with the exception of the Sonoma County Health Plan.

Secton '18:: Vacation
LEAVE
A. :Amounts. A11 regular employees of the City of Petaluma, after

B.., Scheduling. The times during a calendar year in which an
employee may take his vacation shall be determined by the
department head with due respect for the wishes of the employee
and particular regard for the .needs of the service. If the
requirements of the service are such than an employee cannot
-take part or all of his annual vacation in a particular calendar
.year, .such vacation shall be taken during the fo].ls~wing calendar
year.
C'.. Deferral. In the event one or more municipal holidays fall within
an annual vacation leave, such holidays shall not be charged as
vacation leave and. vacation leave shall be. extended accordingly.
D. Fire Battalion Chiefs' Vacation shall be computed as follows:
Amount of Continuous Service Vacation
After completion of twelve. months 5 shifts per year
.After completion of five years 7 shifts per year
After completion. of ten years 8 shifts per year
After completir~n of fifteen years 9 shifts per year
Vacation entitlement accumulated in excess of two years will be
lost.
Any eligible employee with the consent of the head of his
department and the Personnel Officer may defer 2.33 shifts of his
annual vacation to the succeeding calendar year, subject to the
other provisions of this rule. A written report of each deferred
vacation signed by the appropriate department head and the
Personnel Officer -noting the details shall be kept on file with the
Personnel Officer.
The times during the calendar year in which an employee may
take his vacation shall be determined by the department head with
due respect for the. wishes of the employee and `particular regard
for the needs of the service. If the requirements of the service
are such that an emp]flyee cannot take part or all of 'his annual
vacation in a paticular calendar year, such vacation shall be
taken during the following calendar year.

.Section 19. Sick Leave.
A . General. Sick leave with pay sha71 be granted to all employees as
set forth in this section. Sick leave. is .not a right which an
employee. may use at his discretion, but. :rather, shall be used
only .in case of personal illness, disability or the serious illness
or injury of an employee's family member which requires the
employee's attention . The term family members shall include :
spouse; children, parents, spouse's parents, brothers, sisters or
~otler inclivid_uals whose relationship to the employee is that of a
dependent or near dependent.
B ., Accrual. Sick leave shall accrue to all full-time employees at the
rate of eight hours for each month of continuous service. Fire
Battalion Chiefs shall accrue at 12.0 hours per month . No
employee shall accumulate more .sick leave. in any year than
provided .
C . Notification Proce_ dunes. In order tre receive •compensation while
absent on sick Dave, the employee :shall notify his immediate
superior or the 'Personnel Office prior try or within four hours
after this time- -set for beginning his daily duties as may be
specified by tYie head of his department. When absence is for
more than three days/shifts duration,. the employee may be
required to file a, physician's certsficate with the Personnel Office
stating the cause of the absence.
D . Relationship to Workers Compensation. Benefits shall be payable
in situations where employ"ee absence is due to industrial injury
as provided in Ca]iforria State Workers' Compensation Law. The
amount. of disability payments paid to the injured employee shall
be deducted from salary payable to the employee while on sick
leave. During the .first three (3) calendar days of absence for
industrial disability, employees will be compensated at their full
rate of pay without deduction from sick leave unless they are
hospitalized. Absences resulting in immediate hospitalization or
absences continuing beyond the third day shall be charged
against the employee at the rate of one-half (1/2) day for each
day of absence credited or compensated by workers' compensation
.insurance, provided the City receives all compensation paid by
workers' compensation payments only, without City payment for
salary at no loss of sick leave. Sick leave for industrial injury
shall not be allowed for a disability resulting from sickness,
selfinflici-~d injury or willful misconduct.

All employees receiving full-, salaries in lieu of temporary disability

accumulate sick leave..during such periflds of disability:
Section 20. Bereavement Leave
In the event of the death of an employee';s spouse, mother,
step'-mother, mother-in-law, father,, step-father', father-in-law,.
brother, sister, child, including an adopted .child, grandchild and
grandparent, an, employee who atfend~s the .fu-neral shall be granted
time off work with pay:.. The amount of dine .off work with pay shall
be only that which is required to atEend the funeral and make
.necessary funeral .arrangements, but in 'no event "shall it exceed three
(3') working days.,. "These three (3') days shall. not be chargeable to
sick leave. An additional two (2) days required for necessary funeral
arrangements may be charged to the employee'[s sick leave and any
additional time beyond these two days may 'be charged try accumulated
vacation or leave without pay . Such bereavement leave shall not be
.accruable from fiscal year to fiscal year.,. 'nor shall it have any
monetary value if unused :
Secdcn ,21,: Holidays
A . Fixed. Holidays .; The City shall observe eleven (11) fixed-date
holidays. These holidays shall be established for the City's fiscal
year as determined by City Council :resolution.
B: Floating. Holiday. During the' period of this Compensation Plan,
City will authorize one (l) "Floating Holiday" per employee., which
may be taken by.the employee at a time selected by the employee,
subject to operational requirements and approval determined by
the City. Employees .hired between July 1 and December 31 will
be eligible for a "Floating Holiday" during the course of the
Fiscal Year.
Section 22.,, Military Leave
Military .leave shall be arranged in .accordance with the provisions of
State law . All employees entitled to military leave shall give the
appointing .power. an opportunity, within the limits of military
regulations to determine when. such have shall be' taken:
Section 23. Leave of Absence without Pa
The City ,Manager may grant a permanent or ,probationary employee
leave of absence without pay° or seniority fora period not to exceed'
three. (3,) months.. -Good cause being shown by a written request, the
City Manager may extend the leave of absence without pay for an
additional period not, to exceed .six (6) months.. No such leave shall be
granted except upon written :request of the employee setting forth the
reason for the request, and the approval will be in writing. Upon

expiratii~n of a regularly app"roved leave or within a reasonable peris~d
of time after notice to' .return to duty, :the employee shall be reinstated
in tYie 'position held at the: time leave wa's g'ranted. Failure on the
part of an emp]~.yee on leave to report promptly at its expiration, or
within a reasonable time. after notice' to return to duty, shall be cause
for discharge.
Section: 24. Jury Leave
Every classified employee. of the City who is called or required to
serve as a trial. juror shall be entitled to absent himself from his
duties with the City during the period.. of such service or while
necessarily being present in court as a .result of such call. Under
such. circumstances, the 'employee .shall 'be ,paid ~ the difference between
his full aalary and any payment received ~ by him, except travel pay,
for such duty.
Section. 25. Administrative Leave
Members of this unit are eligible for administrative leave. Days may
be granted by the City Manager, upon written request, not to exceed
ten (10) days per Fiscal. Year.
OTHER
Section 26. Retirement
The City of Petaluma=s retirement plan under the Public Employee's
Retirement System shall consist of the following items:

Section 27. Grievance Procedure
A . Purpose of Rule
(1) Topromote improved employer-employee relations by
estab]ishing grievance proced-ores on matters for which
appeal or hearing is not provided by other regulations.
(2) T-o afford, employees individually or-; through. qua]if~ed
employee organization a systematic means of obta~sing 'further
consideration of problems after every reasonably effort has
:failed ,tA resolve them through discussions;.

(3) To provide that grievances shall be settled as near as
possible to -the point of origin.
(4') To provide that. appeals shall be conducted as informally as
possible .
B. Matters Subject to Grievance Procedure. .Any employee in the
competitive service shall have the, right to a-ppeal under this rule,
a decision affecting his employ-merit over which his appointing
power has partial or complete ,jurisdiction and for which appeal is
not provided by other regulations or is not prohibited..
C . Informal Grievance .Procedure. An employee who has a problem or
complaint should first try to get it settled through discussion
with his immee7i:ate supervisor without undue de]ay. If, after this
discussion, he' does not believe the problem has been
satisfactr~riy resolved, he shall have -the right ~ discuss it with
his supervisor`s immediate. supervisor, if any, in the
administrative service. Every effort should. be made to find an
acceptable solution by informal means at the lower possible level
of supervision,. If the employee is not in agreement with the
decision reached, b:y discussion, he shall. then have the right to
.file a formal appeal in writing within -ten (10) calendar days after
receiving the informal decision of his immediate superior. An
informal appeal shall not be taken above the appointing power.
D . Formal.. Grievance Procedure (levels of review through chain of
command)
(1) First level of review . The appeal shall be presented in
writing to the employee's immediate supervisor, who shall
render his decision `and comments in writing and return them
to the emplpyee within five (5) calendar days after receiving
the appeal. If the employee- does not agree with his
supervisor's decision, or if no answer has been received
within five (5) calendar days; the employee may present the
appeal in writing to his supervisor's immediate superior.
Failure of the employee to take further action wtYun five (5)
calendar days after receipt of the written decision of his
supervisor.,. or within a total of fifteen (15) calendar days if
no decision is rendered, will constitute a dropping of the
appeal.
(.2) Further ]svel or levels of review as appr-opriate. The
supervisor. ;receiving the appeal shall review it, render this
decision a`n'd comments in writing, and return them to the
employee within five (5) calendar days after receiving the
appeal. If they employee does not agree with the decision, or
if no answer has been received within five (5) calendar
days, he may present the appeal in writing t,~ the

department head. Failure of the employee to take further
action. within five (5) calendar days after receipt of the
decision or within' a fatal of fifteen; (15) calendar days if not
.decision is rendered, will constitute a dropping of the
appeal.
(3;) Department Rev~w. The department head receiving the
appeal of his designated. °representative, should discuss the
grievance with the employee,,. his representative, if any, and
with, other appropriate persons.. The department head shall
render his decision and comments in writing, and return
them to the :employee within :five (5) calendar days after
receiving 'the appeal. If the employee does not agree with
the decision reached, or if no answer has been received
within five (5) calendar days after .receipt of the decision or
within a total of fifteen. (15) calendar days if no decision is
rendered, will constitute a dropping of the appeal.
(4) City Manager,. The City Manager receiving the appeal or is
designated representative should, discuss the grievance with
the employee, his representative, if any, and with other
appropriate person. The City .Manager .may designate a fact
finding committee,, officer not in the normal line of
supervision, or Personnel Board to advise him concerning
the appeal. T-he City Manager shall render a deci._sion in
writing to the employee within twenty (20) calendar days
after receiving the appeal. _
(5) Conduct of Grievance Procedure.
(a) The tune limits specified above may be extended to a
definite date by mutal agreement of the employee and
the reviewer concerned .
(b) The employee may request the assistance of another
person of his own choosing in preparing and presenting
his appeal at any level of review.
(c) The employee and his representative may be privileged
to use a reasonable a-mount of work time as determined
by the appropriate department head in conferring about
and presenting the appeal.
(d) Employees shall be assured freedom from reprisal for
usirig the grievance procedures.
