HomeMy WebLinkAboutResolution 2004-158 N.C.S. 09/13/2004 resolution No.2004-158 N.C.S. of the City of Petaluma, California ACCEPTING COMPLETION OF THE 2004 OXIDATION POND DIKE REPAIR PROJECT 0500405 WHEREAS, the City Council awarded the contract for the 2004 Oxidation Pond Dike Repair Project to Goebel Paving, Grading & Underground, Inc., P.O. Box 2745, Petaluma, CA 94953, on July 12, 2004; and, WHEREAS, Goebel Paving, Grading & Underground, Inc. has completed all the work to the satisfaction of the Director of Water Resources and Conservation. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Petaluma, that the project is hereby accepted. BE IT FURTHER RESOLVED that: 1. The City Clerk is hereby authorized to sign the Notice of Completion and the City Clerk to file the same with Sonoma County Recorder. 2. The Finance Department is hereby authorized to release the retention money to Goebel Paving, Grading & Underground, Inc. forty-five (45) days after the recordation of the Notice of Completion provided that no liens or stop notices have been filed against the project. 3. This resolution shall become effective immediately, 4. All portions of this resolution are severable. Should any individual component of this resolution be adjudged to be invalid and unenforceable by a body of competent jurisdiction, then the remaining resolution portions shall be and continue in full force Resolution No. 2004-158 N.C.S. and effect, except as those resolution portions that have been adjudged invalid. The City Council of the City of Petaluma hereby declares that it would have adopted this resolution and each section, subsection, clause, sentence, phrase and other portion thereof, irrespective of the fact that one or more section, subsection, clause, sentence, phrase or other portion maybe held invalid or unconstitutional. Under the power and authority conferred upon this Council by the Charter of said City.
