HomeMy WebLinkAboutResolutions 89-148 N.C.S. 05/22/1989f ,~ FZ~iSOlUtI®Cl No. 89-14R 1 V ~.5. of the City of Petaluma, California RESCINDING AND RECONSIDERING THE CITY COUNCIL ALLOTMENT DECISION OF APRIL 17, 1989 AND GRANTING ALLOTMENTS FOR 1990 WHEREAS, the City .Council has adopted a growth management system by Ordinance 1716 N.C.S. (Chapter 17.26 of the Petaluma Municipal Code) establishing the procedure for granting allotments on a yearly basis; and, WHEREAS, interested developers have filed Notice of Intent to Develop forms in accordance with the provisions of Chapter 17.26 and these in combination with other allotment obligations created and anticipated by the action of the City Council comprise the total number of allotment requests for 1990; and, WHEREAS, the granting of allocations must be done in conformance with General Plan policy that permits an annual average of 500 allotments, no more than 1, 000 allotments in any year and no more than 1, 500 allotments over three years; and, WHEREAS, the City Council took an action to grant 1990 allotments at its meeting of April 17, 1989; but, based on subsequent information, decided on May 1, 1989 to reconsider that action of April 17 at its meeting of May 22, 1989; NOW THEREFORE BE IT RESOLVED that the City Council rescinds its earlier action of April 17, 1989 and upon reconsideration hereby grants allotments for calendar year 1990 as follows: 1990 nii„+,,,or+~ Projects of less than 5 acres or less than 15 units 45 Adobe Creek 66 Corona/Ely Area 300 1,f Res. Westridge 71 Bodega Vista South 17 Country Club 3 73 Fairway Meadows 50 Park Place 5 49 Total Granted 671 BE IT FURTHER RESOLVED that the 300 allotments granted to the Corona/Ely Specific Plan area are contingent on the creation and City approval of an assessment district to complete Sonoma Mountain Parkway and related improvements (as described in the Corona/Ely Financing Plan) , and City Council approval of development agreements with each of the landowner/developers participating in said assessment district and setting forth the specific number of allotments out of the total of 300 a particular project will receive over the term of the agreement. Should either of these actions fail to be carried out, the 300 allotment commitment to Corona/Ely shall be withdrawn by the City, and the allotments returned to the 1991 allotment pool. BE IT FURTHER RESOLVED that the City Council hereby makes the following findings in support of its distribution of 1990 allotments: 1. The distribution of 1990 allotments is consistent with the provisions of the Residential Growth Management System ordinance (Chapter 17.26 of the Petaluma Municipal Code) and the applicable policies of the 1987-2005 Petaluma General Plan. 2. The City Council has considered 1990 Development Objectives as well as other allotment commitments in determining which projects would receive 1990 allotments. 3. The City Council has considered new allotment information that has become available since its initial action on 1990 allotments on April 17, 1989. That information allows the City Council to grant 1990 allotments to the Park Place 5 and Fairway Meadows projects and still remain consistent with its intent to grant a total of 671 allotments for 1990. 2 Reso. 89-148 N.C.S. e 4. The decision to .grant 1990 allotments. as specified herein is not detrimental to the public health, safety. or welfare because the City Council has considered' 1990 allotment. applications in the context of overall City-wide growth rates., .'adequacy of public facilities and the timing of development. 5. The Council has chosen not to grant reservations for 1991 for Park Place 5 because a final determination has not yet been made on the .maximum density of .that project. However, the 49 allotments granted to Park Place 5 .for. 1990 represents an expression of Council intent for a single-family residential project on that .site.. 6. The Council has chosen not to grant any reservations for 1991 because general plan policy requires a reasonable ratio of East to West side growth. Since up to 400 of the potential allotment pool of 500 for 1991 is already or will be committed through development agreement to the Corona/Ely and Adobe Creek projects, the remaining tentatively uncommitted allotments for 1991 are likely to be awarded to West side projects in order to comply with that General Plan policy. reso. allotments.1990 Under the power and authority conferred upon this Council by the Charter of said City.
