SUPPORTING THE LEAGUE OF CALIFORNIA CITIES
AND COUNTY SUPERVISORS ASSOCIATION
OF CALIFORNIA'S EFFORT IN HAZARDOUS WASTE
MANAGEMENT PLANNING
WHEREAS, counties statewide face a serious problem involving potential state
preemption of critical local land use decision on the siting of hazardous wastefacilities; and,
WHEREAS, the intent of AB 2948 is for Sonoma County to plan to meet its own needs for
hazardous waste management and to participate in inter-county agreements where appropriate;
and,
WHEREAS, the Department of Health Services (DHS) Guidelines for county hazardous
waste management plans appear to go beyond the intent of the Tanner Statute and would inhibit
Sonoma County and its cities from limiting the size or type of facilities that can be sited; and,
WHEREAS, in order to have an approved county hazardous waste management plan,
Sonoma. County and its cities may become vulnerable through the appeals process by being forced
to accept the siting of any size or type of facility; and,
WHEREAS, equity is based on managing the county's and its cities' "fair share" of
hazardous wastes, either through local siting approvals or through voluntary inter-county
~igreements; and,
WHEREAS, the City of Petaluma supports the use of voluntary inter-county agreements to
structure mutual land use siting commitments; and,
WHEREAS, the appropriate staff of Sonoma County have worked in good faith to
implement AB 2948 and now stand ready to work with the League of California Cities and
CSAC/Tanner Task Force, as requested.
NOW THEREFORE BE IT RESOLVED:
1. That the Petaluma City Council supports the League of California Cities and CSAC's
efforts on behalf of counties to address problems experienced by the counties in working
with the DHS and its interpretation of AB 2948;
2. That the City of Petaluma will work with Sonoma County and its cities to implement the
"fair share" concept and to submit a final hazardous waste management plan that is
consistent with the intent of AB 2948; and
3. That the Sonoma County and .its cities evaluate procedures for environmental impact
reports .and the general plan amendments, as they relate to AB 2948, and compile and
maintain a statewide list of proposed facilities in Sonoma County.
