HomeMy WebLinkAboutResolutions 89-296 N.C.S. 09/18/1989r ' ' resolution No. ~A-~Q~ N.C.S. of the City of Petaluma, California DENYING APPEAL BY GREG AND LAURIE MILLER OF SITE PLAN AND ARCHITECTURAL REVIEW COMMITTEE (SPARC) ACTION ON HARVEY DUPLEX CONSTRUCTION AP NO. 008-181-11 WHEREAS, on July 27, 1989, Site Plan and Architectural Review Committee approval was granted to approve a duplex at 308 Fifth Street; and WHEREAS, an appeal of the Site Plan and Architectural Review Committee's decision was appropriately filed on August 9, 1989 by Greg and Laurie Miller; and WHEREAS, the City Council has held public hearings on September 5, 1989 and September 18, 1989 to consider this appeal and has considered all reports, plans, and testimony presented at these meetings; and WHEREAS, the City Council has considered all previously submitted information, reports, plans, and SPARC minutes relative to this matter; NOW, THEREFORE, BE IT RESOLVED that the City Council finds that after consultation between the developer and the project neighbors and appellants, the project design has been revised to satisfy the concerns of the neighbors and appellants; and BE IT FURTHER RESOLVED that the City Council hereby denies the appeal of Greg and Laurie Miller, modifying the conditions of approval adopted by the Site Plan and Architectural Review Committee as follows Site Specific Conditions 1. The following requirements of the Chief Building Inspector shall be met: a. Show site drainage and grading topography. b. Indicate all utilities on site plan. k~~s. v~~........89.-296.... n.cs. c. Verify utilities are adequate for building (i.e. size of water, electric and gas service and size of sewer) . d. Driveway gradient shall comply with Ordinance #1533 / 1982. e. Responsible party to sign plans. 2. Decorative six foot high fencing, compatible with the house, shall be provided along the east, south and west property lines, subject to staff approval. Fencing shall meet Zoning Ordinance height regulations within the front setback area. Fencing shall be installed or bonded for prior to occupancy. 3. Existing curb cut, as necessary, shall be replaced with curb, gutter and sidewalk to City Standard, subject to the approval of the City Engineer . 4. This project shall be responsible for payment of special development fees adopted by the Petaluma City Council for sewer and water connection, Community Facilities Development, Storm Drainage Impact, Dwelling Construction and School Facilities. 5. The elevation adjacent to the uncovered parking shall be submitted for review prior to the SPARC meeting . Vlindows shall be provided on the garage wall, subject to staff approval. 6. A revised master landscape plan shall be provided., to staff's approval, prior to issuance of a building permit. Landscape shall be installed or bonded for prior to issuance of a certificate of occupancy. The landscape plan shall meet the following guidelines: a. Foundation planting shall be provided along the north elevation of the residence. b. Landscaping in the front setback shall be, at most., approximately 3-4 feet in height when mature to provide a semi-private yard area (excluding foundation planting) . c. Landscaping adjacent to areas used for vehicular maneuvering shall be low growing ground cover. Reso. 89-296 N.C.S. d. Landscaping along the west property line shall mature to a minimum height of 8-10 feet, and be cluster planted to create focal points of interest. 7. A revised site plan shall be provided, subject to staff approval, which meets the following requirements: a. The front yard setback shall be consistent with adjacent residences. 8. The following requirements of the City Engineer shall be met: a. Repair any broken sidewalk. b. Architect shall verify turning movements on revised plans. Standard SPARC Conditions 9. All trees shall be a minimum fifteen gallon size (i.e. trunk diameter of at least 3/4 inch measured one foot above the ground) and double staked; all shrubs shall be five gallon size. All landscaped areas not improved with lawn shall be protected with a two-inch deep bark mulch as a temporary mea sure unti l the ground cover is established. 10. All plant material shall be served by a City approved automatic underground irrigation system. Landscape plans shall include an irrigation plan. 11. All planting shall be maintained in good growing condition. Such maintenance shall include, where appropriate, pruning, mowing, weeding, cleaning of debris and trash, fertilizing and regular watering . Whenever necessary, planting shall be replaced with other plant materials to insure continued compliance with applicable Reso. 8.9-296 N.C.S. landscaping requirements. Required irrigation systems shall be fully maintained in sound operating condition with heads periodically cleaned and replaced when missing to insure continued regular -watering of landscape areas, and health and vitality of landscape materials. 12. All work within a public right-of-way requires an excavation permit from the Department of Public Works. 13. External downspouts shall be painted to match background building colors. 14. Building elevations shall substantially conform to the revised plans presented to the City Council on September 18, 1989. reso.harvey.duplex/resol2 Under the power and authority conferred upon this Council by the Charter of said City.
