HomeMy WebLinkAboutResolution 89-016 N.C.S. 01/17/1989i ,. w R-f'SOlUtlon No. 89-16 N ~.5. of the City of Petaluma, California RESOLUTION TO SUMMARILY VACATE AND ABANDON EMERGENCY ACCESS EASEMENTS WITHIN PARK PLACE NO. 7 IN THE CITY OF PETALUMA WHICH PORTION HAS BEEN SUPERSEDED BY RELOCATION AND AUTHORIZING THE CITY MANAGER TO NEGOTIATE SALE OR EXCHANGE OF SAME TO THE ADJACENT PROPERTY OWNERS, AND THE CITY CLERK TO EXECUTE THE NECESSARY CONVEYANCE BE IT RESOLVED that the City of Petaluma does hereby find and determine that the real property described below is no longer needed for emergency access purposes, having been superseded by relocation, and the same should and is hereby summarily abandoned pursuant to Section 8330 of the Streets and Highways Code, said real property being described as follows: An easement for emergency access purposes over a portion of the lands granted to the City of Petaluma, as described in the document number 83009327, Sonoma County Records, State of California, more particularly described as follows: LANDS OF QANTAS DEVELOPMENT CORPORATION TO BE CONVEYED TO THE CITY OF PETALUMA FOR EMERGENCY ACCESS EASEMENTS TO SERVICE PARK PLACE SUBDIVISION NO. b All that certain real property situated in the City of Petaluma, County of Sonoma, State of California, more particularly described as follows: PARCEL ONE: COMMENCING at the centerline intersection of Glacier Court with Rushmore Avenue as shown on that certain map entitled "Park Place Subdivision No. 2", recorded in Hook 27b of Maps at Page 20, Sonoma County Records; thence along said centerline of Rushmore Avenue North 540 2b' S8" West 104.59 feet; thence leaving said centerline at right angles North 35° 33' 02" East 25.00 feet to a point on the northerly Pane of Rushmore Avenue; thence along said northerly line from a tangent bearing of North 540 2b' 58" West along a curve to the right with a radius of 450.00 feet, through a central angle of 20 01' S4" for an arc length of 15.9b feet to the TRUE POINT OF BEGINNING of the herein parcel being described; thence from said TRUE POINT OF BEGINNING continuing along said northerly line of Rushmore Avenue from a tangent bearing of fVorth 520 25' 04" West, along a curve to the right, with a radius of 450.00 feet, through a Res. No......89.-.1.6_........ N.C.S. central angle of 20 40' 17", for an arc length of 20.98 feet; thence leaving said northerly line and entering the Lands of Qantas Development Corporation as described in deed recorded in Book 2922 of Official Records at Page 962, Sonoma County Records, the following courses: North 5b° 30' 00" East 121.78 feet along a tangent curve to the right, with a radius of 35.00 feet, through a central angle of 900 00' 00", for an arc length of 54.98 feet, South 56° 30' 00" West 26.23 feet, from a tangent bearing of North 33° 30' 00" West, along a curve to the left with a radius of 15.00 feet, through a central angle of 90° 00' 00", for an arc length of 23.56 feet; thence South 5bo 30' 00" West 109.21 feet to the POINT OF BEGINNING. Containing 3252.78 square feet more or less. PARCEL TWO• COMMENCING at the centerline intersection of Rainier Avenue with Maria Drive as shown on that certain map entitled "Park Place Subdivision No. 3" recorded in Book 308 of Maps at Pages 9-12, Sonoma County Records; thence along said centerline of I~laria Drive South 540 32' S7" East 530.68 feet; thence leaving said centerline at right angles South 350 27' 03" West 42.00 feet to a point on the southerly line of said Maria Drive; thence along said southerly line North 52° 10' 46" West 15.83 feet to the TRUE POINT OF BEGINNING of the herein described parcel; thence from said TRUE POINT OF BEGINNING continuing along said southerly line North 520 10' 46" West 21.11 feet; thence leaving said southerly line and entering the "Lands of Qantas Development Corporation" as described in deed recorded in Book 2922 of Official Records at Page 962, Sonoma County Records, the following courses: South 5b° 34' 00" West 88.81 feet, along a tangent curve to the left with a radius of 35.00 feet, through a central angle of 90° 00' 00", for an arc length of 54.98 feet, North 56° 30' 00" East 25.00 feet, from a tangent bearing of North 33° 30' 00" West, along a curve to the right with a radius of 15.00 feet, through a central angle of 90° 00' 00", for an arc length of 23.56 feet; thence North 5b° 30' 00" East 90.57 feet to the POINT OF BEGINNING. Containing 2704.27 square feet more or less. BE IT FURTHER RESOLVED that the City Manager or his representative is hereby authorized to negotiate the sale or exchange of said real property to the adjacent property owners, and upon such sale or exchange, the City Clerk is authorized to execute a conveyance of said real property. Reso. 89-16 NCS BE IT FURTHER RESOLVED that the City Clerk is hereby directed to record this resolution with the County Recorder pursuant to Section 8335 of the Streets and Highways Code.
