A RESOLUTION APPROVING ISSUANCE OF A MITIGATED
NEGATIVE DECLARATION PURSUANT TO CEQA FOR THE
APPROVAL OF A CONDITIONAL USE PERMIT TO ALLOW
A CONVENIENCE MARKET AT 860 PETALUMA BOULEVARD NORTH
A.P. No. 006-050-77
WHEREAS, THE City Council has .reversed the decision of the Planning
Commission denial of a conditional use permit for a 2500 square foot
convenience market (Kwik Stop) at 860 Petaluma Boulevard North in the
Cherry Valley Center (formerly Payran Plaza) ; and, '
WHEREAS, an initial study and a focused traffic study have been prepared
for the proposed use; and,
WHEREAS, the results of these studies have determined that approval of
this use will not trigger any significant adverse environmental impacts that
cannot be mitigated through conditions of approval;
NOW, THEREFORE, BE IT RESOLVED that the issuance of said Mitigated
Negative Declaration pursuant to the California Environmental Quality Act is
hereby approved, based upon the following findings:
1. The project, as conditionally approved, does not have the potential to
degrade the quality of the environment, substantially reduce the
.habitat of a fish or wildlife species, cause a fish or wildlife population
to drop below self-sustaining levels, threaten to eliminate a plant or
animal community, reduce the habitat of a fish or wildlife species,
cause a fish or wildlife population to drop below self-sustaining levels,
threaten to eliminate a plant or animal community, reduce the number
or restrict the range of a rare or endangered plant or animal or
eliminate important examples of the major periods of California history
or prehistory.
2. The project, as conditionally approved, does not have the potential to
achieve short-term, to the disadvantage of long-term, environmental
goals .
3. The project, as conditionally approved, does not have impacts which
are individually limited, but cumulatively considerable.

4. The project, as conditionally approved, does not have environmental
effects which will cause substantial adverse effects on human beings,
either directly or indirectly.
5. Potential adverse traffic impacts are mitigated through conditions of
approval ,
