13 REPORT OUT OF CLOSED SESSION (ACTIONS TAKEN)

15 City Attorney Danly reported in accordance with Government Code section 54957.1 that there
16 was reportable action in the form of a unanimous vote of Council to approve a settlement
17 agreement between the City of Petaluma and the County of Sonoma regarding property tax
18 administration fees. The issue was recently decided by the California Supreme Court, in the case
19 of the City of Alhambra v. County of Los Angeles, involving practice throughout the State,
20 whereby counties charged a property tax administration fee that is intended to recover the
21 County's cost of allocating and forwarding taxes to the various faxing entities. The practice also
22 included charging the fee on the educational revenue augmentation fund, which resulted in
23 additional fees being paid by the taxing entities, which had been determined in the Alhambra
24 case to be unlawful. The City of Petaluma, along with most of the other cities in the County,
25 reached an agreement with the County of Sonoma with a proposal whereby they presented
26 their calculations and amounts, where in the case of Petaluma, amounts to $584,176.21 . That
27 money will be paid to the City in one amount in April. Going forward, the County of Sonoma will
28 not be charging the fee amounts that were disallowed. This agreement is a full release and
29 settlement between the County of Sonoma and the City of Petaluma.
