HomeMy WebLinkAboutResolution 2009-197 N.C.S. 12/07/2009Resolution No. 2009-197 N.C.S. of the City of Petaluma, California REQUESTING EIVIPLOYIVIENT EXTENSION FOR INTERIIVI FINANCE DIRECTOR SANDRA SATO PURSUANT TO GOVERNIVIENT CODE SECTION 21221 (h) WHEREAS, Sandra Sato retired from the City of Oakland in the position of Agency Fiscal and Administrative Manager, effective August 1, 2006; and, WHEREAS, City Manager John C. Brown appointed Sandra Sato to the position of Interim Finance Director, a position deemed to be of limited duration and requiring specialized skills, effective November 16, 2009; and, WHEREAS, City Manager John C. Brown understood and was aware that Sandra. Sato was subject to a 960-hour maximum as a retired member in the California Public Employees' Retirement System (Ca1PERS) at the time of her appointment and would reach her 960-hour maximum on or about December 14, 2009; and, WHEREAS, Sandra Sato is expected to reach her 960-hour maximum allowed by Ca1PERS for temporary employment during the fiscal year on or about December 14, 2009; and, WHEREAS, the City of Petaluma conducted a recruitment for the position of Finance Director in May 2009 and extended the filing deadline date to July 15, 2009 and did not receive a sufficient number of highly qualified applicants; and, WHEREAS, the City of Petaluma has an immediate need to conduct and oversee a series of in-depth and comprehensive reviews, which require thorough analysis and sound recommendations for action; and, WHEREAS, Sandra Sato possesses the necessary and specialized skills as a Finance Director and has direct experience in municipal finance having served in that capacity for the Cities of Oakland, Oroville, Suisun City, and Town of Windsor for over eighteen years; and, WHEREAS, the City of Petaluma plans to conduct a second recruitment for the position of Finance Director in the summer of 2010 and needs the expertise of Sandra Sato until a replacement can be appointed; and, WHEREAS, Ms. Sato is subject to a 960-hour maximum as a retired member in the California Public Employees' Retirement System (Ca1PERS); and, WHEREAS, Ms. Sato has worked for another public agency in Fiscal Year 2009-2010, and is expected to reach her maximum of 960 hours for Fiscal Year 2009-2010 on or about December 14, 2009, and additional work beyond those hours will be required to fulfill the duties of Interim Finance Manager until a successful recruitment can be completed and a permanent Finance Manager retained; and, Resolution No. 2009-197 N.C.S. Page 1 WHEREAS, Government Code section 21221(h) permits continued employment in excess of 960 hours in a fiscal year, if the City requests and Ca1PERS grants approval therefore; and, WHEREAS, this resolution will be presented to Ca1PERS before the expiration of Ms. Sato's 960 hour maximum for the present fiscal year. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Petaluma that: 1. The Ca1PERS Board of Administration is hereby requested to approve an extension for the temporary employment of Sandra Sato by the City of Petaluma through June 30, 2010, the end of Fiscal Year 2009-2010, in excess of 960 hours. 2. The CaIPERS Board of Administrators is hereby requested to an approve extension of the temporary employment of Sandra Sato effective July 1, 2010 through November 15, 2010, for a total period not exceeding twelve months from her initial appointment, in accordance with Government Code Section 21221(h). 3. The City Manager shall immediately transmit this resolution and request to the CaIPERS Board of Administration. Under the power and authority conferred upon this Council by the Charter of said City.
