S, ;t„r q ail LigL I RESOLUTION AUTHORIZING THE EXECUTION OF AN AGREEMENT BETWEEN THE CITY OF PETALUMA, ACTING AS TRUSTEE FOR THE PROPERTY OWNERS IN ASSESSMENT DIST ICT NO. 5 AND C & H CONTRACTORS, INTRODUCED BY COUNCILMAN _/ P2t1/L�� o�� `, & and SECONDED BY COUNCILMAN I s� at a ' Regular Meeting of the City Council of t 4 City of P�lilma 'on the 19th j day r of March , 1962. WHEREAS, the C & H Contractors have substantially completed the construction of work described in Resolution of Intention No, 2749 N.C. S. of the City Council of the.City of Petaluma except for the repair of certain areas; and WHEREAS, the Council determines that it is not for the best 'interests of the property owners to have these areas repaired and repaved during. the winter months because of the conditions of the ground; and WHEREAS, the Engineer of the Work; Alfred Roberts, has advised the City Council that the estimated cost of said work is the 'sum of. $2, 500. 00. NOW, THEREFORE, BE IT RESOLVED that the Mayor, be, and he is, hereby authorized to execute an Agreement with C & H Contractors providing in general as follows: 1, C & H Contractors toldepbsit with the City of Petaluma a surety bond in the amount of $2, 500. 00; 2. The Council, on behalf of the property owners in Assessment District No, 5 and the City of Petaluma,pl agrees to accept. the work done and the . ', surety bond in the amount of$2 , 500. 00 as completion of the work described in Resolution of Intention No 2749 N C. So and the contract executed pursuant thereto, 3. C & H Contractors to have the right to complete the work re- quired by the Engineer of Work or to the satisfaction of the City Engineer on or before May 30, .1962, . - 1- . ?= _� _ ! _ �°27Sy ' 4, 'In the event C & H Contractors fail to make the repairs, the City of Petaluma shall cause the work to be done by itself or by subcontract ;and for the cost thereof to charge the actual costs against the surety and the surety shall agree to pay the actual costs, not to exceed $2, 500n 00, I hereby certify that the'foregoing resolution was duly and regularly Introduced and adopted by the Council of the City of Petaluma, on the 19th day of March , 1962, by the following vote, AYES: COUNCILMEN COLIN, CRINELLA, ELLIS , GUSTAFS'ON , KING , VAN BEBBER, AND MAYOR MATZEN.
