HomeMy WebLinkAboutResolution 2004-128 N.C.S. 07/19/2004 ~Zesolution No.2004-12~ N.C.S. of the City of Petaluma, California AWARDING A CONSTRUCTION CONTRACT FOR THE 2003-2004 WATER SERVICE REPLACEMENT PROJECT PROJECT NO. 0501000 WHEREAS, the Water Service Replacement Project is included in the Department of Water Resources and Conservation Fiscal Year 2003-2004 Capital Improvement Program Budget; and, WHEREAS, in accordance with the City of Petaluma Charter and Municipal Code, California Public Contract Code Section 20162 and other applicable law, the City of Petaluma solicited bids for the Project; and, WHEREAS, six (6) bids for the Project were received on July 1, 2004, and opened in accordance with California Public Contract Code Section 4105.5 and other applicable law; and, WHEREAS, the apparent low bid for the Project was submitted by Vulcan Construction & Maintenance, Inc., in the amount of $471,960; and, WHEREAS, the City staff has verified that Vulcan possesses a valid California Contractor's license, Class A, license number 414892, expiration date April 30, 2005, that qualifies Vulcan to perform the Project. NOW, THEREFORE, DE IT RESOLVED by the Petaluma City Council that: 1. The low bid is accepted. 2. The contract is hereby awarded to Vulcan Construction & Maintenance, Inc., 1010 West Whitebridge Avenue, Fresno, CA 93706-1328, the low bidder, in the amount of $471,960. 3. This resolution shall become effective. immediately. Resolution No. 2004-128 N.C.S. 4. All portions of this resolution are severable. Should any individual component of this resolution be adjudged to be invalid and unenforceable by a body of competent jurisdiction, then the remaining resolution portions shall be and continue in full force and effect, except as to those resolution portions that have been adjudge invalid. The City Council of the City of Petaluma hereby declares that it would have adopted this resolution and each section, subsection, clause, sentence, phrase and other portion thereof, irrespective of the fact that one or more section subsection, clause sentence, phrase or other portion maybe held invalid or unconstitutional. BE IT FURTHER RESOLVED that the City Manager is hereby authorized to execute the contract with Vulcan Construction & Maintenance, Inc., subject to the review and approval of all contract documents, insurance certificates and bonds by the City Attorney. Under the power and authority conferred upon this Council by the Charter of said City.
