NO.'s 007-412-48, 49, 50, 51, 52 and 150-020-5, 7, 10 and 22 WHEREAS, upon recommendation made on December 5, 1988, the Planning Commission recommended that 32.4 acres be rezoned Planned Community District (PCD) /Floodplain Combining (FP-C) to allow construction of an exclusive sales area for automobiles, boats, and recreational motorhomes, and related activities commonly called Petaluma Auto Plaza; and WHEREAS, by Ordinance No. 1746 N . C . S . , Assessor's Parcel No's . 007-412-48, 49, 50, 51, 52 and 150-020-5, 7, 10 and 22, were rezoned to PCD to allow said development; and WHEREAS, , a Mitigated Negative Declaration prepared pursuant to the California Environmental Quality Act was adopted by the City Council as recommended by the Planning Commission (Resolution No. 8g-387 N.C.S.) ; and, WHEREAS, a public hearing on this matter was held by the Planning Commission on November 8, 1988, and the City Council on December 5, 1988, at which times all written and verbal testimony were considered prior to action; NOW, THEREFORE, BE IT RESOLVED that the City Council hereby approves the Petaluma Auto Plaza PCD development program based on the site plans and narrative project description provided by the applicant, on file in the Planning Department, subject to the following findings: PCD Findings. 1. That the proposed rezoning conforms to the Petaluma General Plan's land use designations of Thoroughfare Commercial and Special Retail. 2. That the public necessity, convenience and general welfare clearly permit the proposed rezone. 3. As conditionally approved, the streets and thoroughfares are suitable and adequate to serve the proposed uses and the anticipated traffic which will be generated thereby. 1 ass. ;v~...,.88-39b....... n.cs. 4. Pursuant to the PCDC development agreement, development of the Planned Community District will be initiated within a reasonable time by submittal of an application for a Planned Unit Development Permit, tentative subdivision map, or other appropriate action. 5. Petaluma Auto Plaza will be appropriate in area, location and overall planning to the purpose intended; that the design and development. standards are such as to create an environment of sustained desirability and stability. 6. Petaluma Auto Plaza will be appropriate in area, location, and overall planning to the purpose intended; and that such development will be in harmony with the character of the surrounding areas. 7. The requirements of California Environmental Quality Act Guidelines have been satisfied and hereby incorporates by reference the Negative Declaration approved by Resolution No.gg_387 N.C.S. BE IT FURTHER RESOLVED that the City Council hereby approves the development plan, subject to the conditions hereinafter set out as follows: Conditions for Petaluma Auto Plaza PCD Development Program. 1. The Auto Plaza's eastern-most property lines (abutting the western side of US .101) shall be landscaped in a manner to be approved by the City Council. The purpose of the master landscape plan for the US 101 frontage is to insure a compatible landscape theme from parcel to parcel, not to determine precise placement of every berm or tree/shrub. A master landscape plan for this area shall be approved by the Council and incorporated into the PCD Development program by reference prior to SPARC approval of the first dealership. 2. Prior to issuance of grading permits, a drainage plan shall be submitted to and approved by the City Engineer. This plan shall be certified by a registered engineer to not cause adverse hydrologic or hydraulic effects and comply with all City floodplain policies for those areas of the project site in a FP-C Zone (such as "no net fill" and finished floor elevations 24-inches above base flood levels) . Certification shall state conditions appropriate for the elevations of either current FEMA maps or draft proposed (or soon to be adopted) map, whichever contains the higher flood elevations for the affected site . 3. Street names are subject to approval by the City Street Naming Committee. 4. Amend "Auto Display Pads" to allow pad encroachment into freeway oriented landscaping provide d they maintain a minimum setback from the US 101 right-of-way of ten (10) feet. The size of display pads shall be reduced or made more rectangular in design so that no more than one vehicle/boat may be placed thereon. 2 Reso. 88-396 N.C.S. 5. No more than one dealership is permitted on each parcel. One dealership may comprise more than one franchise. 6. The project sponsor shall provide landscaping and irrigation within the CalTrans right-of-way between the Petaluma Auto Plaza property line and U. S. 101 travel lanes if Caltrans' approval for these improvements is obtained by either the City or applicant. 7. The traffic mitigation measures recommended by DKS .Associates and City Traffic Engineer (as stated in Exhibit B) shall be accomplished by the following means: a) At time of building permit issuance for each building, applicant shall pay that dealership's fair share contribution to the overall signalization, widening and reconfiguration of the Old Redwood Highway overpass and interchange, as determined by City staff; and b) The project sponsor shall install interim traffic signals at the Petaluma/Southbound and Petaluma/Northbound off-ramps to the satisfaction of the City Engineer prior to issuance of building permits for the sixth dealership in the Petaluma Auto Plaza PCD zoned area. 8. An association will be formed to insure proper maintenance of common landscaping, lighting, and signs, subject to the Planning Director's approval. The landscaping and lighting maintenance assessment district shall be formed prior to completion of public street improvements, to the satisfaction of City staff. 9. No parking or display of automobiles shall occur in landscape areas except on approved automobile display pads. 10. All conditions of approval affecting the Petaluma Auto Plaza PCD development program shall be incorporated into the program prior to issuance of building permits for any dealership . 11. Each dealership shall provide on its property at least five (5) feet of landscaping along the Auto Plaza Drive, Benson Way, and Industrial Avenue right-of-ways and shall similarly .install landscaping and sidewalk in, and maintain, all areas within the right-of-way between the curb and property line. 12. All trees shall be a minimum fifteen gallon size (i.e. trunk diameter of at least 3/4 inch measured one foot above the ground) and double staked; all shrubs shall be five gallon size. All landscaped areas not improved with lawn shall be protected with atwo-inch deep bark mulch as a temporary measure until the ground cover is established. 13. Prior to occupancy of the first dealership or within 90 days, whichever occurs first, a program for the temporary display of promotional signs shall be prepared by the applicant and approved by 3 Reso. 88-396 N.C.S. the City Council. This program shall be incorporated into the PCD Development Program.
