HomeMy WebLinkAboutResolutions 88-386 N.C.S. 12/05/1988__ ,, ;~ Resolution No. 88-s8s N C.s. ofi the City of Petaluma, California A RESOLUTION DECLARING THE FENCE ERECTED AT 418 SIXTH STREET, 619 F STREET, 623 F STREET, 625 F STREET, 620 G STREET AND 630 G STREET, PETALUMA, A PUBLIC NUISANCE AND ORDERING SAID NUISANCE TO BE ABATED. WHEREAS, Finbar O'Driscoll is the owner of record of certain property at 418 Sixth Street, 619 F Street, 623 F Street, 625 F Street, 620 G Street and 630 G Street, (A.P. No. 008-203-33) Petaluma, California; and., WHEREAS, it was alleged by the Chief Building Inspector of the Community Development and Planning Department for the City of Petaluma, that the fence erected on the premises is a violation of the Petaluma Zoning Ordinance Article 23, and specifically Sections 23 - 206: and, WHEREAS, the said property owners were notified of a hearing to be held on the question of whether such nuisance did in fact exist; and, WHEREAS, said hearing was held on December 5, 1988, and evidence, both oral and documentary, was heard and considered by the Council on the question of whether a public nuisance did, in fact, exist at 418 Sixth Street, 619 F Street, 623 F Street, 625 F Street, 620 G Street and 630 G Street, Petaluma, California and whether the cost of abating such nuisance should be assessed against said property owner. NOW THEREFORE, BE IT RESOLVED as follows: 1. It is found, ordered and declared that a public nuisance exists at the property known as 418 Sixth Street, 619 F Street, 623 F Street, 625 F Street, 620 G Street and 630 G Street, Petaluma, California, and constitutes a hazard to the public health, welfare and safety. 2. The Chief Building Inspector of the Community Development and Planning Department is hereby ordered to abate said nuisance by the 88-386 a~. h~ ................................ h.cs. demolition or removal thereof, following a period of 15 days beginning at 9:00 a.m. December 6, 1988. Notice of this resolution shall be given to Mr. Finbar O'Driscoll, by depositing a copy of the same in the Postal Service mai 1. 3. The cost of said abatement, if not undertaken by Finbar O'Driscoll, shall be assessed against Finbar O'Driscoll, and if not promptly paid, the City shall institute legal action to recover said monies from Finbar O'Driscoll. Under the power and authority conferred upon this Council by the Charter of said City.
