HomeMy WebLinkAboutResolutions 88-366 N.C.S. 11/07/1988z. 4. ~ Resolution No. 88-366 N.C.S. of the City of Petaluma, California APPROVING THE ISSUANCE OF A MITIGATED NEGATIVE DECLARATION PURSUANT TO THE CALIFORNIA ENVIRONMENTAL QUALITY ACT FOR "THE CHATEAU OF PETALUMA" P.U.D. (A.P, NOS. 007-350-04 and 05) WHEREAS, the Planning Commission has recommended the issuance of a Mitigated Negative Declaration pursuant to the California Environmental Quality Act (CEQA) for the following project: 1. Rezone of 9.62 acres from R-1 6500 to Planned Unit District (P, U,D,), for A.P. Nos. 007-350-04 and 05; and 2. Approval of P.U.D. development plan conditionally allowing construction of up to 300 units of senior housing, common facilities and, upon revision of P.U.D. development plan, ancillary and compatible commercial facility collectively known as "The Chateau of Petaluma" . WHEREAS, a public hearing was held by the Planning Commission on September 13, 1988, and by the City Council on October 24, 1988, at which times all written and verbal testimony (including staff report, traffic, and noise studies) were considered by the decision making bodies prior to action ; NOW, THEREFORE, BE IT RESOLVED that the issuance of said Mitigated Negative Declaration pursuant to the California Environmental Quality Act is hereby approved, based on the following findings: Findings for Negative Declaration: 1. The project, as conditionally approved, does not have the potential to degrade the quality of the environment, substantially reduce the habitat of a fish or wildlife species, cause a fish or wildlife population to drop below self-sustaining levels, threaten to eliminate a plant or animal community, reduce the habitat of a fish or wildlife species, cause a fish or wildlife population to drop below self-sustaining levels, threaten to eliminate a plant or animal community, reduce the number or restrict the range of a rare or endangered plant or animal or eliminate important examples of the major periods of California history or prehistory. 2. The project, as conditionally approved, does not have the potential to achieve short-term, to the disadvantage of long-term, environmental goals . Res. ~0.~.0._.3.6.6...,.... n.es. .. =. . 3. The project, as conditionally approved, does not have impacts which are individually limited, but cumulatively considerable. 4. The project, as conditionally approved, does not have environmental effects which will cause substantial adverse effects on human beings, either directly or indirectly. 5. The residential portion of the project is consistent with and further promotes the objectives, goals, and policies of the General Plan. Through clarification of the General Plan text,. compatibility of the commercial portion of the project with the General Plan's goals and policies shall be assured. 6. A 1980 city-wide survey by the Sonoma State University Northwest Information Center of the California Archaeological Inventory designates the project site as "moderate" probability of a find. Most flat areas bordering creeks are so designated in 'the Petaluma area. Inasmuch as all surrounding properties have been developed and no items of archaeological interest were uncovered, no further study is warranted on this site at this time. reso.neg.dec.chateau resol0 Under the power and authority conferred upon this Council by the Charter of said City.
