AWARDING A CONSTRUCTION CONTRACT
FOR THE 2004 OXIDATION POND DIKE REPAIR PROJECT
PROJECT NO. C500405
WHEREAS, the dike at oxidation Pond 2 requires repair due to erosion; and, ~II

WHEREAS, ill accordance with the City of Petaluma Charter and Municipal Code,
California Public Contract Code Section 20162 and other applicable law, the City of Petaluma
solicited bids for the Project; and,
WHERAS, the engineer's estiillate for the Project is $305,000; and, ~

WHEREAS, eleven (ll) bids for the Project were received on June 24, 2004, and
opened in accordance with Califoi7ua Public Contract Code Section 4105.5 and other applicable
law; and,
WHEREAS, the apparent low bid for the Project was subnutted by Goebel Paving,
Grading & Undergrounding, Inc., i~n the amount of $216,923.38; and,

WHEREAS, the City staff has verified that Goebel Paving, Grading & Underground, ~
Inc. possesses a valid California Contractor's license, Class A, license number 348449,
expiration date May 31, 2005, that qualifies Goebel to perform the Project; and,

NOW, THEREFORE, BE IT RESOLVED by the Petaluma City Council that:
L The low bid is accepted; and ~
2. The contract is hereby awarded to Goebel Paving, Grading & Underground, Inc., the ~
low bidder, in the amount of $216,923.38:
3. This resolution shall become effective inunediately. ~

4. All portions of this resolution are severable. Should any individual component of this
resolution be adjudged to be invalid and unenforceable by a body of competent
jurisdiction, then the remaining resolution portions shall be and continue in fiill force
anal effect, except as to those resolution portions that have been adjudge invalid. The
City Council of the City of Petaluma hereby declares that it would have adopted this
resolution alld each section, subsection, clause, sentence, phrase and other portion
thereof, irrespective of the fact t11at one or more section subsection, clause sentence,
phrase or other portion may be held invalid or Lmconstitutional.
BE IT FURTHER RESOLVED that the City Manager is hereby authorized to execute
the contract with Goebel Paving, Grading & Underground, hic. subject to the review and
approval of all contract documents, insurance certificates and bonds by the City Attorney.
Under the power and authority conferred upon this Council by the Charter of said City.
