Recommendation: It is recommended that the City Council take the following action:
Introduce ordinance establishing radar enforceable speed limits on certain streets within the City of Petaluma.

Summary Statement:
Per California State Vehicle Code 22357, 22358, 22358.3, and 40802, as well as Section 2B.13 of the California
Manual on Unified Traffic Control. Devices (MUTCD), speed studies must be conducted prior to establishing and
posting radar enforceable speed limits on city streets, where development adjacent to the street, major road
improvement, or changes in traffic conditions have occurred, and radar enforcement is prudent.

DISCUSSION AND INTRODUCTION (FIRST READING) OF AN ®RDINANCE TO ESTABLISH
RADAR ENFORCEABLE SPEED LIMITS ON CERTAIN STREETS WITHIN THE CITY OF
PETALUMA
RECOMMENDATION:
Introduce ordinance establishing radar enforceable speed limits on certain streets within the
City of Petaluma.
2. BACKGROUND:
Engineering and traffic survey must be conducted prior to establishing speeds limits on an
existing street. Traffic conditions may change as a result of street improvements,
development, or changes in traffic and/or pedestrian use, which necessitate establishing radar
enforceable speed limits for the safety of the traveling public and pedestrians. Existing speed
zones will not change if there is no significant change to existing traffic conditions.
3. DISCUSSION:
Since most of the City's engineering and traffic surveys have elapsed, the Traffic Engineering
Division of the Public Works Department has conducted new studies to amend or re-establish
the speed limit on various City streets for the safety of the traveling public.
The various .speed zones, citywide, are illustrated in the attached Speed Zone Map.
California Vehicle Code (CVC) and MUTCD requires that an engineering and traffic survey
be performed to determine prevailing speeds as well as establish them. The 12 segments that
have been increased by SMPH cannot be further changed in this speed survey. Agencies are
required by the CVC and MUTCD to set posted limits at the 85`'' percentile speeds obtained
during the speed survey. The 85`" percentile speed for each of these 12 segments was 8-
12MPH above the current posted limit. In these cases, the engineer of record has the authority
and discretion to recommend dropping the new limit by SMPH for reasons such as higher than
expected collisions, road width, curvature, grade and other alignment conditions.
There are eighteen street segments, shown in bold letters, in which speed limit changes are
proposed. Twelve street segments are proposed to be increased by 5 MPH and the remaining
six street segments are proposed to be reduced by 5 MPH. In most cases, the speed limit does
not change, but the surveys are still required to revalidate existing posted speed limits.. The
following table summarizes the various speed zones surveyed. Individual street segments for
the speed surveys are available for review upon request.

4. FINANCIAL.IMPACTS:
The City :generates revenue through issuance of speeding tickets. Updating., the speed surveys
allows the Police Department patrol'. officers to issue citations for speeding violations. If the
City didn't update its speed surveys, a -loss of revenue would occur, due to the inability of the
Police Department to issue citations for vehicular speeding in unenforceable speed zones.

Section 2. Previously established radar enforceable speed zones not re-established
or modified in this ordinance shall remain approved as previously adopted for the streets to
which they apply.
Section 3. If any section, subsection, sentence, clause. or phrase or word of this
Ordinance is for any reason held. to be unconstitutional, unlawful or otherwise invalid by a
court of competent jurisdiction, such decision shall not affect the validity of the remaining
portions of this Ordinance. The City Council of the City of Petaluma hereby declares that it
would have passed and adopted this Ordinance and edch and all provisions thereof,
irrespective of the fact that any one or more of said provisions be declared unconstitutional,
unlawful or otherwise invalid.
Section 4. The City Clerk is hereby directed to post this Ordinance for the period and in
the manner required by the City Charter.

Suggested Procedure for Sequencing of Discussion of Individual Street
Speed Limit Changes for Item 5.C (Radar Enforceable Speed limits)
(1) Upon calling up Item S.C., Mayor or City Attorney announces that because individual Council Members
have property located within 500 feet of one or more streets on which the speed limit is proposed to be
increased or decreased, there will be a sequenced discussion and direction, and Council Members will recuse
themselves from discussion and direction relating to specific streets within 500 feet of their real property.
(2) Proceed in sequence to discuss and, if desired, to provide direction on recommended changes for the
individual street speed limits listed on the following chart, without participation of recused Council Member for
each segment.
(3) A recused Council Member should step down from the dais and leave the Chamber, returning only after
discussion and direction has concluded as to the streets within 500 feet of that Council Member's real property.
(4) Discuss and, if desired, provide direction on all remaining speed limits for all streets which are not within
500 feet of any Council Member's real property and do not require recusal of any Council Member.
(5) The entire Council may then vote on the Ordinance as a whole. No further discussion on the segmented
portions of the Ordinance should occur after recused members have returned to the dais.
