HomeMy WebLinkAboutResolutions 88-259 N.C.S. 07/18/1988 ~es®Il.,ltl®~ ~®. 88-259 N.C.J. of the City of Petaluma, California A RESOLUTION APPROVING REVISIONS TO THE UNIT DEVELOPMENT PLAN FOR SOUSA SUBDIVISION LOCATED BETWEEN MAGNOLIA AVENUE AND SCHUMAN LANE WHEREAS, by Ordinance No. 1606 N.C.S., Sousa Subdivision was rezoned to Planned Unit Development and, WHEREAS, by action taken on June 28, 1988, the Planning Commission recommended conditional adoption of a revised final unit development plan for said subdivision to incorporate/revise development standards pertaining to maximum driveway slope and fence location restrictions. NOW, THEREFORE, BE IT RESOLVED that the unit development plan previously approved for the project by City Council Resolution No. 85-63 is hereby amended to permit revision to development plan as incorporated .herein . BE IT FURTHER RESOLVED that the City Council hereby adopts the findings of the Planning Commission as its findings as set out hereinafter: Findings 1. Said amendment to the plan clearly results in amore desirable use of land and a better physical environment than would be possible under the original development plan . 2. The PUD District, as originally developed, has a suitable relationship to one (1) or more thoroughfares . No additional traffic impact is anticipated as a result of the proposed amendment. 3. The plan amendment as conditioned continues to present a unified and organized arrangement of buildings and service facilities which are appropriate in relation to adjacent properties. 4. The natural and scenic qualities of the site are protected with adequate available public and private spaces designated on the original unit development plan. 5. The development of the subject property, in the manner as proposed to be amended by the applicant, will not be detrimental to the public welfare, will be in the best interests of the City and will be in keeping with the general intent and spirit of the zoning regulations of the City of Petaluma, and the Petaluma General Plan. BE IT FURTHER RESOLVED that the City Council hereby approves the revised unit development plan subject to the conditions of approval set. out hereinafter. ~~s. No.....8.8.-.2.5.9......... v.cs. Conditions 1. All applicable original conditions, as determined by staff, of the existing PUD Unit Development Plan Resolution 85-63 shall remain in full effect. 2. A fence exhibit shall be submitted for staff review and approval. Said exhibit shall include but not be limited to: a. Fencing must comply with Zoning Ordinance Requirements (Section 24-500) regarding maximum height in front and street side setback areas. Specific fence location and height limitations shall be worked out between applicant and staff . b . Height limits in view corridors -the creative layout of the lots is such that 6 foot high fencing may not be appropriate in certain locations even though (a) would allow it. c. Fence design shall be subject to SPARC review as part of the submittal for the individual house. For existing houses, fence design shall be subject to staff review. An optional open fence design may be developed. 3. All requirements of the Chief Building Official shall be complied with: a. Retaining walls provided on the sides of the driveway shall be engineered to hold back the soil. 4. Minor modifications to the PUD Development Standards may be allowed, subject to SPARC review and approval. 5. Subdivision perimeter fencing for the entire subdivision shall be completed by the developer as soon as possible.
