HomeMy WebLinkAboutResolutions 88-225 N.C.S. 07/05/1988Resolution No. s8-225 N.C.S. of the City of Petaluma, California RESOLUTION ACCEPTING PROPOSAL FOR SPECIAL ASSESSMENT PROCEEDINGS FOR NORTH MCDOWELL BOULEVARD ASSESSMENT DISTRICT The City Council of the City of Petaluma resolves: South Point Business and Industrial Park Partnership ("the developer") is to undertake the construction of the following described public improvement: The construction of Southpoint Boulevard and Northpoint Boulevard, including associated curbs, gutters and sidewalks, utilities, storm drainage, street signage and markings, railroad crossing signalization, and all other appurtenances required as a condition of the approval of the tentative map for Southpoint Business Park. The developer proposes to this City Council that the City include in special assessment proceedings for the proposed North McDowell Boulevard Assessment District the acquisition of these public improvements after their completion, the cost of the acquisition to be assessed on the property of the developer benefiting from the improvements. The City Council accepts this proposal in principle, subject to the following conditions: 1. The special assessment proceedings shall be taken under the Municipal Improvement Act of 1913, with improvement bonds to be issued under the Improvement Bond Act of 1915. 88-225 Rcs. iVu ............................... N.C.S. 2. The described improvements shall be certified by the City Engineer as complete and ready for acceptance before the acquisition is approved. The improvements may be acquired notwithstanding that the right-of-way may have earlier been dedicated to the City as a part of the process of filing a final map of the developer's subdivision. 3. The developer shall submit evidence satisfactory to the City Engineer that the costs proposed to be assessed shall have been actually incurred and paid, and that the land proposed to be assessed shall be free of mechanics' liens resulting from the construction of the improvements. This resolution shall in no way constitute a guarantee or assurance that the special assessment proceedings will be completed, the City Council being without jurisdiction to assure the levy of special assessments until conducting a public hearing as required by the Municipal Improvement Act of 1913. If the North McDowell Road Assessment District is not formed, the developer may apply to the City Council for the formation of a separate assessment district for these improvements.
