RESOLUTION ESTABLISHING SALARY AND SUPPLEMENTAL WAGE BENEFITS
FOR MANAGEMENT EMPLOYEES, UNITS 8 & 9
WHEREAS, THE City Manager, pursuant. to Section 28, City
of Petaluma City Charter, is required and empowered to make a
recommendation to the City Council on matters related to employees'
compensation; and,
WHEREAS, the City Manager has reviewed the attached
Exhibit "A" and Exhibit "B" and recommends approval thereof,
NOW, THEREFORE, BE IT RESOLVED that the salary and
supplemental wage benefits as specified in these attachments for .Management
Personnel are approved and shall become effectsve July 1, ]988.
BE IT FURTHER RESOLVED that it is City Council po]icy
that ninety (90) days notice is required by either party (City Council. and
City Manager) prior try termination of services between said parties .
Under the power and authority conferred upon this Council by the Charter of said City.

This compensation plan - shall. be for a one (:1) year term for the. fiscal

Section 3. Comperi'satifln, ,for'Clothing `Loss
The City Managers; authorized to provide eompensatifln to City
employees for hss. or damage to -their clothing w'hieh occurs during the
course o£: carrying .out an official .duty.. A request .for compensation
hereunder- shall. be submitted in wri#ing, in detail, to the City Manager
via the department .head concerned. The amount of, compensation, 'if
any, shall be at the discretion. of the City Manager.
Section 4. Vacation, Payment at Termin'atann
Employees who terminate employment shall be paid: in a lump sum for
all accrued vacatis~n have earned prior-- to -the: effective date. of
termination . .
Section 5. Sick Leave:, Payment of
In the event. of _ the .death. or retirement of ari emplDyee who has
competed ten (10;) ~or more, years of continuous service with the City,
the emplDyee should. .Ue par3 or shall receive to his benefit fifty
percent (50~) of Fus . accumulated but unused sick leave riot to exceed
480 hours.
Section 6. Deferred Compensation
The City of Peta]:uma .shall make available to the members of this unit,
the City's Deferred Compensation .Plan..
Section 7. PERS `Emplsyer 'Paid Contribution
The City shall pay 7~' of the employee's share. of; the Public Employees'
Retirement System contribution. The City will also defer the taxes on any
remaining member's contribution to PE RS .
Section 8. Work'_,During a Local Emergency
Members of this unit who are required, to work. during a Council
Declared Local '.Emergency shall be paid at 1 x their hourly rate for all
hours beyond their normal work day.
INSURANCE
Section 9. Health Insurance
During the. period' of this Memorandum of, Understanding, the City shall
pay any premium increases. beyond the current Gity contributiDns as
listed below. No. increase in the do]lar amount. of the employee
contributions shall. be assessed during the tsrm of this Memorandum of
Understanding, with. the exception of the Sonoma County Plan.

Sect~n 11. Life Insurance

Section. 14. Vacation
A. Amounts. _ All :regular empl~iyees of the, .City of Petaluma, after
working one; full, year are entitled t7o the equivalent of eighty (80)
hours of vacatir~n with ,pay in the year following the year in
which vacatiDn is ~ earned . "
All regular employees of "the City of ,Petaluma, after- five (5)
years of continuous 'service with the City;, anci beginning with the
sikth year, shall. be entitled " try the equivalent of one hundred
twenty" (120) hours of vacation per year.
After -ten; (10) ;years of continuous' service with the City, eight
(~8) ~ hours of -vacation shall be .added, for each year of continuous
service to a ~m_ aximum of one hundred sixty ~ (160) hours of
vacatDn .

Section 15.. Sick Leave
A . Accrual. Sick. lease shall accrue tp all. full-tune employees at the
rate of eight `Yiours for each month of continuous service. No
employee shall accumulate more sick 'have in any year than
provided.
B . Family ,Sick ,Leave... Leave of absence.. up to four working
days/shifts witYi, pay per fiscal year ~ may be granted to an
employee in 'the event of serous illness or .injury in the
emplDyee's;. immediate; family and will . be charged against sick
leave. The .immediate .family shall consist of the spouse,, children,
parents,, brothers;, sisters, or other individuals whose relationship
tq the employee is' that of a -legal ,dependent.. In such case., the
ap""pointing power' shall grant such sick leave. only when in his.
opinion the relationship of the sick or disabad person to the
employee warr--ants swch use of sick have. ~ .~
C . Relationship to .Workers Compensation,. Berle""fits shall be payable
in situatiDn where employee absence is d"ue to industrial injury
as provided in California State Workers' Compensation Law. The
amount of disability 'payments pai~3 to the injured. empls~yee shall
be deducted from. salary payable to the employee while on sick
leave. During the first three (3) cahndar days of absence fr~r
industrial: disability,. employees will be compensated at their full
.rate of pay without deduction from.. sick -leave unless they are.
hospitalized';. Absences resulting iri -immediate hospitalization or
absences continuing beyond the third' day shall 'be charged
against the- employee at the rate of one-half (.1/2) day .for each
day of .absence credifed or compensated' by workers' compensatiDn
insurance, provided the City receives ah compensation. paid by
workers' compensation payments only, without City payment for
salary at no 1DSS of .sick. ]cave. Sick leave fior industrial injury
shall `not be a]lowed for a disability -resulting from sickness,
self-inflicted injury or w71fu1 misconduct..
All employ- ees receiving full salaries in lEU of temporary disability
payments pursuant to Sectir~n 4850 Labor Code are _ entitled to
accumulate sick .leave during' such periods` of disability .
. Section a6. Bereavement Leave
In the event' of the death of an empls~yee',s' spouse..,. mother,
step-mother,. mother-iz-law, father, step-father; father-in-]aw,
brother; sister',, child,.. .including an adopted child:, grandchild and
grandparent, an employee who attends the funeral shall., be granted
time off work with pay.. The. amount of time :off work with pay shall
be oril'y that w:hi~ch is required to attend the funeral and make
necessary funeral. arrangements, but in no event shall it exceed three
(3) working days. These three (3) days shall nat.. be chargeable to
sick leave.. An additional two (2) days required for necessary funeral
arrangements may be charged to the employee's -sick have and any
additional time beyond these two days may be ..changed to accumulated
vacation or have without pay. Such bereavement leave. shall not be

_Sectis~n, l7. Holidays
A: Fixed Holidays.; The City shall observe eleven (,11): fixed-date
holidays. These `holidays shall be established for the City's fiscal
year as determined by City Council. resoluidon .
B. FlDating Holiday. During the. :period of thin Compensation Plan
the City will authorize. one (1) "Floating Holiday" per employee,
which may .be taken by the employee at a tune. selected by the
employee,subject ts~ operational requirements and approval.

course of the Fiscal Year.
Section. 18. Military Leave
Military leave shall ~be arranged in accordance. ;with the provisions' of
.:State law. All. employees entitled to military leave shall give, the
appointing power an opportunity within 'the limits of military
regulations ~ determine ,when such leave shall be taken,.
Section l9. -Leave of Absence without Pay
The City Manager may' grant a permanent or probationary empls~yee
leave of absence without pay or seniority fora period not to exceed
three (-3) months;. Good cause being shown by a written regiesf, the
City Manager may• °extend the leave of absence without pay for an
additional ,period. not. to exceed six ('6) montYis., No such :]gave. shall be
granted except upon written request of the employee setting forth the
reason for the request, and the approval will be in writing. Upon
expiration of a, regularly approved. leave; or within a reasonable period
of time. after notice °to return to duty, the employee shall. be reinstated
in the position, held,. at the time leave was granted. Failure on the
part of an employee _ on .leave ~ report promptly at its expiratifln, or
within a reasonable time after notice ~ return to duty, shall be cause
for discharge .
Section 20. Jury: `Leave
Every classified emplgyee of the City- who- is called or required "
serve as a trial juror shall. be entitled' t~ ,ab"sent himself. from his
duties- with. the City during. the period of such service or while
necessarily` being present; in court as a result of sucYi call: Under

Section 3. Overtime -Police Lieutenants
Overtime at the regular rate, 'of pay is authorized under the following
circumstances for Police Lieutenants:
1. When extra. duty is required by ca11-out or extended. service, due
to a major emergency situation, i.e., flood., earthquake, "SWAT
operatifln or other major unusual .incidents requiring the presence
of a L~i.eutenant.
2. When required for the ,proper investigatiDn_ of extremely pressing
personnel matters, such as serious personnel. complaints or officer
involved. shooting, when authorized by the Chief of Police.
3. To file .:behind another Lieutenant to provide .adequate shift
supervision during periods of high activity or special events with
the approval of the Chief of Police.. We feel. routine vacancies
should be filled by an Acing Watch Commander when possible to
provide training exposure to the Sergeants.
Section 4. Comperisati~n, for C]~thing Loss
The City Manager is authorized too provide compensation to City
employees for less or damage to' their clothing which occurs during the
course of carrying out. an official duty. A request. for compensation
hereunder shall be submitted in writing, ~n detail, to the City Manager
via the department head concerned. The amount of compensation, if
any,. shall' be at the discr-etion of the City Manager.
Section 5. Vacation, Payment at Terminat~n
Employees who terminate .employment shall be. paid in . a lump sum for

Sect~n 6. Sick Leave., Payment of
In the event of the death or retirement. of an employee who .has
completed ten (10') or more years of continuous service with the City,
the employee should be paid or shall. receive to his benefit fifty
percent (,50~~) of his accumulated but unused sick leave not to exceed
480 hours.
Section 7. Deferred 'Compensation
The City of Petaluma sha11 make available to the members of this u-nit,
the. City's Deferred Compensation Plan.
Sect~n 8. Holiday Pay
The City shall pay° Battalion Chiefs and Police Lieutenant for eleven
(11) holidays in the month of December in lieu of giving time off.

Section 9 Court Appearances: Police. Management Personnel
The City will, compensate - a minimum of four (4) • hours • at time and
one-half for. each.. officer for court appearances on his own time;
.additionally, time' and one-half (`1-1/2) shall be compensated for all
hours actually worked in court beyond such four (4'j hours.
An employee receiving :full. salary while not. wor}eing`; pursuant to. Labor
Code Section 4850; shall not be granted further ~com;pensati~n for court
time. unless. this court time (including all related: professional activities)
exceed the.. number of hours in the' regular- workday (eight (8) or ten
(10) , depending upon his or her schedule) ;in one. day or 40 hours in.
one week; if. such court time and related 'professional activities exceed
eight (8~) or ten (1Oj hours in one day .(whichever is the applicable
workday or 40 hours in one week) the employee shall be compensated
for such additional time at the applicable overtime rate.
Section 10. PERS. E_mphyer Paid Contribution
The City .shall pay 7~ of the employee's share of the Eublib Employees'
Retirement ,System contribution. The City will. also defer the taxes- on
any remaining member's contribution to PE'R'S'..
Section 11. Work Durin?g a Local Emergency,
Members of this' unit- who are required to -work during a Coun_cal
Declared Local Emergency shall be paid at 1 x their hourly rate for all
hours beyond their,,normal work day.
Section 12. Uniform Allowance -Public .Safety
The classifications of Police Captain and Police Lieutenant shall recieve
1.,5$ of the top step .Patrol Officer's annual salary effective July 1,
1988 as the Uniform :Allowance.
The elassificati:Dns of" Fire Battalion Chief and .Fire Marshal shall
recieve 1.5~ of the bop step Firefighter's annual salary effective
July. 1, 1988 as the Uniform Allowance,

B. .Scheduling.. The times' during a calendar year in which an
employee may take his vacation shall be determined by the
department Bead with due respect for the wishes of the :employee
and particular, regard for the needs', of the service.. If the
requirements .of .the .service are such than an employee cannot
take part or all of his annual- vacation in a part~ular calendar

department, and the Personnel Officer may defer 2.33 shifts of his
annual vacation to the succeeding calendar year, subject try the
other. provisoes of this rule. A written report of each deferred
vacation ~ signed `by the appropriate department .head and the
Personnel Officer rioting the details Sfiah be kept on file with the
Personnel Officer.,
The times "during the calendar year. in which. any employee may
take his vacatiDn shall be determined. by the department head with.
due respect. for -the wishes of the emphyee .and particular regard
for 'the needs of the service. If the requirements of the service
are such that an employee cannot take part or all of his annual
vacation in a particular calendar year,, . such vacation shall be
taken during 'the fallowing calendar year.

Sectien T9. Sick .Leave
A . General. Sick l~aye with pay. shall be granted to all probationary
and permanent .emplr~yees within the competitive ser--vice. Sick
leave shall.. not be considered as aright which. an employee may
use at ,his' discretion, but shall be allowed only in case of
necessity or actual personal sickness, disability, or as allowed by
the compensatiDn plan .
B . Accrual. Suck lease shall accrue to all .full-time employees at the.
rate of eight hour-s for each month of continuous service. Fire
Battalion Chiefs shall accrue at 12,.0 hours. .per month.. No
employee .shall accumulate more sick leave in any year than
provided'...
C . Notification Procedures. In order to receive compensatiDn while
absent on sick leave, the employee. shall notify his immediate
superiDr or the Personnel Office prior- ~ or within four hours

more than three days/shifts duration,: the employee may be
required ~ ~ a physizaan's certificate with the Personnel Office
stating the. cause o€ the absence.
D.. Famil .,Sick, Leave:. Leave of absence up ~ four working
days shifts with: pay per fiscal year.. may be granted to an
emplpyee in. the event of serinus' illness or injury in the
emp].c~yee's :immediate .family and will be charged against sick
leave. The immediate family shall consist of "the' spouse, children,
parents, brothers.,, sisters, or other in'divitluals whose relaticznshp
tD the empleyee is that of a legal dependent. In such case., the
appointing power shall. grant such sick leave only when. in his
opi.nir~n the relatiDnship of the sick or .disabled person to the
employee. warrants such use of sick leave..
E . Relationship 'to Workers Compensation Benefits shall be payable
in situations. where. employee absence is due to industrial injury
as provided in ,°California State Workers' Compensation Law. The
amount of disability payments pain _to the injured :employee' shall
be aeaizct~ed from salary payable to the empls~yee while on sick
' leave. During the •fisst three (3) calendar days of absence for
industrial. disability, 'employees will be compensated at their full
rate of pay without. deduction. from sick' ]gave .unless they are
.hospitalized.. Absences. resulting, in immediate hospitalization or
ab ences continuing beyond the third. .day .shall be charged
against the employee at ahe rate of one-'half (•:1/2) day for each
day of absence credited or compensated by workers' compensation
insurance, provided the City receives all compensation :paid b:y
workers' compen_satipn payments only., without City payment. for
salary at no. loss of sick leave.. Sick ]cave for industrial injury
shall not be allowed for a clisability .resulting from sickness,
self-infli~t~d' injury or willful misconduct.

All emplDyees receiving full. salaries in lieu of, temporary disability
payments • pursuant ~ Section 4850 Labor Code are entitled to
accumulate sick leave during such periods of disability.
Section 20. Bereavement Leave
In the event of: the death of an employee's spouse, mother,
step-mother., mother-in-law , father, step-father, father-in-law ,
brother, sister, child, including an adopted ,child, grandchild and
grandparent, an .employee who attends the funeral shall be granted
time off work with pay . The amount of time off work with pay shall
be only that. which is required try attend.. the funeral and make
necessary funeral arrangements, but in no event shall it exceed three
(3) working days. These three (3) days shall. not be chargeable ts~
sick leave. An additional two (2) days required for necessary funeral
arrangements may be charged to the employee's sick leave and any
additional time beyond these two days may be charged tD accumulated
vacation or leave :without pay. Such bereavement, leave shall not be
accruable from. fiscal .year to fiscal year, nor shall it have any
monetary value if .unused..
Section 21. Holidays
A . Fixed Holidays The City shall observe eleven (-11) fixed-date
holidays.. These holu3ays shall be established.. for the City's fiscal
year as determined by City Council resolution.
B. Floating Holiday.: During the period of° this Compensation Plan,
City will authorize one (1) "'Floating Holiday" per employee, which
may be taken by the employee at 'a timer selected by the employee,
subject to operational. requirements and approval determined by
..
the City.. Emplflyees hired between July 1 and December 31 will
be eligible; for a "Floating Holiday" during the course of the
Fiscal Year .
Section 22. Military Leave
Military leave shall. be arranged in .accordance. with the. provisions of
State .law . All employees entitled. to military leave shall. give the
appointing- power an opportunity within-. the . limits of military
regulations to determine when such leave shall be taken..
Section 23. Leave of Absence without Pay
The City Manager :may grant a permanent or probationary employee
leave. of absence without ;pay or seniority fora period. -not ~ exceed
three (3} -months., Goad- cause being shown. by a wri~n request, the
City 'Manager may extend .the leave of absence without pay for an
additional period not to. exceed: six (6) months:. No such. leave shall be
granted except upon written request of the employee setting forth the
reason for the request, and the approval will be, in writing. Upon

expiration of a regularly approved have or within a reasonable perr~d
of time after notice. to return to duty, the employee shall be reinstated

part of an employee on leave ~ report promptly at its expiration, or

Section 24. Jury Leave
Every classified employee of the City .who ~ .called or required to
serve as a 'trial juror shall be entitled to absent himself from his
duties with: the: City :during the period. of such service or while
necessarily being present in court as a result .of such call. Under
such circumstances,,:. the ,employee shall be paid. the difference between
his full salary and any payment received 'b"y "him, except travel pay,
for such duty..
Section 25. Adiriiriastrative Leave
Members of this ;unit are eligible for administrative; leave.. Days. may
bey granted, by, the City Manager upon written. request; not to exceed
ten (10) drays per Fiscal, Year.
OTHER
Section 26. Retirement
The City of Petaluma's retirement. plan under- the Pub].io Employee's

A . Purpose of Rule
(1)~ To promote improved emplflyer-emplr~yee re]~tions by
establishing .grievance procedures on matters for .which

B . Matters- Subject:. to Grievance Procedure,. Any emphyee in the
competitive ervice shall have the right to appeal under this rule,
a decision affecting his employment over which his appointing
power has partial. or complete jurisdiction ;and for which appeal is
not provided by other' regulations or is not prohibited.
C. Informal Grievance P°rocedure. An employee who has a problem or
complaint should: first try to get it settled. through discussion
with 'his immediate supervisor without un'd'ue. de]ay. If, after this
discussion., he does not be].eve• the. problem has been
satisfactorily resolved, he shall have the rig,~ht to cliscuss it ~ with
his. supervisor's immediate supervisor, if any, in the
admirusi-xatve service. .Every effort should be made to find an
acceptable; ~solutnn by informal means .at the ls~wer possible level
of supervision,. If the employee is .not. in agreement with the
decision reached- by discussion, he shall then :have the right to
file a formal °appeal in wri#ing with_isi ten (10) calendar days after
receiving the: informal decision of his immediate superior. An
informal appeal shall not be taken above, the appointing power.

rendered, will constitute a dropping of the appeal.
(4) City Manager ~ T,he; City Manager r_e_ceiving the appeal or is
designated representative ahould discus's the grievance with
the employee, 'his representative , if any , and.. with other
appropriates person . T;he City Manages may designate a fact
finding committ=gee, officer not. in the normal line of
supervision,, or Personnel. Board to, advise him concerning
the appeal. 'The City Manager shall render a decision in
writing to ~ the employee within twenty (20) calendar days
after receiving' the appeal.
(5) Conduct of Grievance Procedure.
(a) The time: limits specified above may ,be extended to a
definite date by metal agreement of the employee and
the reviewer ~ concerned . '
(b) The employee may request the, assistance of another
.person. of his ..own choosing in :preparing and presenting
'his.: appeal at any level of review .
(c,) .The employ,.ee and his, representative. may' .be privi]eged
to use .a :reasonable ,amount of 'work time as determined
by the appropriate department head in conferring about
and presenting the appeal.
(d') Employees .shall be assured freedom from reprisal for
using the. grievance procedures.
