HomeMy WebLinkAboutResolution 2004-107 N.C.S. 06/21/2004 Resolution No.2004-107 N.C.S. of the City of Petaluma, California AUTHORIZING GRADING ' FOR MAGNOLIA PLACE SUBDIVISION PRIOR TO FINAL MAP APPROVAL WHEREAS, the developer, O'Brien Group, has requested permission to grade the Magnolia Place Subdivision on Magnolia Avenue, Samuel Drive and Gossage Avenue prior to final map approval; and, WHEREAS, the developer agrees to comply with the City Grading and Erosion Control I Ordinance No. 1576 NCS; and, WHEREAS, the developer agrees to comply with the Regional Water Quality Control Board's policies, file a Notice of Intent and prepare a Storm Water Pollution Prevention Plan; and, 'i i WHEREAS, the developer agrees to enter into a grading agreement and provide surety to secure the performance of the grading work; and, WHEREAS, the developer shall obtain a grading permit from the Community Development Department, and; WHEREAS, the City Council discussed the grading request and agreed to allow grading on the Magnolia Avenue portion and that no grading shall occur on the Gossage Avenue portion of the Magnolia Place Subdivision until the following conditions of approval have been met to the satisfaction of the Community Development Director. 1. The Site Plan and Architectural Review Committee (SPARC) approved the final landscape and tree mitigation plan for the Gossage Avenue portion of the project. Resolution No. 2004-107 N.C.S. 2. Public notices for the SPARC hearing reviewing the final landscape and tree mitigation plan shall be distributed to parcels within a 500-foot radius of the Magnolia Place Subdivision. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Petaluma that authorization to grade the Magnolia Avenue portion of the Magnolia Place Subdivision and upon satisfying the herein described conditions of approval, grade the Gossage Avenue portion of the Magnolia Place Subdivision prior to final map approval is approved. t i Under the power and authority conferred upon this Council by the Charter of said City.
