Dear City Council:
The City has historically charged the Meyers-Nave bills to defend the City General Fund to the City's
General Fund. But now, the City-is now using enterprise funds to cover the General Fund shortfall.
I wrote the Council back on January 7, 2013 protesting that these litigation costs are a General Fund
(1100) expense, not an expense that should be charged to the Wastewater Enterprise Fund (6600)
(29%) nor to the newly created Storm Drain Utility Fund (6800) (71%)which has no revenue source
other than the General Fund.
On February 4th, 2013 staff correctly charged the-attorney's fees for Meyers and Nave in regards to
(Bryant Moynihan v. The City of Petaluma), to the City's General Fund. I attached one page of the
Meyers-Nave bill and one page of the-claims and bills showing the $10,444.70 invoice being paid out
of the General Fund. The summary of Meyers-Nave's invoices by fund was incorrect understating the
amounts charged to 6600 and not even listing 6800 on the summary.
Now, this month, The City is charging 21% of the storm drain maintenance expense to the
Wastewater enterprise fund and 79% to the Water Enterprise Fund (6700). And again, the summary
of billings is incorrect. There has never been any study to justify any use of enterprise funds for the
legal costs incurred by the City.
The City staff has made three mistakes in the past 3 months in regards to this one Meyers-Nave's
case billing. How many more Meyers-Nave mistakes have been made for other issues? When will
the billing descriptions for the Meyers Nave billings be properly described? It would take less time to
do the job correctly than for staff to provide the Council an inaccurate and misleading summary report
of Meyer's Nave billings. Why is this city administration not able to do their job correctly?
