AMENDING RESOLUTION NO. 2008-186 N.C.S. TO PROVIDE FOR
REORGANIZATION, LAYOFFS, AND ABOLISHING ONE ASSISTANT IN CIVIL
ENGINEERING, ONE MAINTENANCE WORKER III, ONE TRAFFIC ENGINEER,
AND ONE PUBLIC WORKS INSPECTOR II POSITIONS IN THE GENERAL FUND
FOR FISCAL YEAR 2008-09, EFFECTIVE OCTOBER 31, 2008, AND ONE
CUSTODIAL SUPERVISOR AND THREE CUSTODIAN POSITIONS EFFECTIVE
NOVEMBER 14, 2008, DUE TO LACK OF FUNDS AND CONSIDERING
CONTRACTING AND/OR SUBCONTRACTING WORK FOR LABOR COST-
CONTROL REASONS; AND REINSTATING ONE LAID OFF AND FROZEN FIRE
INSPECTOR I POSITION, EFFECTIVE OCTOBER 31, 2008.
WHEREAS, for the fiscal year 2008-09, the City Council delayed approval of the
General Fund portion of the budget in order to re-evaluate projected expenditures and expenses;
and,
WHEREAS, that evaluation determined the preliminary budget, as presented, over-
estimated the likely revenue by approximately $2,146,300 and determined that expenditures need
to be further reduced in order to balance the preliminary budget as required by law; and,
WHEREAS, on October 6, 2008, the City Council, in order to bring anticipated General
Fund expenditures into line with the latest revenue estimates as quickly as possible, and in
addition to other budget adjustments, adopted Resolution 2008-186 N.C.S. laying off and/or
freezing vacancies in 26 positions supported by the General. Fund and laying off employees
occupying the vacated positions or any position to which such employees have and invoke
displacement rights; and,
WHEREAS, the City Council reserved for further consideration whether to approve
permanently replacing by contracting or subcontracting, for labor cost-control reasons, the work
formerly performed by the Custodial Supervisor and three Custodian positions to permit further
evaluation of the cost saving proposal, and to await the outcome of further impact bargaining and
discussion regarding alternatives to layoffs, with AFSCME representatives; and,
WHEREAS, the City Council also encouraged staff, in impact bargaining with Local
1415 International Association of Fire Fighters representatives, to continue to consider
alternatives to layoffs; and,
WHEREAS, City Staff conducted the requested evaluation of cost savings proposals
and conducted further impact bargaining with the aforementioned groups; and,
WHEREAS, additional evaluation of projected General Fund revenues and expenses
reinforces the need for the cost saving proposal to permanently replace by contracting or
subcontracting the work performed by the Custodial Supervisor and three Custodians to avoid
the potential need for further staff reductions at this time; and,

WIIEREAS, no alternatives to Layoffs were approved by AFSCME membership; and,
WIIEREAS, agreement was reached with the Fire Fighters Association regarding an
alternative to layoff and freezing a Fire Inspector I Position, and a side letter of agreement to the
bargained agreement with the Association has been executed.
NOW, THEREFORE, BE IT RESOLVEll by the City Council of the City of
Petaluma that Resolution No. 2008-186 N.C.S. adopted October 6, 2008, is hereby amended as
follows:
1. The reorganization, layoff, and abolishing of one Assistant in Civil Engineering, one
Maintenance Worker III, one Traffic Engineer, and one Public Works Inspector II
position, effective October 31, 2008, and one Custodial Supervisor and three
Custodian positions, effective November 14, 2008 are hereby authorized. In addition,
for labor cost-control reasons, the work formerly performed by these abolished
positions may be permanently replaced by contracting or subcontracting the work.
Said reorganization and layoffs of positions shall occur in accordance with applicable
memoranda of understanding, compensations plans and personnel rules.
2. The laid-off and frozen position of Fire Inspector I is hereby reinstated, effective
October 28, 2008.
3. Any and all provisions of Resolution 2008-186 N.C.S. inconsistent with this
Resolution are hereby repealed. Except for such repeal, Resolution 2008-186 N.C.S.
continues in full force and effect.
Under the power and authority conferred upon this Council by the Charter of said City.
