RESOLUTION APPROVING THE PARCEL MAP
FOR BODEGA VISTA II, A 3 LOT
RESIDENTIAL DEVELOPMENT LOCATED NORTH OF BODEGA AVENUE
AT NORTH WEBSTER STREET, EAST OF AMBER WAY, AP NO. 6-221-05
WHEREAS, A.~ogel Engineering, has filed with this Council a parcel map to
subdivide land within this City to be known as Bodega Vista II and has
paid all required filing fees; and,
WHEREAS, the City Engineer, the Director of Planning and the Planning
Commission have examined and reviewed the same as required by law and all
reports, recommendations, and comments thereon have been forwarded to
and considered by this Council at its meeting held on April 4, 1988;
NOW, THEREFORE, BE IT RESOLVED that this Council hereby finds as
follows
1. The proposed parcel map, together with provision for design and
improvement is consistent with the General Plan.
2. The proposed parcel map is compatible with the objectives, policies,
general land uses and programs specified in said General Plan.
3. The site is physically suitable for the type of development proposed.
4. The site is physically suitable for the proposed density of development
as conditioned herein.
5. The design of the development, and the proposed improvements
therefore, will not cause substantial environmental damage and no
substantial or avoidable injury will occur to fish or wildlife or their
habitat .
6. The design of the parcel map as conditionally approved will not cause
public health problems .

NOW, THEREFORE, BE IT FURTHER RESOLVED that this Council hereby
approves the parcel map known as Bodega Vista II, subject to the following
conditions
1. The following are the requirements of the Building Inspector:
a. Any buildings to be removed shall require a permit.
b. Building pad elevations shall be certified prior to construction.
c. A holding tank for lots above 160' elevation may be required by
the City Engineer.
d. All retaining walls shall meet the requirements of the 1985 UBC..
e. Where ground slopes greater than 10%, foundations shall be
stepped per Uniform Building Code 2907(C),
f . Soils with an expansion index greater than 20 require special
design foundation per Uniform Building Code 2904 (B) .
2. All changes required by the conditions of approval shall be made to
the Parcel Map .
3. All Planning commission conditions of approval for the PUD plan which
affect the PARCEL Map shall also be incorporated in the Parcel Map
prior to revised Parcel Map submittal.
4. The project shall conform to all conditions of the City Engineer as
follows
a. The developer shall comply with the amended Petaluma Municipal
Code Sections 20.36.010 and 20.36.020 which require the
developer to pay storm drainage impact fees (as calculated in
Chapter 17.30) on construction in all sections of the City of
Petaluma.
b. Full half street improvements along Bodega Ave. shall be required
when Bodega Vista I Phase 2 is constructed. If field conditions
prove the existing pavement to be satisfactory, the full pavement
section will not be required.
c. Preservation of the cobblestone curb along Bodega Avenue shall
conform to Resolution 86-21 which established policy and
preservation design standards.
d. The two 30' access/PUE easements shall be private and maintained
by the property owners.
e. The two 30' access easements and all backyard and hillside
drainage control must be within underground pipe system with
surface catchment swales and inlets.
f . The parcel map will be responsible for a pro-rata share of the
cost of signalizing the intersection of North Webster Avenue and
Bodega Avenue as determined by the City Engineer.

g . Provision for maintenance of the private sanitary sewer and storm
drainage system are required.
h. This development. shall pay a pro-rated share of the cost of the
off-site storm drainage improvements as proposed by Bodega Vista
II. This cost shall be determined by the City Engineer.
i. The proposed subdivision shall contribute towards the storm drain
payback agreement approved by the City Council in concept for
the Wright Subdivision.
j . Minimum horizontal separations between the water services and the
proposed sanitary sewer shall be 10' .
k. The ultimate one half street right of way for Bodega .Avenue is 43
feet. Additional dedication along Lot 1 frontage shall be
required.
1. A 10' PUE is required along the Bodega Avenue frontage of Lot
1.
m. Prior to issuance of any building permit, the lot pad elevations
shall be certified by a registered Civil Engineer.
n. This development is contingent upon the improvements to be
constructed concurrently. If this is not possible, it will be the
responsibility of the Bodega Vista II developers to improve North
Webster Street and New Amber Way (including appropriate
dedications, undergrounding and utility extensions) and Bodega
Avenue including modification of the existing traffic signal at the
intersection of Bodega Avenue and North Webster Street to
accommodate the future road extention. The off-site storm
drainage improvements proposed by Bodega Vista I shall also be
required and must conform to the Sonoma County Water Agency.
It is recommended that construction of these improvements be a
credit towards the projects storm drainage impact fee. This
determination should be made by the City Council.
5. School Facilities and Park and Recreation Improvement Fees shall be
paid in accordance with existing laws and ordinances at the time of
building permit issuance.
6. The parcel map shall conform to the Sonoma County Water Agency
Design Criteria .
7. In the event that archeological remains are encountered during
grading, the work shall be halted and a qualified archeologist shall be
consulted for evaluation of the artifacts and to recommend future
action. The local Indian community shall also be notified and consulted
in the event any archeological remains are uncovered.
8. Storm Drainage Impact Fees shall be paid by Municipal Code, Chapter
17.30 as amended by Council policy.

9. Applicant shall participate on a fair share basis in any future
assessment districts or other funding mechanisms formed to improve
areawide flooding, traffic congestion or other subregional problems for
which development of this property is found to be a contributing
factor. These "Major Capital Facilities Fees" shall be applicable in an
amount to be determined by the City Council.
BE IT FURTHER RESOLVED, that the City Council finds that the
requirements of California Environmental Quality Act Guidelines have been
satisfied by Resolution No .gg-113-A~ . C . S . , adopted by the City Council on
April 4, 1988.
