of the City of Petaluma, California
A RESOLUTION APPROVING THE UNIT DEVELOPMENT PLAN
FOR BODEGA VISTA II SUBDIVISION A 6 SINGLE-FAMILY UNIT
DEVELOPMENT, NORTH OF BODEGA AVENUE, EAST OF AMBER WAY
AND NORTH WEBSTER STREET.
WHEREAS, by Ordinance No. f G ~ N.C.S., Assessor's Parcel Number
6-221-05 has been rezoned to Planned Unit Development; and
WHEREAS, by action on February 23, 1988, the Planning Commission
considered and forwarded a negative recommendation to the City Council on
the unit development plan for 6 single-family units in said Planned Unit
District; anal,
WHEREAS, Mogel Engineering has appealed the action of the Planning
Commission of February 23, 1988; and,
WHEREAS, the matter has been properly brought before and heard by the
City Council at a duly noticed hearing on April 4, 1988 at which the
applicants and all interested parties were permitted to be heard; and,
WHEREAS, the City Council finds that the requirements of California
Environmental Quality Act Guidelines Section 15083 have been satisfied and
hereby incorporates by reference the Negative Declaration approved by
Resolution No. 88-113-A N.C.S.
NOW, THEREFORE, BE IT RESOLVED that based on the following findings
the appeal of the action of the Petaluma Planning Commission is hereby
granted:
1. The development plan, as conditioned, results in a more desirable use
of the land, and abetter physical environment than would be possible
under any single zoning district or combination of zoning districts.
2. The development plan as conditioned has a suitable relationship to
Bodega Avenue and Amber Way which are adequate to carry the
additional traffic generated by this development.
3. The development plan represents a unified and organized arrangement
of building sites and service facilities which are appropriate in relation
to adjacent properties and adequate landscaping will be provided for a
each property is reviewed by SPARC.

4. The scenic and natural qualifies of the site are protected through the
limitations on building heights on the ridge and through SPARC
review .
5. The development of the project site as conditionally approved will not
be detrimental to the public welfare, will be in the best interest of the
City, and will be in keeping with the general intent and spirit of the
Zoning Regulation of the City of Petaluma and the Petaluma General
Plan .
NOW THEREFORE, BE IT FURTHER RESOLVED that the unit development
plan for a five lot, six unit development as presented in the Improvement
Standards, Exhibit "A", is hereby conditionally approved pursuant to
Section 19A-504 of Zoning Ordinance No. 1072 N.C.S. , as amended subject
to the following conditions:
1. Building architecture, exterior materials, color, landscaping, irrigation
design, and materials shall be subject to SPARC approval.
2. The Improvement Standards shall be modified to incorporate the
following
a. Garage conversions shall be prohibited.
b. Home occupations are permitted, subject to Petaluma Zoning
Ordinance and provisions of any CC&R's.
3. All conditions of approval of the Tentative Map to be submitted shall
be incorporated where appropriate into the PUD Development Plan.
4. Driveway locations as shown in Improvement Standards (page 4) shall
be typical, not binding on each lot., but subject to staff approval.
5. Foundation and floor plans shall be stepped so as to keep buildings
close to natural grade, subject to SPARC approval.
6. No cuts or fills in excess of 3' shall be permitted. Improvement
Standards shall be expanded to limit grading to staff approval.
