HomeMy WebLinkAboutResolutions 88-067 N.C.S. 03/07/1988~-~ ~~ Resolution No. s8-~~ N.C.s. of the City of Petaluma, Ca{ifornia RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PETALUMA REQUESTING THE BOARD OF SUPERVISORS OF THE COUNTY OF SONOMA TO CONSOLIDATE A SPECIAL MUNICIPAL ELECTION TO BE HELD ON TUESDAY, JUNE 7, 1988 WHEREAS, the City Council of the City of Petaluma has called a special municipal election to be held on June 7, 1988, for the purpose of submitting to the voters a measure concerning a proposed charter amendment; and WHEREAS, it is in the public interest that the special municipal election be consolidated with the Statewide Primary election to be held on the same date, and that within the City, the precincts, polling places and election officers of the two elections be the same, and that the County Election Department of the County of Sonoma canvass the returns of the special municipal election and that the election be held in all respects as if there were only one election; NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS: 1. Pursuant to the requirements of Section 23302 of the Elections Code, the Board of Supervisors of the County of Sonoma is hereby requested to consent and agree to the consolidation of a special municipal election in the City of Petaluma with the statewide Primary election on Tuesday, June 7, 1988, for the purpose of submitting to the voters a charter amendment measure. 2. The exact form of the charter amendment measure to appear on the ballot is as follows SHALL THE CITY OF PETALUMA CHARTER BE AMENDED TO ADD TO ARTICLE IX THE FOLLOWING SECTION 63.5? "63..5 Adoption of Utility Users Tax. A utility users tax within the City of Petaluma Yes may be levied or imposed only after a majority of the voters within the City of Petaluma, actually voting on such measure, approve such a utility tax. Such a utility tax may include a tax upon the use in the City of Petaluma by any residential user; business user, industrial user, or any other user, of telephone communication services whether intrastate, No interstate, electrical energy, gas, water, garbage, cable television or any other use of utilities by residents of the City of Petaluma. This is an exclusive right granted to the voters of the City of Petaluma and neither the City Council of the City of Petaluma nor any of its officers, agents or employees shall have the power to levy and/or impose such a utility tax without such voter approval. The election shall be held in all respects as if there were only one election, and only one form of ballot shall be used. 4. The Board of Supervisors is requested to issue instructions to the County Election Department to take any and all steps necessary for the holding of the consolidated election and canvassing of the returns of the special municipal election, and to seek reimbursement for its additional election costs from the City of Petaluma as provided in the existing agreement between the City and County covering such costs. 5. The City Clerk is hereby directed to file a certified copy of this resolution with the Board of Supervisors and the County Election Department of the County of Sonoma.. reso .election LAW 12 Under the power and authority conferred upon this Council by the Charter of said City.
