HomeMy WebLinkAboutResolution 2010-005 N.C.S. 01/04/2010Resolution No. 2010-005 N.C.S. of the City of Petaluma, California AUTHORIZING THE POLICE DEPARTMENT TO UTILIZE FUNDS FROM THE AMERICAN RECOVERY AND REINVESTMENT ACT JAG (ARRA JAG) GRANT TO PURCHASE ONE (1) 2010 CHEVROLET TAHOE POLICE VEHICLE AND ONE (1) 2010 CHEVROLET'/4 TON 4X4 CREW CAB P/U TRUCK FROM VICTORY AUTOWORLD, PETALUMA, CA IN THE AMOUNT OF $78,315.18 WHEREAS, on July 20, 2009, the City Council adopted a resolution authorizing the Police Department to apply for and accept federal stimulus funds administered by the U.S. Department of Justice, Bureau of Justice Assistance under the American Recovery and Reinvestment Act (ARRA); and, WHEREAS, the Police Department applied for and received a grant under the ARRA in the amount of $103,332 for the purchase of police vehicles and equipment; and, WHEREAS, the purpose of the ARRA grant funds is to help stimulate the local economy; and, WHEREAS, the Police Department sought price quotations fora 2010 Chevrolet Tahoe Police Vehicle and a 2010 Chevrolet'/4 Ton 4X4 Crew Cab P/U Truck equipped as specified by the Police Department from various local automobile dealers; and, WHEREAS, the only local automobile dealer that could fill the order for the police vehicle and truck with the required equipment was Victory Autoworld in Petaluma; and, WHEREAS, Petaluma Municipal Code (PMC) section 4.04.050 requires purchases of supplies and equipment with an estimated value greater than the amount defined by the City's Charter (which is $25,150 based on the December 18, 2007, procurement guidelines) to be by formal bid pursuant to PMC section 4.04.080; and, WHEREAS, PMC section 4.04.050 exempts a purchase from the bidding process when an emergency exists, the commodity can be obtained from only one vender or the purchase is . pursuant to a cooperative purchase program with other public agencies; and, Resolution No. 2010-005 N.C.S. Page I WI~EREAS, because Victory is the only vendor that is local and has the ability to fulfill the vehicle order with the specified police equipment, Victory is the sole vendor able to supply the police vehicles in compliance with the ARRA grant, and the purchase is exempt from the bidding requirement. NOW, THEREFORE, BE IT RESOLVEll, that the City Council hereby authorizes the purchase of one (1) 2010 Chevrolet Tahoe Police Vehicle and one (1) 2010 Chevrolet'/4 Ton 4X4 Crew Cab P/U Truck from Victory Autoworld, Petaluma, CA in the amount of $78,315.18 Under the power and authority conferred upon this Council by the Charter of said City. REFERENCE: I hereby certify the foregoing Resolution was introduced and adopted by the Council of the City of Petaluma at a Regular meeting on the 4`~ day of January, 2010, by the following vote: AYES: Qarrett, Vicc Mayor Glass, Harris, 1-lealy, Rabbitt, Renee.
