8 ORDINANCE,OF'THE CITY COUNCIL OF THE:CITY'OF PETALUMA
9 DESIGNATING THE;HANSEN HOUSE AT
10 718 NORTH MCDOWELL BOULEVARD
11 A LOCAL HISTORIC LANDMARK

14 WHEREAS, as part of the North McDowell,Commons project the applicant has initiated
15 the designation of`the Hansen=House at 718 North McDowell a local landmark in response to
16 previous determination by the•Historic and Cultural Preservation Committee that the Hansen
17 House has local significance; and,
18
19 WHEREAS, on May 28; 2013 at a duly noticed public hearing the,Historic and Cultural
20 Preservation Committee reviewed the proposal for rehabilitation and designation of the Hansen
21 House and recommended the Planning'Commission recommend;designation to the City
22 Council; and,
23
24 WHEREAS; on May 28, 2013 at`a duly noticed public hearing the Planning Commission
25 approved a Mitigated,Negative Declaration and Site Plan and Architectural Review for the
26 North McDowell Commons project, including the rehabilitation of the:Hansen House; and,

28 WHEREAS, on May 28,2013 at a duly,noticed public:hearing the.Planning Commission
29 approved Resolution No. 2013-091 recommending the City Council designate the Hansen House
30 at 718 North McDowell a local'historic landmark,

32 WHEREAS, on July 1; 2013 the City of Petaluma'City Council held a duly noticed public
33 hearing to consider,the proposed landmark designation.

35 NOW THEREFORE BE',IT ORDAINED BY'THE COUNCIL OF THE CITY OF PETALUMA AS"FOLLOWS:

37 Section 1. Designation as Local Landmark. The,City Council hereby designates the Hansen
38 House at 718.North McDowell Boulevard; APN 137-061-035, as a local historic landmark; based
39 on the following determinations:
40
41 A. Designation of the Hansen,House asta local landmark,is consistent with the Petaluma
42 General Plan 2025,in that it identifies; recognizes; and protects a historic resource that
43 is part. of Petalumd's unique and irreplaceable cultural, heritage (3-P-1) and
44 designates a local landmark as part of the development review process(3-P-1 D).

2 B. Designation of the Hansen House will further implement historic preservation
3 objectives outlined in Chapter 15 of the Implementing Zoning Ordinance (IZO) in that
4 it will serve'to promote the health, safety, and general welfare cif the public through
5 the protection, and enhancement of a building that is a reminder of past eras,
6 events, and persons important to Ideal history by ensuring that the Hansen House is
7 subject to the historic preservation controls and'standards in said Chapter.

9 C. On July 24, 2003 the Historic and Cultural Preservation Committee found the Hansen
10 House to be locallysignificantbased on its association with local midwifery as related
11 to owner Anna:Marie Hansen and its association With the local Danish agricultural
12 community.

14 D. The following description of the characteristics of the Hansen House justify its
15 designation as a local historic landmark and are excerpts from Susan Clark's
16 evaluation of the Hans and Anna Marie Hansen Homestead, dated May 2003:
17
18 1. The Hansen House is associated with Anna Marie Hansen who was a midwife and
19 evidenced through an outpouring of public comment during public hearings
• 20 regarding the historic importance of the building was associated with local
21 midwifery in,PetalOrna.

23 2. The Hansen,House is associated,with the local Danish agricultural community in
24 that Hans and Anna Marie Hansen, immigrants from Denmark who became
25 chicken ranchers-and built:the present farmhouse on the 23 acre site in 1906. The
26 Hansens were part of Petaluma's Danish community at the turn of the 20th
27 century and the house on ,McDowell Boulevard became. a common gathering
28 place for the extended family and friends. In 1930 there were 629 foreign born
29 Danes•living.in'SOnoma County;`more than half of whom lived in Petaluma and
30 most of the others were located in the nearby communities of Two Rock,
31 Penngrove, and.Petaluma.

34 E. The following character defining elements of the Hansen House are to be preserved:
35
36 1. enclosed Water tank;
37 2. hipped roof;
38 3. v-rustic siding;
39 4. double,hung wood sash windows;
40 5. cutaway front porch;
41 6. structural massing;,
42 7. the single.Tuscan column supporting the root over the porch; and
43 8. existing palmtrees_in front of the building

45 F. The location of the landmark is 718 North McDowell Boulevard and the boundaries of
46 the landmark as•the assessor's parcel number 1372061-035.

48 Section 2. Recordation of Designation: The local landmark designation shall be recorded by
49 the 'applicant With the Sonoma County Recorder's office as a deed,restriction applicable to
50 assessor's parcel number 137=051-035. Proof ,of such recordation shall be provided to the
51 Planning Division prior any building permit final relating to the Planning Commission's approval of
52 13-SPC-0082.

2 ,Section 3. Severability. If any provision of this ordinance or the application thereof to any
3 person or circumstance.is:held.invalid,the remainder of the ordinance, including the application
4 of such part or provision to,other persons or circumstances shall not be affected thereby and
5 shall continue in full force and effect. To this end, provisions of this ordinance are severable. The
6 City Council hereby declares that it would have passed each section, subsection, subdivision,
7 paragraph, sentence, .clause, or phrase hereof irrespective of the fact that any one or more
8 sections, subsections, subdivisions, paragraphs, sentences, clauses, or phrases be held
9 unconstitutional, invalid, or unenforceable.

11 Section 4. Effective Date. This ordinance shall become effective thirty (30) days after the
12 date of its adoption by the'Petaluma City Council.

14 Section 5. Posting/Publishing of Notice. The City Clerk is hereby directed to post and/or
15 publish this ordinance or a synopsis of it for the period and in the manner required by the City
16 Charter.
