9 ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PETALUMA
10 DESIGNATING THE HANSEN HOUSE AT
11 718 NORTH MCDOWELL BOULEVARD
12 A LOCAL HISTORIC LANDMARK

15 WHEREAS, as part of the North McDowell Commons project the applicant has initiated
16 the designation of the Hansen House at 718 North McDowell a local landmark in response to
17 previous'determination by the Historic and Cultural Preservation Committee that the Hansen
18 House has local significance; and,
19
20 WHEREAS, on May 28, 2013 at a duly noticed public hearing the Historic and Cultural
21 Preservation Committee reviewed the proposal for rehabilitation and designation of the Hansen
22 House and recommended the Planning Commission recommend designation to the City
23 Council; and,

25 WHEREAS, on May 28, 2013 at a duly noticed public hearing the Planning Commission
26 approved a Mitigated Negative Declaration and Site Plan and Architectural Review for the
27 North McDowell Commons project, including the rehabilitation of the Hansen House; and,

29 WHEREAS, on May 28, 2013 at a duly noticed public hearing the Planning Commission
30 approved.ResolutionNo. 2013-011 recommending the City Council designate the Hansen House
31 at 718 North McDowell a local historic landmark,

33 WHEREAS, on July 1, 2013 the City of Petaluma City Council held a duly noticed public
34 hearing to consider the proposed landmark designation.

36 NOW THEREFORE BE IT ORDAINED BY THE COUNCIL OF THE CITY OF PETALUMA AS FOLLOWS:

38 Section 1. Designation as Local Landmark. The City Council hereby designates the Hansen
39 House at 718 North McDowell Boulevard, APN 137-061-035, as a local historic landmark, based
40 on the following determinations:

42 A. Designation of the Hansen House as a local landmark is consistent with the Petaluma
43 General Plan 2025 in that it identities, recognizes, and protects'a historic resource that

1 is part of Petaluma's unique and irreplaceable cultural heritage (3-P-1) and
2 designates a local landmark as part of the development review process (3-P-1 D).

4 B. Designation of the Hansen House will further implement historic preservation
5 objectives outlined in Chapter 15 of the Implementing Zoning Ordinance (170) in that
6 it will serve to promote the health, safety, and general welfare of the public through
7 the protection and enhancement of a building that is a reminder of past eras,
8 events, and persons important to local history by ensuring that the Hansen House is
9 subject to the historic preservation controls and standards in said Chapter.

11 C. On July 24, 2003 the Historic and Cultural Preservation Committee found the Hansen
12 House to be locally significant based on its association with local midwifery as related
13 to owner Anna Marie Hansen and its association with the local Danish agricultural
14 community.

16 D. The following description of the characteristics of the Hansen House justify its
17 designation as a local historic landmark and are excerpts from Susan Clark's
18 evaluation of the Hans and Anna Marie Hansen Homestead, dated May 2003:
19
20 1. The Hansen House is associated with Anna Marie Hansen who was a midwife and
21 evidenced through an outpouring of public comment during public hearings
22 regarding the historic importance of the building was associated with local
23 midwifery in Petaluma.

25 2. The Hansen House is associated-with the local Danish agricultural community in
26 that Hans and Anna Marie Hansen, immigrants from Denmark who became
27 chicken ranchers and built the present farmhouse on the 23 acre site in 1906. The
28 Hansens were part of Petaluma's Danish community at the turn of the 20th
29 century and the house on McDowell Boulevard became a common gathering
30 place for the extended family and friends. In 1930 there were 629 foreign born
31 Danes living in Sonoma County, more than half of whom lived in Petaluma and
32 most of the others were located in the nearby communities of Two Rock,
33 Penngrove, and`Petaluma.

36 E. The following character defining elements of the Hansen House are to be preserved:

38 1. enclosed water tank;
39 2. hipped roof;
40 3. v-rustic siding;
41 4. double hung wood sash windows;
42 5. cutaway front porch;
43 6. structural massing;
44 7. the single Tuscan column supporting the roof over the porch; and
45 8. existing palm trees in front of the building

47 F. The location of the landmark is 718 North McDowell Boulevard and the boundaries of
48 the landmark as the assessor's parcel number 137-061-035.

50 Section 2. Recordation of Designation. The local landmark designation shall be recorded by
51 the applicant with the Sonoma County Recorder's office as a deed restriction applicable to
52 assessor's parcel number 137-061-035. Proof of such recordation shall be provided to the

1 Planning Division prior any building permit final relating to the Planning Commission's approval of
2 13-SPC-0082.

4 Section 3. Severability. If any provision of this ordinance or the application thereof to any
5 person or circumstance is held invalid, the remainder of the ordinance, including the application
6 of such part or provision to other persons or circumstances shall not be affected thereby and
7 shall continue in full force and effect. To this end, provisions of this ordinance are severable. The
8 City Council hereby declares that it would have passed each section, subsection, subdivision,
9 paragraph, sentence, clause, or phrase hereof irrespective of the fact that any one or more
10 sections, subsections, subdivisions, paragraphs, sentences, clauses, or phrases be held
11 unconstitutional, invalid, or unenforceable.

13 Section 4. Effective Date. This ordinance shall become effective thirty (30) days after the
14 date of its adoption by the Petaluma City Council.

16 Section 5. Posting/Publishing of Notice. The City Clerk is hereby directed to post and/or
17 publish this ordinance or a synopsis of it for the period and in the manner required by the City
18 Charter.
