Summary Statement'
The City is initiating the 'annexation proposal to. ensure protection and preservation of the existing habitat and the
numerous species benefitting from the site's environs. No development will occur on the property other than
posting of appropriate signs regarding no trespassing/hunting/fishing and identification of species habitat and
preservation (similar in design. and nature to other educational kiosks along the Petaluma River).

RECOMMENDATION:
The Planning Commission conducted a public hearing on June 23, 2009 and upon conclusion of the
public hearing, moved to recommend, to the City Council, adoption of the following actions:
1. Adopt Resolution finding for a Class 8 Categorical Exemption to the California Environmental
Quality Act;
2. Adopt Resolution approving General Plan Amendment to designate the parcel as Open Space;
3. Introduce Ordinance prezoning of the parcel to P.C.D. (Planned Community District consistent
with the adjacent water recycling facility and public ownership) with a Floodplain overlay with
an amendment to the adopted PCD~to include the open space reference to said parcel; and,
4. Adopt Resolution authorizing, submission of an application to LAFCO requesting annexation
(including amending the City Sphere of Influence) of the parcel to the City of Petaluma,
including detachment from County Service Area No. 40 (Fire Services) and County Serve Area
No. 41 (multiple services).
2. BACKGROUND:
The City of Petaluma purchased the subject property from Christine Hill, et al, in August 2004,
through grant funding provided by the National Oceanic and Atmospheric Administration and the
California Coastal Conservancy. The City water recycling,. ponds are located directly east of the
property; the three parcels. containing the oxidation ,ponds were annexed to the City in September
1986. The 260+ acres containing the Ellis Creek Water Recycling Facility, polishing ponds, trails
and open space .wetlands, located east and northeast of the subject property were annexed in October
2005.
The oxbow curve that forms the north/east/south boundary of the parcel with the existing City limits
was originally the alignment of the Petaluma River; which was bypassed by a United States river
channel straightening project in the early 1900's. The U.S. purchased the necessary right-of--way and
ability to place dredge material on the subject property in 1918 and subsequently completed the

' channel realignment project. The section of the remnant of the original river channel can be seen in
:the, foreground .on the panoramic photo (see AttachmentB,., attached to the Planning Commission.. staff
report).:. Tle old river channel. lies between the water recycling. facility and the Hill property and does
,not break contiguity of City jurisdiction; it is assumed. to remain public lands of the U.S. as an
historic waterway.
3. DISCUSSION:
The Planning Commission <conducted a public hearing. on Tuesday, June 23, 2009.. A Public Notice
on the hearing had been published in the Press .Democrat and notice was mailed to all property
owners within 1,000'. No phone. calls or questions were received and no one spoke at the Public
Hearing. With a motion, approved three to one (Commissioner Burton'abstained), the Commission
recommended approval of all four actions pertaining to the proposed annexation. '
A separate Notice of Public Hearing .for the present action was mailed and published (see Attachment
2). As ofthe writing of this Agenda Bill, no comments had been received.
4, hINANCIAL IMPACTS:
Financial impacts are expected to be minimal. The City currently owns the parcel; the posting of No
Trespassing/No Hunting signs may be placed on the property along the riverfront at a cost of less than
$500. In the: future, should. grant.. funds become available, the property is a potential site for
restoration planting and habitat enhancement work efforts. ~~°

Surrounding the. 74.9 acre parcel on three sides is the City of Petaluma Ellis Creek Water
Recycling Facility, on the fourth side by. the Petaluma River (see Attachment A). No physical
improvements exist on the site. and .none are proposed subsequent to annexation. Access to the
parcel is either by foot through brush from. the perimeter non-public path at the Ellis Creek
facility or by the River, no improvements to access arc planned.

STAFF ANALYSES
General PIan 2025 :Consistency: The 75 acre parcel is currently. not within the Urban Growth
Boundary, Sphere of Influence, or the City Limits, therefore it currently has no General Plan land
use designation. The Ellis Creek.Water Recycling Facility is designated as .Public/Semi-Public,
which. would',serve, on this property as well (see Attachrnent:,D for the current General. Plan 2025
Land, Use 'Map:). H'owever' given the :intent to retain the property as open.. space, City staff
.recommends desrgriafing, the. parcel as Open Space rather than Public/Semi Public..
Tfic City's General Plan 202;5 divides the community into fourteen sub-areas; the Ellis Creek
facility,,. ;is located within the Lakeville ~H,ighway sub-area. Policy 2-P-31 of the'General Plan.

enhancements along: the. Petaluma River and Estuary". In addition; extensive policies are
contained' in Chapter 4, The Natural Environment, calling -.for protection; of habitat -arid special

for Biology aril Natural; .Resources,. pages 4-4 and 4-5 of the General Plan 2025). The proposal..
to designate the property- as Open Space and annex the property into the City to allow
enforcement of no trespassing restrictions is consistent with these preservation policies. The
City currently contains 5'42. acres of Open Space (see. Table 6.1-1 on page 6=5 of General Plan
2025) with an additional .157 proposed through the General Plan implementation period. The:

proposed designation and annexation would add the 74 acres. to the 157 proposed to accomplish
a total of 773" acres of open space .for the community.
Zoning Consistency: The annexation process for the Ellis -Creek facility included an action to
prezone the property to Planned Community District (PCD) with speciftc standards to address
the development and operation of 'the City owned facility (see Attachment E for the current.
Zoning Map). It appears to be most expedient and appropriate to prezone the 74.9 acres to PCD
and include an Open .Space component within the adopted PCD Standards. The prezoning will
also include. a Floodplan overlay designation as is appropriate given the parcel's location,
proximity to the River, and its elevation.
Annexation and -Sphere of Influence: The authority for- annexation and Sphere of
Influence amendments rests with the Local Agency Formation Commission (LAFCO) in
accordance with applicable sections of the Cortese-Knox-Hertzberg Local Government
Reorganization Act of 2000. The .City Council is asked to authorize- the submission of
annexation and Sphere Amendment application forms to LAFCO for their consideration. Once
their authorization is obtained, recordation of the Annexation and Detachment Exhibits will
occur to conclude the annexation process.

A Notice of Public Hearing was published in the Press Democrat on June 12, 2009 and sent to all
property owners within 1,000 feet of the proposed annexation. There are no residences within
1,000' of the property. No written comments or communication have been received at the time
of writing the Commission staff report.-

The proposed annexation is exempt from the California Environmental Quality Act under the
following section:
Class 8: Actions by Regulatory Agencies for Protection of the Environment Consists of
actions taken 'by regulatory :agencies, as authorized by state or local ordinance, to assure, the.
maintenance, restoration, enhancement; or protection of the environment where the regulatory
process invol-ves procedures for protection of the environment.
This crass of exemption, was, selected. since the action to .annex the .property is intended to further
the strength of protecting the environment through the City's ability to enforce the proposed
PCD'"'Standards of open apace, and habitat protection: No further environmental review is
required. A Notice of Exemption -will be filed at time of annexation authorization by LAFCO.

**You are invited to attend a Planning Commission hearing on the
proposed annexation of open space lands at the southeast edge of the City*'*
NOTICE. IS HEREBY GIVEN that the City of ..Petaluma, Water Resources and Conservation Department is processing an
application to complete the annexation of 74.9 acres owned by the City (known as Assessor's Parcel Number 019-330-
009 and the "old Hill property") along the Petaluma River to the City of Petaluma, adjacent to the Ellis .Creek Water
Recycling Facility, located at 4014 Lakeville Highway. The City is initiating the actions to annex the: property to ensure
protection and preservation of the existing habitat and the numerous species benefitting from that. habitat.
The application for review.by the PlanningCommission includes the request to:
1. Approve.a Class 8 Categorical .Exemption to CEQA;
2. prezone'the parcel to P.C.D. (Planned Community District consistent with the adjacent public
facility and ownership) with a Floodplain overlay;
3. .amend the Petaluma General Plan 2025 Land Use Map to designate the parcel as Open Space;
and,
4. annex the property, including. detachment from County Service Area No. 40 (Fire Services) and
County Serve Area No. 41(muitiple services)

NOTICE IS GIVEN Ghat the Petaluma City Council adopted, in August of 2002, a Resolution which approved the
Environmental Impact Report (EIR) for the EIIisCreek Water Recycling Facility. The annexation of this parcel. has been
found to be exempt from the California Environmental Quality Act under the following:
Class 8: Actions by Regulatory Agencies- for Protection of the Environment
Consists of actions, taken by regulatory. agencies, as authorized by state or local ordinance, to .assure the maintenance,
restoration, enhancement, or protection of -the environment where the regulatory process involves procedures for
protection ofthe environment.

1. Pursuant to Section 15378 of the California Public Resources Code, the action by the
City of Petaluma to approve a General Plan amendment to facilitate the annexation of
APN 019-330-009 constitutes a "project" as defined within the California Environmental
Quality Act.
2. Pursuant to Section 21084 of the State of California -California Environmental Quality
Act Guidelines, .known as CEQA, calls for the identification of "classes of projects which
have been determined not to have a significant effect on the environment and which shall
be exempt from this division":
3. Pursuant to Section 15308 of the "Guidelines" Class 8 of the approved list of Categorical
Exemptions states: "consists of actions. taken by regulatory agencies, as authorized by
state or local ordinance, to assure the maintenance, restoration, enhancement, or
protection of the environment where the regulatory process involves procedures for
protection of the environment. Construction activities and relaxation of standards
allowing environs mental degradation are not included in this exemption".
4. The proposed General Plan Amendment to designate the .subject property as Open Space,
the proposed prezoning to PCD, and the proposed annexation is all undertaken by the
City with the intent to preserve and protect'the existing habitat and species existing on the
site and that no development is anticipated-for the property.
5. That the approval of ,~a Class 8 Categorical Exemption for the proposed actions is
appropriate andconsistent with the California Environmental Quality Act and the City of
Petaluma Environmental Review Guidelines.
6;: The preparation ~of a ``Notice of Exemption" pursuant to Section 15374 of CEQA, citing
the Class 8 exemption; is hereby authorized for filing by the City of Petaluma upon
approval .of the General Plan Amendment, prezoning; and annexation of APN 019-330-
009.

1. That the proposed amendment is deemed to :be in the public interest. The amendment'to
the General Plan -land -use map. would ensure that the, existing habitat and species existing
on the subject property "shall be protected and enhancement through the authority held by
the City of Petaluma:
2. That the proposed amendment -is consistent with the initiative and applicable General
Plan Sections pertariing to the Urban Growth Boundary, in that no development or
extension of public services will be provided on this property; therefore, no amendment
to the UGB is proposed in conjunction with this General Plan Amendment.
3. That the proposed actions ("project") are consistent with the General Plan. 2025, in that:
Policy 2-P-31 states: "Enhance ecological diversity, education, and enhancements along
the Petaluma River and Estuary". In addition, extensive policies are contained in Chapter
4, The Natural Env"ronment, calling. for protection of habitat and special status species
and their supporting habitat (see Goal 4-G-1 and applicable policies and programs. for
Biology and Natural Resources, pages 4-4 and 4-5 of the General Plan 2025). The
proposal to desgnate.the .property as. Open Space and annex. the property into the City to
allow enforcement of no trespassing restrictions is consistent with these preservation
policies.
4. That the proposed project will not be detrimental to the public welfare, will be in the -best
interests of the City, and will be in keeping with the general intent and spirit of the
Zoning Regulations of the City..

l . That the Planned Community District will result in a more desirable and cohesive use of
land and a better continuity for the existing living environment on the site than would be
possible under any other zoning district or combination of zoning districts.
The proposed. designation of PCD will allow for the identification of environmental
preservation and protection of the existing and further habitat and species utilizing that
habitat within the adopted PCD Standards, as amended, to be cohesive with the habitat
lands presently existing on the Ellis Creek Water Recycling Facility properties.
2. That the proposed PCD designation is consistent with the provisions .of the applicable
City of Petaluma Zoning Regulations, General Plan 2025, and the Municipal Code.
That the proposed PCD designation is suggested for property which requires no suitable
relationship to one or more thoroughfares as no additional development will be permitted
on the property. Amendments to the existing PCD documents, as set forth below and
further defined in Attachment 'J, provide for identification ~ and protection of the subject
property and are included herein in the prezoning actions.
a. Section 3. Permitted Principal Uses shall be amended to add:
® Open Space for the preservation of habitat and the species dependent upon
that habitat.
b. Section 9. SitePlan shall be amended to add to the last bullet:
o The 75 acres, separated from the remainder of the property by the remnant
riverbed, and purchased by the City in August 2004, shall be preserved as
habitat with no public access expected to occur.
4. That the proposed project will not be detrimental to the public welfare; will be in.the best
interests of the City; and will be in keeping with the ,general intent and' spirit of the
Zoning. Regulations and the General Plan 2025 of the City.

NOTICE IS HEREBY GIVEN that the City of Petaluma, Water Resources and Conservation .Department is processing an
application to complete the annexation of 74.9 acres owned by the.-City (known, as Assessor's Parcel Number 019-330-
009 and the "old Hill property") along the Petaluma River to the City of Petaluma, adjacent to the Ellis Creek Water
Recycling Facility, located at 4014 Lakeville Highway. The City is initiating the actions to annex the property to ensure
protection and preservation of the, existing. habitat and the ..numerous species benefitting from that habitat. The
Planning Commission held a Public Hearing on June 23, 2009 and recommended approval of all actions relating to the
annexation; as set forth below.
The application for review by the City Council includes the request to:
1. Approve a Class 8 Categorical Exemption to CEC1A;
2. prezone the parcel to P.C.D. (Planned Community District consistent with the adjacent public
facility and ownership) with a Floodplain overlay;
3. amend the Petaluma General Plan 2025 Land Use Map to designate the parcel as Open Space;
and,
4. annex the property, including detachment from County Service Area No. 40 (Fire Services) and
County Serve Area No. 41 (multiple services)
No development will occur on'tfie property other than possible. posting of appropriate signs regarding no trespassing
or hunting/fishing and identification of species habitat and preservation (similar in design and nature to other
educational kiosks along the Petaluma River and creek frontages),.

12 SECTION 1, PURPOSE:
13 -
14 The purpose of establishing this Planned Community Development is to regulate the
15 development of the parcels identified above. The uses and standards established by
16 this District are designated to create compatible development of this site with adjacent
17 residential, commercial, park, and agricultural properties, and. to integrate the existing
18 structures with new construction.

20 SECTION 2, PROJECT SITE:
21
22~ The site is located on the south side of Lakeville Highway and is 263.33 acres in size. The
23 parcels are bounded by Lakeville Highway to the east,. Ellis Creek to the south, the
24 Petaluma River to the west, and' Shollenberger Park adjacent to North Bay Business Park
25 on the northern borders of the property,. respectively.

27 Approximately two acres of the site are presently improved with a farm house, fallen
28 barns, driveway and residential yard area. A degraded naval-radar building is located
29 at the mud flat near the Petaluma River.

31 The parcel is presently accessed directly from Lakeville Highway.

33 SECTION 3, PERMITTED PRINCIPAL USES:

35 The following are the principal uses permitted in this PCD District:

37 Administrative offices in support of water recycling operations, laboratory, and
38 maintenance.
39 Laboratory facilities to support analyses, research, educational,. and
40 experimental, testing of water, wastewater, industrial, and storm water as
41 required in support of the City of Petaluma's compliance efforts with the
- 42 regulatory community and education of youth. Indoor hazardous waste storage
43 in the laboratory:
44 Mechanical equipment repair as necessary to support water recycling
45 operations and of times water and storm water operations for the City of
46 Petaluma..
47 Mechanical, electrical, and electrical instrumentation storage and warehousing

1 • Mini telecommunications facilities, in accordance with all applicable provisions
2 of Chapter 14.44 of the Petaluma Municipal Code, which have received site
3 plan and architectural review and approval by the Planning Director.

5 SECTION 6. STREET SYSTEM AND LOT DESIGN:

7 Access to the site will be from Cypress Drive Through a new west access road. (two
8 thirteen foot lanes) as shown on drawing PCD-1. The road is for Petaluma Marsh access
9 as well as recycling.. facility access. Visitors to the Petaluma Marsh will have access from
10 Cypress Drive and can park along the new access road angled parking (18 spaces) or
11 pull into the parking area where an additional 82 spaces are available. Ten of those
12 spaces are for oversized vehicles and four are ADA accessible. A gate is located along
13 the west access road which will be utilized to control public access to the recycling
14 facilities. Right turn only (12 foot wide) .provisions will be made for entrance and exit
15 from the recycling facilities along Lakeville Highway (PCD-2): A right turn pocket will be
16 added to the Lakeville Highway entrance and an acceleration lane will be added for
17 right turn back onto Lakeville Highway. Once on the facility property from Lakeville
18 Highway (two '12 foot lanes), visitors will be directed to the Operations and
19 Maintenance building. because gates block access to the recycling facilities (PCD-2).
20 Facility staff will be encouraged to enter and exit the facilities on and off of Cypress
21 Drive utilizing the traffic light at North McDowell Boulevard fior left turns.
22
23 Once within the recycling facilities, 20 foot private roads are utilized for internal traffic
24 patterns (PCD-1 ).The shoulder width is six foot and made of compacted imported fill
25 material. All rna}or equipment is,surrounded by the private road system allowing access
26 to all the facilities except the east side of the oxidation ditch is made of compacted.
27 gravel (26 feet in width).

29 Visitors to the Petaluma Marsh park their cars within the new parking lot (PCD-3) and
30 walk on trails that allow access to the mud flat and the polishing treatment wetlands,
31 from the polishing treatment wetlands through an agricultural field to the recycled
32 water storage reservoir, point access trails to Ellis Creek at two different locations,, and a
33 trail that ties to Shollenberger Park .(PCD-1 ). Regulatory restrictions from the Department
34 of Fish and Wildlife Services to protect endangered species will .require careful planning
35 of access to various areas of the Petaluma Marsh. The west access road has two
36 thirteen foot lanes.

38 SECTION 7 TOPOGRAPHY:

40 The topography of the site is shown on drawing PCD-4. In ,general, the portions of the
41 site slated for.new recycling. facility structures. will be filled on average to 16.5 feet, a
42 simildr elevafii~on of the adjacent Northbay/Oakmead.Business Park. Fill areas are
43 surrounded by fhe private water recycling facility roads. The clay soil removed prior to
44 the filling operations will be utilized to create the polishing treatment wetlands on the
45 Petaluma Marsh section of the property. The polishing treatment wetlands provide a
46 new,30 we.t acres of~habitat for birds and other wildlife. Existing elevations of 5 feet, 10
4~? feet; and l5 feet are boxed on drawing PC-4.

1 Much of the site: is jurisdictional wetlands (SW-1 and S1N-2, areas in gray)., hence, the
2 layout of the recycling facilities on the site. wetlands d"re defined,'by the soil type, plants
3 that grow there and the hydrology.. Although the site, has been farmed for half a
4 century or more., the soil type and hydrology have made the area a wetland. The
5 placement of the recycling facilities on the site; will utilize only 2.93 acres of the
6 jurisdictional wetland area. The drainage from the-other side of Lakeville Highway has
7 been through .a culvert under Lakeville Highway as designdted on SW-l .This culvert will
8 be extended under the new-facility entrance road to allow for the same drainage into
9 the wetland fhat occurs today. Once construction is finished, the wetland area will be
10 returned to current. grade and°~ggriculturdl farming. Another important drainage area. is
11 located where four 60=inch culverts combine at the•corner of the business park and
12 drain into the coastal marsh boundary area (SW-2):. These culverts will remain as
13 currently designed. Two treesiare located in the middle of the-site. The polishing
14 treatment wetlands have been° designed around fhe two trees that will remain (SW-2).
15 Other tree disturbances" along Ellis Creek will be replaced with a 3:1 ratio and
16 hydroseeded with native grasses-. The Open Space District an,d Coastal Conservancy
17 have provided grant funding to enhance the habitat around the business park as can
18 be seen on the professional landscaping plan (.PCD L-0.3).

20 SECTION 8, LAND USE:
21
22 The land use is designated Public/Institutional for the 40. acre recycling facility site and
23 Public/Institutional with•a conservation easement-(due to-the purchase of this parcel
24 using grant funding) for the Petaluma Marsh site (PCD-5).

26 SECTION 9, SITE PLAN;
27
28 Some highlights of the site plan are as follows (PCD-6):
29
30 The northern section. of the site consists of the Operations, Lab, 8~ Maintenance
31 (O&M) building which will. have a similar administrative use as the adjacent
32 Kaiser facility. Adjacent to the O&M building is an open reservoir for the storage
33 of tertiary treated recycled water (kidney shaped.:). Just east of the reservoir is the
34 cleanest processing area of the facility where already treated water is cleaned
35 further through filters and disinfected using wltra-violet lights. This tertiary treated
36 water will then be distributed' into the community for irrigation ofi golf courses,
37 airport land, and parks. Thus, the site has been designed to position. the cleanest
38 areas~of'the recycling facility functions closest to fhe adjacent. business park:•
39 Just east of the O8~M and tertiary facilities are the oxidation ditches,; secondary
40 clarifiers and secondary treatment facilities: These open topped tanks hold three
41 million gallons, (mg) of. water and.1.3 million gallons of water, each,. respectively
42 .(total volume for oxidation ditches 6 mg and. clarifiers 2.6 mg). Microorganisms
43 use the, wasfe in the water as food. Oxygen is supplied to drive the metabolism
44 reaction. The presence. of oxygen in the wastewater moves the environment
45 from a reducing one. to an oxidizing one, therefore, creating very few odors in
46 thin tired of fhe planf.
47 In the very southern corner of the publicly zoned section (upper 40 acres) of the
48 • site are the head works and solids handling .areas. The head works is the first time
49 the wastewater is exposed to air and thus can °be odorous. The solids handling

1 area can also be:odorous. Thus, all fhe,unt' operations in this area .are designed
2 to be vented through odor control beds located adjacent to the head works
3 structure.
4 ~ €i~e~{~y-tThe Petaluma Marsh section of fhe; project is ocated on'the 223.33 acres
5 designated as~Public/Institutional. The marsh will be enhanced by the~addition of
6 polishing treatment wetlands and trails. Many of the upgrades in this Brea of the
7 site have been funded by the Open-Space bisfirict and Coastal Conservancy.
8 The 75 acres separate from the remainder of the property by the remnant
9 riverbed and purchased by the Cit rLin August 2004, shall be preserved as
10 habitafwith no public access. expected to occur. -

12 SECTION 10, PARKING PLAN:
13
14 The parking plan has Three separate areas (PCD-7).
15
16 1. The first is for the Petaluma Marsh area and consists of 18 spaces of street parking
17 at the entrance jusf off.of Cypress Drive as the. site is accessed (PCD-7). This
18 public parking area is considered'an overflow area.. for adjacent businesses
19 during business hours and the marsh during the weekend hours. This parking area
20 will be paved with asphalt so as to provide adult-free, all weather surface. Each
21 parking space provided shall be designated. by: lines painted upon the paved
22 surface and shall be adequate in area. Parking areas shall be constructed
23 according to plans approved as specified' herein and maintained thereafter in
24 good condition. 'Alk parking; driveway areas, and landscape islands wifhin such
25 areas shall be surrounded by six inch high, continuous concrete curbing. Bumper
26 blocks will not be .used: in This area. No ADA accessible parking will be provided in
27 this area. A sidewalk is provided for safe pedestrian access to the trails.

29 2. The second area is on the marsh site and provides another 27 spaces on the
30 west side of the-main lot and 41 spaces on the east side of`fihe main lot. Four
31 ADA accessible.spaces are located on the west side of the lot as well as ten
32 oversize parking spaces (P'CD-7). Overall, 100 parking spaces are provided for
33 the marsh site. Visitor surveys were conducted at nearby'Shollenberger Pdrk
34 which indicated thatup'to 300 visitors per day accessed that site. The marsh site
35 visitation rate is anticipated to be higher due to the enhanced ,e.ducdtional
36 .components of #he~site, 'thus the expanded parking and oversize parking. A.:ratio
37 of one space per six visifiors has been determined to° provide adequate parking..
;- 38 .Docents a#~Shollenberger Park.le.d 600 children on tours of~,the parkin~the 2003-
39 200.4 school year: The number of docenfi led tours is anficipdted fo increase '
40 :when the marsh 'habitats become available for educational opportunities. Thus a
41 ratio of oversize; vehicle ,parking spaces of l per 30 children visiting the°site on a
42 weekday has been provided. All parking and. loading areas, except the ADA
43 accessible area and oversized spaces, in the marsh area.. are compacted rock.
44 which: is consistent with fhe rustic nature of the Petaluma Marsh. ADA and
45 oversized spaces will.,be asphalt.. Bumper blocks will be used for all ,parking in this
46 aced of 'the project to :define the space. No lines, will be used in fhe compacted
47 ~ rock parking area. A sidewalk exists all the way around fhe parking area to the
48 ~ trail for safe pedesfrian access. '

1 3. The third parking plan is for the O&M,building: The operations and laboratory
2 portion of the administration building.: is 1FO,000 square feet. The anticipated
3 number of employees is 12-14. Thus, the ratio ~is .on_e parking spaceper 715
4 square feet, The maintenance portion of~the building is 4,.400 square feet and
5 consists of warehouse and garage areas and only one parking space is needed
6 for each 900 square feet of gross floor area. Using: these ratios, 19 parking spaces
7 have been provided on the, north .and east sides of the .building with a 20'h space
8 provided on the north side for ADA accessibility. All parking, and loading areas
9 around the 08~M_building shall be paved with asphalt so as to provide dust-free,
10 all weather surfaces. Each parking space provided shall be designated by lines
11 painted upon the paved surface and shall be adequate in area:. All parking,
12 driveway areas; and landscape islands within such areas shall. be surrounded by
13 .six inch high; continuous concrete curbing. Bumper blocks will not be used in this
14 area.

16 All future parkingfacilifies shall conform to City Site Plan and Architectural Design
17 Guidelines. .

45 The landscaping and. tree planting plan are attached as PCDL-0.3 through PCDL-OJ.
46 The plan consists' of-returning much of the overall site back to agricultural land
47 (designation 9 on PCDL-0.3). Oak upland habitat and screening will ~be utilized along
48 the business park dnd adjacent to polishing treatment wetland A. Grassland habitat will
49 be replaced after..development of the polishing treatment wetlands and pipe crossings

1 ~ along Ellis Creek. Polishing treatment wetlands will have,:glt.ernating vegetation and no
2 vegetation to enhance- the treatment wefland envirgnrnent for nutrient removal. Islands
3 will be installed to provide hiding places for;nesting birds..

5 At the facility eritrance'from Lakeville Highway,. two palm trees will designate the 24
6 foot wide. entry road (PCDL-0.4). A hedge row, typical of the farming community, will be
7 used to screen. the tertiary facilities from the Lakeville view corridor while traveling east
8 on ,Lakeville Highway. Coastal Oak and Valley Oak will screen the visitor parking for the
9 OS~M building area from Lakeville Highway. Perennial grasses and oaks will be used
10 around the 08~N1 building for screening. A water conserving demonstration garden will
11 be utilized around the tertiary storage reservoir and an access trail through the
12 agricultural field will end at the garden.
13 ~.
14 At the plant and marsh entrance from Cypress .Drive,. a'row of cottonwood trees will
15 welcome everyone (PCDL-0.5). ,Valley Oak will be utilized to adorn parking spaces
16 along the overflow parking area. Oak trees along with Blue Elderberry and. other plants
I7 as shown will be utilized to screen the main parking and .provide shade in the main
18 parking area. Oak forest with upland native seed mix of grasses will be provided to
19 enhance the trail experience from the parking area to ffi;e.Shollenberger Park
20 connecting trail. Restrooms will,be provided west of the parking lot. An array of woody
21 shrubs such as Toyon, Coast Silk,-tassel, California wild rose:, and trees such as Box Elder
22 will screen the solids handling facilities from the polishing treatment wetlands area
23 (PCDL-0.6). The funding for the screening of the business park and recycling facilities will
24 be from the Coastal Conservancy and Open. Space Districts. Future native species will
25 be planted once the tree canopy is established. Future`planting material is anticipated
26 to be donated through local. community groups.

28 SECTION 13, ELEVATIONS:

30 The elevations of all major structures are listed on drawing PCD-2 as part of the
31 description of each building. The tallest structure is a concrete tank which is 33 feet
32 above grade and located in fhe solids handling area of'the plant (awayfrom Lakeville
33 Highway and the business park). The. elevations for'the::08~M building, filter support
34 building; thickening. building, screw press building;, and. electrical building are shown on
35 the 13 Architectural drawings at fhe end of the packet.

3.7 SECTION 14; DEVELOPMENT SCHEDULE:

39 The EIIis Creek Water Recycling Facility is slated to.go to bid on January l8, 2004:. Bids:
4Q will be opened:on March 10, 2004 and presented to the City Council. for award on April
41 18, 2004. The contractor is anticipated to break .ground. by June 1; 2004. The ,project will
42 take 30 months to build and six months to completely start up. Thus, final completion is
43 anticipated in November of 2008.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PETALUMA
APPROVING'A CLASS 8 CATEGORICAL.EXEMPTIbN FROM THE
CALIFORNIA:ENVH2ONMENTAL QUALITY ACT, FOR THE
GENERAL PLAN AMENDMENT, PREZONING, AND ANNEXATION OF
ASSESSOR'S PARCEL NUIVIBER 019-330-009
WHEREAS, upon evaluation of the proposed project it has been determined that a Class 8
Categorical Exemption pursuant to Title 14. California Code of Regulations, Chapter 3. Guidelines for
Implementation of the California Environmental Quality Act, Section 15308, is appropriate for approval;
and,
WHEREAS, the Planning Commission of the City of Petaluma held a public hearing on June 23,
2009, heard staff recommendations and were available to hear public testimony and recommended to the
City Council approval of the Ellis Creek annexation proposal; and
WHEREAS, the City Council held a public hearing on January 25, 2010 and considered all written
and verbal communications concerning potential impacts resulting from the project before rendering a
decision;
NOW, THEREFORE, BE IT RESOLVED that the City Council adopts the Class 8 Categorical
Exemption, based' on the following:
1. Pursuant to Section 1537.8 of the California Public Resources Code, the action by the City of
Petaluma to approve a General Plan amendment to facilitate the annexation of APN 01.9-330-009
eonstitutes~a "project" as defined within the California Environmental Quality Act.
2. Pursuant to 'Section 21.084 of the State of California -California Environmental Quality Act
Guidelines,: known as CEQA, calls for the identification of "classes of projects which have been
determined not to have a significant effect on the environment and which shall be exempt from
this division"'.
3. Pursuant to Section 15308 of the "Guidelines" Class 8 of the approved list of Categorical
Exemptions states: "consists of actions taken by regulatory agencies, as authorized by state or
local ordinance, to assure the maintenance, restoration, enhancement, or protection of the

environment where; the regulatory process involves procedures for protection of the environment.
Construction activities and relaxation of standards allowing envicon- mental degradation are not
included in this.exemption".
4. The proposed General Plan Amendment to designate the .subject property as Open Space, the
proposed prezoning to PCD, and the proposed annexation is all undertaken by the City with the
intent to. preserve and protect the existing habitat and species existing on the site and that no
development is anticipated for the property.
5. That the"approval of.a Class 8 Categorical Exemption for the proposed actions is appropriate and
consistent with the California Environmental Quality Act and the City of Petaluma Environmental
Review Guidelines.
6. The preparation of a "Notice of Exemption" pursuant to Section 15374 of CEQA, citing the Class
8 exemption, is hereby authorized for filing by the City of Petaluma upon approval of the General
Plan Amendment, prezoning, and annexation of APN 019-330-009.

FINDINGS:.
1. That the Planned Community District will result in a. more desirable and cohesive use of
,land and abetter continuity for the existing living environment on the site than would be
possible under any other .zoning district or combnation.of zoning districts.
The proposed designation of PCD will allow for the identification of environmental
preservation and protection of the existing and further habitat and species utilizing that
habitat within the adopted PCD Standards, as,amended, to be cohesive with the habitat
lands presently existing on the Ellis Creek Water 'Recycling Facility properties.

Planned Comm. unity Development (PCD) Standards
SECTION 1, PURPOSE:
The purpose ofiestablishing this Planned Community Development is to regulate the
development of the parcels identified above. The uses and standards established by
this District are designated to create compatible development of this site with adjacent
residential, commercial; park, and agricultural properties,`.and to integrate the existing
structures with new construction.
SECTION 2, PROJECT SITE:
The site is located on the south side of Lakeville. Highway and, i 263.33 acres in size. The
parcels are bounded by Lakeville Highway to the east; Ellis Creek to the south., the
Petaluma River to the wes ,and Shollenberger Park adjacent to North Bay Business Park
on the northern borders of the property, respectively.
Approximately two acres of the site are presently improved with d farm house, fallen
barns,. driveway and residential yard area. A degraded naval radar building is located
at fhe mud flat nedr;fhe Petaluma River.
The parcel is presently accessed directly from Lakeville Highway.
SECTION 3, PERMITTED'PRINCIPAL USES:
The following are the principal uses permitted in this PCD bistrict:

• Manufacturing of clean water for discharge to the Petaluma River or recycling in
the urban or agricultural setting.
• Manufacturing of biosolids as a by-product of clean water production for reuse
to augment agricultural land with nutrients or as an alternate daily cover on
garbage at local landfills or disposition to a recycling center for further treatment
and reuse. All associated truck traffic for biosolids movement from the site.
• Public corporation yard.
• Storage of chemicals in support of recycling facility goals: above ground
storage of diesel'fuel (8,000 gallons) for power back up system; chemicals for
tertiary treatment and disinfection; polymers #or biosolids thickening and
dewatering; grease, oils, coatings, paints, and all others as required for
maintenance of the facilities. Vented storage space for paints, cleaners, and
other maintenance related materials is provided. Delivery of bulk material via
semi-truck or chemical tank truck.
• Communication equipment as needed for control of the facilities and
communication to the City's other facilities (pump stations, water department,
etc.).
• Agriculture as a continuation of the existing land use.
• Light metal and. steel fabricating shops, tooling and machine shops where stock
of finished material is kept indoors or in a covered storage area integral to the
maintenance shop.
• Caretaker residence (Ordinance 1930 N.C.S., 8/93)
• Creation of wastewater wetlands for storage and further polishing of recycled
water prior to discharge to the Petaluma River or further reuse in the agricultural
and/or the urban setting.
• Recreational and educational use of the Petaluma Marsh and trail access
integral to this. new site and a new trail connection to Sholleriberger Park.
• Operi Space for the preservation of habitat and the species dependent upon
that habitat.
SECTION 4, PERMITTED ACCESSORY USES:
The following accessory uses permitted in this PCD District:•
• Accessory uses and buildings customarily appurtenant to a permitted use,'in
accordance with the provisions for primary uses and structures in this District.
• Development of a visitor center with classroom facilities.
• Development of a laboratory outside or inside for the enrichment of children in
grades'K-college.
• Renovation or replacement of the farm .house for use as a visitor center or for use
as a residential dwelling for premises caretaker.
• Signs, in accordance with the provisions of Section 21-204.
SECTION 5, CONDITIONAL USES:
The following are the conditional uses permitted in this PCD District, in accordance with
the provisions of Article 21 and Section 26-500.

• Mini telecommunications facilities, in accordance with all applicable provisions
of Chapter`l 4:44 of the Petaluma Municipal Code, which have.`received site
plan and architectural review and approval by the Planning Director.
SECTION 6, SfiREET SYSTEM AND LOT DESIGN:
Access to the site. will be from Cypress Drive: through a new west access. road (two
thirteen foot lanes) as shown on dravying P.CD: l .The road is for Petaluma. Marsh access
as well as recycling facility access. Visitors to the Petaluma Marsh will have access from
Cypress Drive and can. park along the new access road angled parking (18 spaces) or
pull into the parking :area where an additional 82 spaces are :available. Ten of those
spaces are for oversized vehicles and four are ADA accessible. A gate is located along
the west access road which will be utilized to control public access to the recycling
facilities. Right turn only (12 foot wide) provisions will be. made for entrance and exit
from the recycling facilities along Lakeville Highway (:PCD-2). A right turn pocket will be
added to the Lakeville Highway entrance and an acceleration lane will be added for
right turn back onto Lakeville Highway. Once on the facility property from Lakeville
Highway (two 12 foot lanes), visitors will be directed to_fhe Operations and
Maintenance building because gates block access to the recycling facilities (PCD-2).
Facility staff will be encouraged to enter and exit the facilities on and off of Cypress
Drive utilizing the traffic light at North McDowell Boulevard for left turns.
Once within the recycling facilities, 20 foot private roads are utilized far internal traffic
patterns (PCD-1 ).The shoulder width is six foot and made of compacted imported fill
material.: All major equipment is surrounded by the private road system allowing: access
to all the facilities except the east side of the oxidation ditch is made of compacted
gravel (26 feet in width).
Visitors to the Petaluma Marsh park their cars within the new parking lot (PCD-3) and.
walk on trails that. allow access to the mud flafi and the polishing treatment wetlands;
from the polishing treatment wetlands through an agricultural field to the recycled
water storage reservoir, point~access trails to Ellis Creek at two different locations, and a
trail that ties to Shollenberger Park (PCD-1 ). Regulatory restrie.tions from the Department
of Fish and Wildlife Services to protect endangered species will require careful planning
of access ~to various areas of the Petaluma. Marsh-:.The west access road has two
~thrfeen foot lanes. '
SECTION T, T;.OPOGRAP'WY.
The topography'of the' ite is shown on drawing PCD-4: In general, the portions of the
site slated for new recycling facility structures will be filled on average to 16.5 feet, a
similar elevation of the adjacent Northbay/Oakmead.Business Park. Fill areas are
surrounded by the private-water recycling facility roads. The clay "soil removed prior to
the filling operations will be utilized to create the polishing. treatment wetlands on the
Petaluma Marsh section of the property. The. polishing treatment wetlands .provide a
new 30 we:t acres of habitat for birds and other wildlife. Exis .ing elevations of 5 feet, 10
feet, and 15 feet are boxed on drawing PC-4.,

Much of the site; is jurisdictional wetlands (SW-1, and'SW-2, .areas in gray.); hence,. the
layout of the recycling facilities on the site:. Wetlands are defined by the soil type; plants
that grow .there and: the hydrology. Although `fhe site has been #arrned for half a
century or more, the soil type and hydrology have made the area a wetland. The
placement of fhe recycling facilities on the site will utilize only 2:93 acres of the
jurisdictional wetland area:: The drainage from the other side o.f Lakeville Highway has
been through a culvert under Lakeville Highway as`designated on SW-1. This culvert will
be extended under the new facility' entrance road to allow for the same drainage into
the wetland that occurs today. Once construction is finished, •the wetland area. will be
returned to current grade and agricultural. farming. Another importdnt drainage area is
located where four 60-inch culverts combine at the corner of the business park and
drain into the coastal marsh boundary area (SW-2). These culverts will .remain as
currently designed. Two trees are:located in the middle of'the site. The polishing
treatment wetlands have been designed around the two trees that will remain (SW-2).
Other tree disturbances along Ellis Creek will be replaced vyith a 3:1 ratio and
hydroseeded with native grasses. The -Open Space District and Coastal Conservancy
have provided grant funding, to enhance the habitat around the business park as can
be seen on the professional landscaping plan (PCD' L-0.3).
SECTION 8, LAND USE::
The land use is designated Public/Institutional for the 40 acre .recycling facility site and
Public/Institutional with a, conservation easement (due to the purchase of this parcel
using grant funding) for the Petaluma Marsh site (PCD-5).
SECTION 9, SITE PLAN:
Some highlights of the site plan are as follows (PCD-6):
o The. northern section. of the site consists of the Operations, Lab., ~ Maintenance
(O8~M) building which will have a similar administrative use as the adjacent
Kaiser facility. Adjacent to the O&M building is an open reservoir for the storage
of tertiary freate,d recycled water (kidn`ey shaped). Just east of the reservoir is the
cleanest processing area of the facility where. already treated water is cleaned
further through filters and disinfected using ultra=violet lights. This tertiary treated.
waterwill then be distributed into the community for-irrigation of~~golf courses,
airpoct;land„and ,parks. Thus, the site has been designed to position he cleanest
areas of the recycling facility funcfions closest to the adjacent business park.
• v Just east of, the:O8~M and tertiary, facilities are the oxidation ditches, secondary
clarifiers and secondary treatment facilities. These open topped.tanks.hold three
million gallons (rrigl)''of water and 1.3 million gallons of water, each, respectively.
(totaf volume for oxidation ditches 6 mg and clarifiers.2:6'mg}. Microorganisms
use the~waste in the`.water as food. Oxygen-is supplied to drive the metabolism.
reaction. The.presence of oxygen in fhe wastewater moves the environment
_•~ from .a.re,ducing:one to an oxidizing one, therefore, creating very few odors in
this area of'the plant.
o In the verysouthern corner of the publicly zoned section (upper 40 acres) of the
site are the head works and solids handling areas. 'The head works is fhe first time
the:wastewater is exposed to air and thus.can be odorous. The solids handling

area can also be odorous. Thus, all theunit operations in this area are designed
to be vented; through odor control beds located adjacent to the head works
structure.
The. Petaluma Marsh section of the project is located on the 223.33 acres
designated. as Public/:Institutional. The marsh will be enhanced by the addition of
polishing treatment wetlands and trails. Many of the upgrades in this area of the
site have been funded by t;he Open Space District and Coastal Conservancy.

SECTION 10, PARKfNG PLAN:
The parking plan has three separate areas (PCD-7).
The first is for the~Petaluma,'Marsh area and consisfs of Y8 spaces of street parking
at the entrance just off of Cypress Drive as the site is accessed (PCD-7). This
public parking area is considered an overflow area for adjacent businesses
during business hours.~and the marsh during the'weekend hours. This parking area
will be paved with asphalt so as to provide adult-free, all weather surface. Each
parking space provided shall be-designated by lines painted upon the paved
surface and shall be adequate in area. Parking areas shall be constructed
according to plans approved as specified herein and maintained thereafter in
good condition. All parking, driveway areas, and landscape islands within such
areas shall be surrounded by six inch high, continuous. concrete curbing. Bumper
blocks will nat be used in this .area. No ADA accessible parking will be provided in
this area.. A sidewalk isprovided for safe pedestrian access to the trails.
2. The second area is on the marsh site and provides:another 27 spaces on the
west side of the main lot and 41spaces on the east side of the main lot. Four
ADA accessible spaces are located on fhe west side of the lot as well as ten
oversize parking,~spnces (PCD-7). Overall, 100 parking spaces are provided for
the marsh site. Visitor surveys were. conducted at .nearby Shollenberger Park
which indicated'that up to 300 visitors. per day accessed that site. The marsh site
visitation rate is anticipated to be higher due to the enhanced educational
components, of the site; thus the expanded parking and .oversize parking. A ratio;

of one space per.~six visitors has been .determined to provide adequate parking.
pocents.at Sholl,enberger Park led 600 children on tours of the park in the 2003-
2004 school; year. The number of docent led tours is anticipated to increase
`when the marsh habitats become available for educational opportunities. Thus a
ratio of oversize vehicle .parking spaces of 1 per 30 children visiting the site on a
weekday has been provided. All parking and loading areas, except the ADA
accessible area ,and oversized spaces, in the marsh. area are compacted-rock
which:. is consistent with the rustic nature of the Petaluma Marsh. ADA and
over5ized'spaces will 'be asphalt. Bumper blocks will be used for all parking in this
area of'fhe project to define the space. No linen will be used in the compacted
rock parking area. A sidewalk exists all the way around the parking area to the
trai(for safe pedestrian access.

3. The third parking plan is for the 08~M, building,; The operations and laboratory
portion of the administration building is 10;000 square feet. The anticipated
number of employees is 12-14. Thus, the ratio is one parking space per 715
square'feet. The maintenance portion of the building is 4,400 square feet and
consists. of warehouse and garage areas and only one parking space is needed
for each. 900 square feet of gross floor area. Using thes"e ratios, 19 parking spaces
have been ,provided on the north and•east sides of the building-with a 20'h space
provided on the north side for ADA accessitjility. All parking and loading areas
around the Q&M building shall be paved wifh asphalt so as to provide dust-free,
all weather surfaces: Each parking space provided shall be designated by lines
painted upon the. paved surface and shall be adequate in area. All parking,
driveway areas, and landscape islands within, such areas shall be surrounded by
six inch high, continuous concrete curbing. Bumper blocks will not be used in this
area.
All future parking facilities shall conform to City Site. Plan and Architectural Design
Guidelines.

SECTION 12; .LANDSCAPE:AN'D TREE PLANTING PLAN:
The landscaping and`~tree planting plan are attached as PCDL-0:3 through PCDL-OJ.
The- plan consists; of returning much: of the overall. site back to agricultural Idnd
(designation 9 ori~~PGDL-0.3). Oak upland habitat and screening will be utilized along
the business park and adjacent.to polishing treatment wetland A. Grass{ana habitat wily
be replaced after development of the polishing treatment wetlands and pipe crossings

along Ellis Creek, Polishing treatment wetlands will have d(ternating vegetation and no
vegetation #o enhance the treatment wetland environment for nutrient removal. Islands
will be installed to provide hiding places for nesting bird's.
At the facility entrance-from Lakeville Highway, two palm trees will designate the 24
foot wide. entry road (P'CDL-0.4). A hedge row, typical-of~fhe farming community, will be
used to screen the tertiary facilities from the. Lakeville view corridor while traveling east
on Lakeville Highway. Coastal Oak and Valley Oak will, screen the visitor parking for the
08~M building area from Lakeville Highway. Perennial grasses and oaks. will be used
around the 08~M building for screening. A water conserving demonstration garden will
be utilized around the tertiary storage' reservoir and an access trail through the
agricultural.field will end at the garden.
At the plant and marsh entrance from Cypress Drive, a row of cottonwood trees will
welcome everyone (PCDL-0.5). Valley Oak will be'u,tilize.d to adorn parking spaces
along the overflow parking area. Oak trees along wifh' Blue Elderberry and other plants
as shown will be utilized to screen the main parking and "provide shade in the .main
parking area. Oak forest with upland native seed m'ix of grasses-will be provided to
enhance the trail experience from the parking area to the`Shollenberger Park
connecting trail. Restrooms~will be provided west. of. the parking lot. An array of woody
shrubs such as Toyon, Coast Silk- asset, California wild: rose; and trees such as Box Elder
will screen the solids handling facilities from the polishing treatment wetlands area
(PCDL-0:6). The funding for'fhe screening of the business park and recycling facilities will
be from the Coastal Conservancy and Open Space Districts.. Future native species. will
be planted once the tree canopy is established. Future planting material is anticipated
to be donated through local community groups.
SECTION 13, ELEVATIONS:
The e evations of all major struc.fures are listed on drawi'n'g PGD-2 asp part of the
description of each building. The tallest structure is a concrete tank which is 33 feet
above grade and located in the solids handling area of the plant (away from Lakeville
Highway and the business park)., The elevations for th.e;0&N1 ;building, filter support
building, thickening building, screw press building, a- nd ~eleetrical building are shown on

SECTION 14, DEVELOPMENT SCHEDULE:
The',Ellis Creek Water Recycling Fdcility is slated'.to go to bid 'on January.l8, 2004. Bids
will be opened on March ~l 0,.2004 and presented to the City Council for award .on April
18, 2004. The contractor is anticipated to break ground by June l , 2004. The project will
take 30 months~to build and six months to completely start up. T,h. us, final completion is
anticipated in November of 2008.

5 SUPPORTING AN APPLICATION TO
6 THE LOCAL AGENCY FORMATION COMMISSION (LAFCO)
7 FOR ASSESSOR'S PARCEL NUMBER 0.19-330-009
8 COMPRISING A 74.9 ACRE PARCEL OWNED BY

15 WHEREAS, after public review and input, the City Council of the City of Petaluma adopted
16 under Resolution No. 2010- N.C:S., the Categorical Exemption from CEQA for the proposed
17 annexation; and,

19 WHEREAS, consistent with implementing the project, which includes a General Plan
20 Amendment and prezoning the subject property, it is appropriate to annex the property known as
21 Assessor's Parcel Number 01.9-330-009.

23 NOW, THEREFORE, BE IT RESOLVED that pursuant to the Municipal Organization Act
24 (Government Code 35000 et.Seq.) the Petaluma City Council hereby supports and directs the filing of an
25 application to the Local Agency Formation Commission of Sonoma County for a proposed reorganization
26 as follows:
27 An annexation of approximately 74.9 acres located adjacent to 4104 Lakeville Highway
28 (including amending the City Sphere of Influence) to the City of Petaluma, including
29 detachment from County Service Area No.'40 (Fire Services) and County Serve Area No.
30 41 (multiple services). .

32 BE IT FURTIIER•RESOLVED that the reasons for the requested reorganization are:

34 1. This annexation and Sphere of Influence amendment will enable several policies within the
35 General Plan to be achieved including the preservation of open space and riparian habitat along
36 the Petaluma River through the protection of City ownership and police powers.

38 2. That the proposed annexation and Sphere of Influence amendment is consistent with the Goals,
39 Policies; and Programs of the General Plan 2025 Land Use and Natural Environment Elements to
40 ensure that riparian and adjacent habitat is maintained and protected.

3. That the owner of said. property, being the City of Petaluma, has initiated said annexation and
Sphere of Influence amendment.
4. That the City of Petaluma does not, at this time, propose to expand or modify the City's Urban
Growth Boundary as no "urban development", as defined in the applicable UBG policies, or
extension of utilities is proposed for this property.
5. That the proposed project has complied with the requirements of CEQA through the approval of a
Class 8 Categorical Exemption for the proposed actions, and no further environmental analysis is
necessary.
