AUTHORIZING THE CITY MANAGER TO EXECUTE AGREEMENTS FOR USE OF
RECYCLED WATER WITH THE AGRICULTURAL RANCHERS IN SUPPORT OF
RECYCLED WATER APPLICATION ON AGRICULTURAL LAND

WHEREAS, the Regional Water Quality Control Board prohibits the City from
discharging treated effluent into the Petaluma River from May 1 to October 20; and,
WHEREAS, the application of recycled water on agricultural land is included in the
Department of Water Resources and Conservation Fiscal Year 2003-2004 Operations and
Maintenance Budget; and,
WHEREAS, the program involves the application of approximately 550 million gallons
(1690 acre-feet) of secondary recycled water from the City's oxidation ponds at 4400 Lakeville
Highway to seven ranches northeast of the ponds; and,
WHEREAS, it is estimated that the annual amount of water not discharged to the
Petaluma River but instead recycled on agricultural land is 37% of all wastewater generated from
the City; and,
WHEREAS, an agreement with the ranchers for agricultural reuse of recycled water will
support compliance with the requirements of the Regional Water Quality Control Board.
NOW, THEREFORE, BE IT RESOLVED by the Petaluma City Council that:
1. The above recitals are true and correct and hereby declared to be findings of the City
Council of the City of Petaluma.

2. The City Manager is hereby authorized and directed to execute an agreement with the
ranchers subject to the review and approval of the City Attorney.
3. This resolution shall become effective immediately.
4. All portions of this resolution are severable. Should any individual component of this
resolution be adjudged to be invalid and unenforceable by a body of competent
jurisdiction, the remaining resolution portions shall be and continue in full force and
effect, except as to those resolution portions that have been adjudged invalid. The
City Council of the City of Petalu>na hereby declares that it would have adopted this
resolution and each section, subsection, clause, sentence, phrase and other portion
thereof, irrespective of the fact that one or more section subsection, clause sentence,
phrase or other portion maybe held invalid or unconstitutional.
Under the power and authority conferred upon this Council by the Charter of said City.
